that we have funds in the current bond account to cover that work. You also agreed to note on an interim

The plan was reviewed for conformance to the 1972 Town of North Andover Zoning Bylaw(last amended
July 10,2006). The Applicant has submitted the following information for VHB's 2nd review:
• Response to comments letter,with Appendixes A through H dated August 22,2007,
• Site Plans(10 Sheets+Cover)dated July 5,2007 with revisions through August 22,2007.
The following comments note non-conformance with specific sections of the Zoning Bylaw or
questions/comments on the proposed design and VHB's recommendations/suggestions. Original comments
are in regular font,with follow-up comments in bold.
Town of North Andover Zoning Bylaw
1. Section 6—It is not clear where the Facility Entrance Sign(See Sheet 4,note 3)is to be located. The
Applicant should clarify on the plans.
Addressed.
2. Section 8.1—The Applicant should justify the location of the accessible parking space near the
proposed scales. VHB suggests moving this accessible space closer to one of the building entrances.
Addressed.
3. Section 8.3.5.e.i—VHB suggests including a north arrow on the cover sheet Site Locus.
Addressed.
4. Section 8.3.5.e.iii—The address and telephone number of the Applicant(TBI,Inc.)should be included
on the plans,as required by this section.
Addressed.
5. Section 8.3.5.e.ix—The Applicant has provided a perspective rendering of the proposed facility,
however this section requires a front view elevation plan. The elevation plan should identify the
building elevations.
Partially addressed. The intent of the comment was to get a building elevation plan,front view,
showing the height of the proposed building,as required by this section. Although the
renderings are informative,VHB suggests also providing a preliminary elevation plan,or request
a waiver from this section. At a minimum,the proposed building height should be included in
the dimensional chart on sheet 1.

6. Section 8.3.5.e.xv—Tree and Shrub Planting details should be provided.
Partially addressed. A Shrub Planting detail has been added,however a Tree Planting detail has
not been added to the plans.
7. Section 8.3.5.e.xvii—Is it the intent to only illuminate the immediate vicinity of the proposed facility?
Will any other activities require lighting near the scales or bins,such as early morning or night work?
Partially addressed. The Applicant states in his response that additional lighting will be
provided at the scale house. The Proposed Photometric Plan should reflect all proposed lighting.
General Comments
8. The Applicant should clarify why there is such a large paved area east of the proposed facility. The
proposed use of this area is not clear.
Addressed.
Drainage Comments
9. A catchment area plan should be provided for the pipe capacity calculations.
Addressed.
10. VHB suggests providing a double catch basin where more than 20,000 square feet(sqft)of drainage
area contribute to a drainage structure. Therefore,CB-3,CB-4,CB-7, CB-8,CB-11,CB-12,CB-18
should be double catch basin structures. Also,wherever there is more than 20,000 sgft of contributing
area into a catch basin structure,VHB suggests increasing the pipe size to a minimum of 15"diameter.
Addressed.
11. The Applicant should verify the constructability of the proposed manholes. It appears some manholes
have several pipes connecting into them at tight angles(i.e.DMHs 2 and 3).
Addressed.
12. The Applicant should provide groundwater elevations at the location of the proposed underground
detention system. A clearance of 2 feet has to be maintained between the groundwater elevation and
the bottom of the infiltration system. Test pit logs should be provided for the proposed location of the
underground detention system.
Partially addressed. The Applicant states that test pits information will be provided when they
become available. Test pits are scheduled to be conducted on September 4,2007.
13. The Applicant should provide specifications of the Brentwood Stormtank System. A plan view should
be provided in the detail sheets,along with the cross-section view. Also the outfall pipes(12"and 36")
modeled in the Pond Pack routing should be indicated on the plans. It is not clear where their locations
are in the plan and details provided.
Addressed. The applicant should verify the height of the headwall on Section BB.
14. The Applicant should provide a cross-section detail of the proposed swale on the southern side of the
site. Is vegetation proposed in the Swale? Does the swale provide added treatment to the runoff? VHB
recommends placing a trash grate at the the end of the trench drain and at the entrances of the 12"
culvert under the truck parking spaces.
Addressed.

15. VHB suggests calculating the runoff for the 2, 10 and 100 year storms flowing into the proposed swale
at the southern side of the site(trench drain and open ditch). This would verify that the swale will not
overflow into the parking lot.
Addressed.
16. Water quality volume calculations should be provided in the report. The first inch of runoff shall be
treated.
Addressed.
17. Erosion and sediment controls shall be in effect prior to commencement of each increment/phase of the
construction of the underground detention system. Erosion and sedimentation control elements should
be included in the stormwater management system plan and their details should be included in the
detail sheets.
Addressed.
18. A FEMA map should be included in the report to verify that the site is out of the 100-year flood plain.
Addressed.
Massachusetts DEP Stormwater Management Standards
The Applicant has not provided the Massachusetts Stormwater Management Form for the original
design showing whether the proposed drainage system is compliant with all 9 Stormwater
Management Standards of the Massachusetts DEP Stormwater Policy Handbook of 1997. The
standards are listed below. However,VHB has provided comments on whether each of the standards
is addressed by the current design:
e) Stormwater discharges from areas with higherpotential pollutant loads require the
use of specific stormwater management BMP's. The ttse of infiltration practices
without pretreatment is prohibited.
The applicant should verify that the proposed used is not an area of higher potential
pollutant loads to verify this standard.
Addressed.
It is recommended that the Applicant provide WRITTEN RESPONSES to the issues and comments
contained herein.

Town of North Andover Zoning Bylaw
1. Section 6—Are new signs proposed?
2. Section 8.1 and 11.4.4—The Applicant should submit revised parking space calculations.
3. Section 8.1 and 11.4.4—The Applicant should clarify on the plans where the reserved parking spaces
for residents and visitors are located. Note that there are currently 31 spaces provided in the lot along
Water Street. As specified in Section 8,2 spaces are required per dwelling unit. There are 20 units,
therefore if this is to be the designated residential lot,additional spaces are required.
4. Section 11.3.2.a—VHB suggests clarifying on the plans that RCG North Andover Mill LLC is the
Applicant.
5. Section 11.3.2.g—The Applicant should provide soil conditions and show areas of slopes over 12%,as
required by this section,or request a waiver.
6. Section 11.3.21—Has the Applicant looked at impacts on public utilities due to the change from office
space to residential space,as required by this section?
7. Section 11.3.2.i—Are there any environmental concerns related to this Planned Development District?
The Applicant should provide a narrative,as required by this section.
General Comments
8. Has a Traffic Analysis been prepared that considers the revised uses?

9. VHB offers the following comments regarding consistency:
a. The Preliminary Plan specifies"Residential on Second Floor",however the architectural plans
show proposed units on the 3rd,5d'and Mezzanine levels.
b. The Preliminary Plan is sheet 1 of 4. Are there additional sheets for review?
c. The Memorandum in Support of Application refers to Exhibits B through I,however none of
the additional plans are titled as exhibits.
10. Is adequate emergency access provided to the residential units? Has the North Andover Fire
Department reviewed the plans?

Regarding our conversation about TBI and installing transponders here is what I have designed �
for the Of course having design
does not mean that it can be done easily and there are cost factors involved for this version that will reduce you administration time and
costs as well as traffic enforcement by NAPD. In the diagram you will see 7 Transponder Receiver Locations.The combination from
transponders 1,2,3 and 4 will monitor normal truck traffic in and out of holt road and which location they went to along with the time
entering and leaving.Transponders 5,6 and 7 will monitor North Andover's permitted truck routes for authorized vehicles and monitor any
vehicle traveling from Rt 125 North and passing Rt 133.This will clearly show if a vehicle traveled through the town with out a'All Road"
permit and it will also track if they went to any of the Holt Rd facilities. It will also monitor if a truck entered from Rt 133 and if they had the
right permit.
This plan requires the following:
ALL Trash trucks must purchase a transponder which will be their permit,they will also have the annual sticker currently used on the front
bumper.
Transponders will be color coded to the current scheme used today with white added for general commercial traffic that will only use the
designated 1495 t R1125 Route.All other permitted trucks will have corresponding color coded transponders tha(wiUdotheaame
as
the white generic ones but will also track if they are permitted to use the town roads when they exit Holt Rd or if they pass the intersection
of Rt 133 and Rt 125 on the way to Holt rd.Any White Transponder that turns right when leaving or passes Rt 133 and Rt 125 is in
violation and should be notified and or warned. Police can have a portable scanner in their police cars that will immediately determine if
the truck is properly permitted to travel on North Andover Roads and the transponders will be mounted in such a way that police can
visibly see the color of the transponders. On a yearly basis the transponders will be renewed otherwise they will be picked up if used as

expired.
To reduce the cost and time of administration, reconciling the truck counts recorded from Wheelabrator and T.B.I. should match exactly to
all trash trucks that entered and exited Holt Rd. Obviously this will not always be perfect but you will now have documented proof that
trucks are being allowed to use the facility with out proper permitting or using the facility without being properly recorded into the logs.
Now all I have to do is find a company that can install this and give us a quote for the job. Due to possible cost problems we may have to �
drop receivers G&7 because of the distance but lets see first. |

Proposal:
The applicant,Thompson Brothers Industries,Inc.,is seeking a Site Plan Special Permit to construct a
30,000 s.£ recycling facility and solid waste transfer station,extensive grading and landscaping,and lighting

➢ This is the 2°d Public Hearing for the Application. Planning Staff and VIIB completed their first review
dated August 3 and August 7, 2007 respectfully. The applicant submitted responses to both reviews
dated August 22,2007. VHB is currently reviewing said responses.
➢ The purpose of this meeting is to discuss the following:
1. Brief overview of application to date&General discussion of revisions to plan set.
2. Site Plan Special Permit Application compliance with the Site Assignment Decision.
3. Discussion of Conditions within the Site Assignment Decision.
4. Filing of an ANR(Form A)Plan to combine Lots 1-3.
➢ The proposed facility is located at 210 Hold Road, which consists of the site assigned area of three
parcels totaling 5.8 acres of industrially zoned land. The western portion of the site (approx. 2 acres)
serves as a maintenance and office facility for the existing solid waste transportation business. The
remaining two parcels of site assigned area has been in use since 1984 as a yard for solid waste transfer
trucks and trailers. In September 2006,TIB purchased the lots to the east to construct the recycling and
transfer facility, stormwater management, and yard for transfer trucks and trailers.
➢ On May 9, 2005, the Massachusetts Dept. of Environmental Protection issued a Determination of Site
has been signed by the abutter, Joseph Cristaldi, Holt Road Excavators, LLC. and provided in
Attachment G of the Site Plan Review Application.
The applicant will need to submit the legal document describing the easement. Said document
will be then be reviewed by the Planning Department. A copy of the final easement must be
recorded with the Registry of Deeds and a certified copy of the recorded document filed with the
Planning Office.
Comment Addressed. TBI requests that this item be a condition of the special permit issued by the
Planning Board. TBI will provide the Planning Department with a copy of the final drainage easement,the
design of which is contingent upon input from the Planning Department,the Conservation Commission,
and DEP. Proof that the easement has been recorded by the Registry of Deeds will be provided to the
Planning Department.
V. TOPOGRAPHY: This has been provided on the site plan at two-foot intervals.

vi. ZONING INFORMATION: A zoning chart has been included on the Plans submitted located on
Sheet 1. The application indicates that the site is located within the Industrial 2 zoning district.

vii. STORMWATER DRAINAGE: A stormwater analysis for the pre- and post-development
conditions for the site have been performed by the appllicant. Below please find VHB's
comments:
1. A catchment area plan should be provided for the pipe capacity calculations.
The applicant provided a Catchbasin Area Plan in their revised responses (Attachment B) and is
currently being reviewed by VHB.
2. VHB suggests providing a double catch basin where more than 20,000 square feet (sqft) of
drainage area contribute to a drainage structure. Therefore, CB-3, CB-4, CB-7, CB-8, CB-
11, CB-12, CB-18 should be double catch basin structures. Also, wherever there is more
than 20,000 sgft of contributing area into a catch basin structure, VHB suggests increasing
the pipe size to a minimum of 15"diameter.
The applicant provided a Catchbasin Area Plan in their revised responses and is currently being
reviewed by VHB.
3. The Applicant should verify the constructability of the proposed manholes. It appears some
manholes have several pipes connecting into them at tight angles (i.e.DMHs 2 and 3).
The applicant included the requested information and is currently being reviewed by VHB.
4. The Applicant should provide groundwater elevations at the location of the proposed
underground detention system. A clearance of 2 feet has to be maintained between the
groundwater elevation and the bottom of the infiltration system. Test pit logs should be
provided for the proposed location of the underground detention system.
Test pits are scheduled to be conducted within the area of the underground detention system
for September 4, 2007, and the results will be forwarded upon completion. The clearance of
ix. BUILDING ELEVATION: The applicant provided an architectural rendering(Figure 2) from the
vantage point of Holt Road.
The applicant will need to provide additional elevation drawings showing the entire proposed
structure from all vantage points. Further, the architectural plans should be incorporated into
the site plan review plan set.
Partially Addressed. Final architectural drawings are not yet completed for the project.
The applicant states that final drawings will be submitted as part of the building permit
application. Planning Staff will defer to the Planning Board for the final decision.
X. LOCATION OF PARKING/WALKWAYS: The applicant is proposing 60 additional car and
truck parking spaces related to the 30,000 s.f.building. The existing structure

or the parking spaces when the scales are in use. Addressed.
3. The applicant should explain if the 16 parking spaces directly in f-ont of the proposed
structure are to be utilized by larger vehicles or employee parking. The parking spaces
measure approximately 28 ft. x 12 ft. Addressed.
4. The plans should be revised to indicate employee parking. Partially Addressed on Sheet 4.
The applicant should include signage designating employee parking. The details of said
signage should be included on Sheet 10.
xi. LOCATION OF WETLANDS/NOTICE OF INTENT: The site plan states that wetlands exist
within 100' of the project. As such, the applicant will be required to file with the Conservation
Commission for a Notice of Intent.

xii. LOCATION OF WALLS/SIGNS: The applicant has not submitted a signage plan or details of
proposed directional signs. The applicant should revise the plan set to include details of all
proposed directional signage on the site.
Partially Addressed. Sheet 4 indicates the locations of signage on the site. The applicant further
comments that all traffic signage will meet the requirements of the MA Highway Standards.
Details of the facility sign and signage details have been added to Sheet 10. Planning Staff
requests that addition information be added to Sheet 10 showing the dimensions of the facility
sign and that all onsite and offsite signage be reviewed and approved by the Inspector of
Buildings.
xiii. LOCATION OF ROADWAYS/DRIVES: Access to the site will be from 4 curbcuts off of Holt
Road. The applicant should verify if the proposed aisle widths meet the 25'requirement as stated
in Section 8.1.7.

Partially Addressed. TBI submitted a formal request for a waiver to omit the need to review the
traffic study under this application. The Planning Board will need to discuss this issue and then
vote to grant/deny the waiver.
xx. EROSION CONTROLS: The applicant will be required to provide details relating to the erosion
control plan.
Comment Addressed. The plans have been revised to include erosion control details (Sheet 2)
and details of the proposed siltation barriers are shown on Sheet 9. Further,TBI has submitted a
NOI application with the Conservation Commission and will be preparing a CSWPPP in

the facility to be located on the 5.8 acres of land located at 210 Holt Road.
General Comments:
➢ This is the 3d Public Hearing for the Application. Planning Staff and VHB completed second reviews
dated August 31 and August 27, 2007 respectfully. The applicant is currently responding to said
reviews. In addition,the Planning Board requested that the applicant provided an amended traffic study
taking into consideration approved and anticipated growth along the Rte. 125 corridor. The applicant is
currently responding to this request.
➢ Planning Staff spoke with Attorney John Clavens who represented the Board of Health during the
TBI hearings regarding the filing of ANR plan and the Planning Boards ability to modify the
approved conceptual design under the Site Assignment decision. Attorney Clavens stated that
combination of lots under an ANR plan would not impact the conditions of the site assignment
decision so long as the area(5.8 acres)to be utilized for the construction of the waste facility
remained the same. Further,the Planning Board has the ability to modify the approved conceptual
design without requiring the applicant to reopen the public hearing process with the Board of Health.
Recommendations:
Planning Staff recommends continuing the application to the October 2, 2007 meeting to allow the
applicant to respond to Staff,VHB, and Planning Board Comments.
