HomeMy WebLinkAbout1980-11-03November 3, 1980 Regular Meeting The PLANNING BOARD held a regular monthly meeting on Monday, November 3, 1980 at 7:30 p.m. in the Town Office Meeting Room. The following members were present and voting: William Chepulis, Chairman; P~ul A. Hedstrom, Esq., Vice Chairman; Joseph D'Angelo, Clerk; Michael P. Roberts; and John J. Burke. Susan S. Pierre, Town Planner, and William Cyr, Highway Surveyor, were also present. The meeting came to order at 7:40 p.m. PLANS NOT REQUIRING APPROVAL Wood Lane - Margaret Dei .~h.a~. - No applicant present. Motion: by Mr. Roberts to approve the plan of land located in North Andover, M~ss. dated September, 1980 for Margaret Deighan under Subdivision Control Law Not Required. Also,that the application be returned to the petitioner to be corrected before the plans are signed. Second: by Mr. Burke. Vote: Unanimous in favor~ of motion. Fellowship Bible Church - Mr. Scott Giles spoke - this is a chs~ge in lot line. Motion: by Mr. Roberts to approve the plan of land located in North Andover, N~ss. for Fellowship Bible Church, dated October 29, 1980 under Subdivision Control L~w Not Required. Second: by Mr. Burke. Vote: Unanimous in favor of the motion. Winter,ale Streets - division of one lot into two. Motion: by Mr. Roberts to approve the plan of land located in North Andover, Mass. for H. Clayton, dated October 31, 1980 under Subdivision Control Law Not Required. Seco.nd: by Mr. Hedstrom Vote: Unanimous in favor of the motion. Carleton l~arms/Raleigh Tavern Lane - withdrew without predjudice. Willows Industrial Park - No applicant present and the Design agreement has not been received. Motion: by Mr. Roberts that the Planning Board notify the developer that the Board is surprised at the delay in meeting the conditions outlined at the last meeting regarding the waiver. If in two weeks time the Board does not receive the document, they will notify the utility companies that the order of conditions has not been fulfilled. Also, if they (the developers) go ahead with the installation of utility poles, they are doing so at their own peril. Second: by Mr. Hedstrom. Vote: Unanimous in favor of the motion. November 3, 1980 -2- Regular meeting Trafalgar Estates - Letter of Credit Paul Hedstrom said the letter is O.K., but it should not contain an expiration date. Motion: by Mr. Hedstrom to accept the Letter of Credit, No. 244, and also to notify Mr. Flatley that it has been accpeted along with the condition that the phase by completed by July 23, 1981 with NO EXT~SIC~S. Second: by Mr. Roberts. Vote: Unanimous in favor of the motion. Note: Paul requested that the letter also include a paragraph requesting Mr. Flatley's presence at the next Planning Board meeting to discuss the sidewalk situation in this subdivision. Hardtcourt,Estates A letter dated October 6, 1980 from Frank Gelin~s was read. Mr. William Cyr said that there could be a problem with overflow to the abutters. Motion: by Mr. Roberts that the plan of proposed drainage located in North Andover, Mass prepared for John Warlick, dated September 15, 1980, be approved, subject to the showing af a 20 foot easement on the plan on the new existing d~aim lines, to invert elevation 168.89 ~nd running to manhold invert 148.26; and also a 20 foot drainage easement running from proposed designated manhold invert 157.31 to proposed designated manhole invert 148.26. The plans will not be signed or approved until such easements are shown on the plan. Second: by Mr. Burke. Vote: Unanimous in favor of the motion. Woodchuck Lane/Raleigh Tavern Lane - Bond amount Attorney Virginia Keith submittted a Subdivision Control Agreement and a proposed release of 13 lots. She incorporated the two previ~asly approved subdivisions into one Subdivision Control Agreement. The clerk read a letter from the Highway Surveyor. Motion: by Mr. Roberts that the Planning Bo~d accept the bond amount of $101,OO0, $99,000 being allocated and outlined in the Highway Surveyor's letter of October 30, 1980, and pending verification from the Board of Public Works for a bond amount of $2,000; and to release the lots as soon as proper verification by the Town Planner is made in cross-referencing the plans. Second: by Mr. Hedstrom. Vote: unanimons in favor of the motion. November 3, 1980 -3- Regular meeting ~uller Farms - Thetford Realty - J. Philbin - Release of covenants - l0 lots Ja~v Burke disqualified himself from this vote because he has an interest in this subdivision. Motion: by Mr. Roberts to release 10 lots per the Highway Surveyor's letter of October 30, 1980 and the Board of Public Works letter of September 22, 1980, and that 3 more lots be held in reference to the bond amounts in the above mentioned letters - $2,000 for the BPW and $22,000 for the Highway Department. The lots to be held are 14, 15, and 23, per the recorded plans at the Registry o£ Deeds, and the completion date is November 1, 1981. Second: by Mr. Hedstrom. Vote: unanimous in favor of the motion. Salem Forest - Bond Release The clerk read letters from Mr. George Farr and the Highway Surveyor. Motion: by Mr. Roberts to release the $5,000 per the Highway Surveyor's letter of November 3, 1980, and also that at the next annual town meeting S~lem Forest (Granville Lane) be submitted for judiCation. Second: Mr. Hedstrom. Vote: Unanimous in favor of the motion. Cricket Lane -.Expiration date November 11 1980 - rec~est for an extension Motion: by Mr. Roberts tha~ the Planning Board grant an extension to November 17, 1980 and will grant no further extensions. Second: by Mr. Burke. Vote: unanimous in favor of the motion. Mr. and Mrs. Spraoklin - re~uest to have Hs~meadow Rd. pave~. The clerk read a letter frcm Town Counsel. Buddy Cy~ said that the town should be working with the bank to make sure sufficient funds are there to do the work. He want~ to contact Mr. Jenkins at the Andover Savings Bank to see what can be done. Bruce Neri, 167 Haymeadow Rd. spoke about the safety factor on this read. Paul Hedstrom said if the bank does not give satisfactory answers, he is in favor of calling the subdivision back under a change of circumstance. However, it would entail the process of advertising for a public hearing, which is time consuming. Susan St. Pierre, Town Pl~ner, warned the Board about a law suit should they call the subdivision back in. Motion: by Mr. Roberts that if at the end of two days the Board does not get a positive response from the bank to improve the road, the Planning Board will advertise in the Lawrence Eagle Tribune for a public hearing to move up the completion date. Second: by Mr. Hedstrom. Vote: unanimous in favor of the motion. November ~, 1980 -4- Regular meeting .Correspondence - Mrs. Mary Armitage The clerk read two letters from Mrs. Mary Armitage, dated October 21, 1980 and October 3, 1976, re: Appledore (Glen Road). Motion: by Mr. Hedstrom to accept and put on file. Second: Mr. Roberts. Vote: unanimous in favor. Presco%t St. - Bond release The clerk read letters from John Tut~le, dated October 22, 1980, and the Highway Surveyor, dated October 30, 1980. Motion: by Mr. Roberts that per the Highway Surveyor's letter cf October 30, 1980 $6,000 be released, leaving a balance of $5,800. Second: by Mr. Burke. Vote: unanimous in favor of the motion. Lakeside - Bond release Mr. Cyr recommended nc release. The clerk read a letter from the BOard of Public Works. Motion: by Mr. Roberts to release $30,150 per the Board of Public Works letter, dated November 3, 1980, leaving a balance cf $28,350. Second: by Mr. Burke. Vote: Unanimous in favor of the motion. Planners Informer ion The Town Planner talked about the CARD plan, Cluster Zoning, the Master Plan, and a subdivision update. Board of Appeals - decisions - read and on file.
