BOARD OF SELECTMEN MINUTES April 25, 2016
CALL TO ORDER:
ChairmanTracy Watson called the meeting to order at 6:00 PM at the School
Administration Building Meeting Room.
ATTENDANCE:
The following were present: Chairman Tracy Watson, Clerk Phil DeCologero, Licensing
Commissioner, Richard Vaillancourt, Rosemary Smedile, Donald Stewart, Town Manager Andrew Maylor,
Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff.
EXECUTIVE SESSION:
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
enter into executive session for reason #2 under M.G.L. Chapter 30A, §21(a)-to conduct contract
negotiations with non-union personnel.
Chair Watson declared that the board will reconvene in open session at the conclusion of executive
session.
Roll call vote-DeCologero: yes, Smedile: yes, Vaillancourt: yes, Watson: yes, Stewart: yes. Vote
approved 5-0.
The Board returned to open session at 7:00 p.m. The meeting was recorded. Approximately 10 members
of the public were present.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to approve the Open
Session Minutes of April 11, 2016 as written. Vote approved 5-0.
COMMUNICATIONS AND ANNOUNCEMENTS:
Planning Board Report for Town Meeting-John Simons (taken out of order)
John Simons, Chair of the Planning Board, presented the commendations for Town Meeting
Warrant Articles 9-13. Mr. Simons explained that the Planning Board has not voted on Articles 16 or 28
but will be discussing them at their next meeting.
Recognition-Retired Fire Chief Andrew Melnikas
Chairman Watson read the Resolution of Appreciation that was presented to Chief Melnikas at his
retirement party on April 23, 2016.
CONSENT ITEMS:
Accept donation in the amount of $6,000 from the Friends of the North Andover Senior Center and

Borderline Running Club for the 4 of July Fireworks display
Martha Cashins, President of the Friends of North Andover Senior Center and Chris Marshall from the
Borderline Running Club presented a check to the Board in the amount of $6,000 to be used for the 2016
4 th of July Fireworks display.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen
accept the donation of $6,000 from the Friends of the North Andover Senior Center and Borderline

Running Club to be used toward the 4 of July Fireworks display. Vote approved 5-0.
Appointments
The appointment subcommittee recommended Krishna Patel be appointed to the Festival Committee.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen
approve the appointment of Krishna Patel to the Festival Committee for a term ending June 30,
2016. Vote approved 5-0.
The appointment subcommittee recommended Gayle C. Heney be appointed to the Poet Laureate
Committee.

Rosemary Smedile made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen
approve the appointment of Gayle C. Heney to the Poet Laureate Committee for a term ending
June 30, 2017. Vote approved 5-0.
Town Meeting Warrant recommendations for Articles 9-13
The Board will vote on the remaining three articles (15, 16 and 28) at their next meeting on May 10 th.
Richard Vaillancourt made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
recommend favorable action on Articles 9-13. Vote approved 5-0.
Ratification of the Police Chief contract
After several weeks of negotiation, the Board reached an agreement with incoming Police Chief Charles
Gray.
Rosemary Smedile made a MOTION, seconded by Donald Stewart, that the Board of Selectmen
approve and sign the contract between the Town of North Andover and Police Chief Charles Gray.
Vote approved 5-0.
LICENSING COMMISSIONERS
Donald Stewart made a MOTION, seconded by Phil DeCologero, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Paul Gallant of Merrimack College requests the following licenses:
One Day Wine and Malt License for a tournament celebration at the athletic complex on Saturday, April
30, 2016 from 10:00am-5:00pm
One Day All Alcohol License for the Augustinian Provincial Reception at the Rogers Center for
Performing Arts (lobby and tent) on Saturday, May 14, 2016 from 5:30pm-8:30pm

Donald Stewart made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen,
acting as Licensing Commissioners, approve the fifteen (15) One Day licenses for Merrimack
College as presented. Vote approved 5-0.
Donald Stewart made a MOTION, seconded by Tracy Watson, to close the meeting of the North
Andover Licensing Commission. Vote approved 5-0.

OLD BUSINESS
Reconsideration of recommendation to hire In House Counsel
Selectmen Smedile requested the Board reconsider the decision to hire In House Counsel. Selectmen
Smedile indicated she was concerned about the cost and believed the Board should continue with their
current Town Counsel.
Rosemary Smedile made a MOTION, seconded by Donald Stewart that the Board of Selectmen
reconsider the decision to hire in house counsel and continue with current Town Counsel. Motion
defeated 3-1-1. Selectmen Smedile voted in favor. Selectmen Stewart abstained.
NEW BUSINESS:
None
PUBLIC COMMENT:
John Smolak of South Bradford Street, spoke in favor of keeping outside Town Counsel stating he
believed counsel needed to maintain independence. Mr. Smolak also asked the Board to consider
streamlining the permitting process for land use projects.

Donald Stewart made a MOTION, seconded by Phil DeCologero, to adjourn the meeting at 8:40
p.m. Vote approved 5-0.
