Hedstrom~ Chairman; Michael P. Roberts, Vice-Chairman; Vincent S. Turano, Clerk; John J. Burke; and Erich W. Nitzsche. Highway Surveyor William Cyr, Town Planner Susan St. Pierre; and Conservation Commission Chairman James Lafond were also present. PLANS NOT REQUIRING APPROVAL A. Flately Ber~e!.ey Road. MOTION: by Mr. Turano to approve the plan of land located in North Andover, Mass, prepared for A. Flately and dated May 20, 1981 under Subdivision Control Law Not Required. SECOND: by Mr. Burke VOTE: Unanimous - motion carries MDF Realty (George Schruender) - Hillside Road MOTION: by Mr. Burke to approve the plan of land located in North Andover, Mass. prepared for MDF Realty, dated May, 1981 under Subdivision Control Law Not Required. SECOND: by Mr. Furano VOTE: Unanimous - motion,carries. George Farr - Raileigh Tavern Lane MOTION: by Mr. Burke to approve the plan of land located in North Andover, Mass. prepared for George Farr and dated J!une 15, 1981 under Subdivision Control Law Not Req!uired, SECOND: VOTE: by Mr. iTurano Unanimolus - motion carries. GILMAN LANE Member Turano abstained. A letter from th!e Conservation Commission dated June 15, 1981 which was submitted tOnight, was read. There is a difference between the Highway Surveyor and the Conservation Commission regarding the drainage. June 15, 1981 -2- Regular Meeting Gilman Lane continued Chairman Hedstrom stated that legally, with the Notice of Intent filed, the Conservation Commission is approving a plan under Wet- lands Protection. With that order in place, the Planning Board cannot do anything about it. Mr. Cyr stated that the drainage is NOT a brook, it is a drainage ditch that was built for the purpose of drain~n9 the property. As far as he is concerned, it is a corner lot and we are doing nothing but creatin~ a mosquito breeding area which is agains~ the preservation of wetlands. He feels that he has the authority to control the design of drainage and he wants a legal opinion. Both Mr. Cyr and Member Nitzsche feel that the drainage has been modified. Susan St. Pierre disagreed saying that the Conservation Commission acted on a modification to an approved subdivision before the Planning Board acted on it. MOTION: by Mr. Roberts that the Planning Board notify the applicant that we have been notified by the Fire Chief that the stationing of the hydrants as outlined by the plan has been approved and the 6" water lines have been approved by the Board of Public Works. SECOND: by Hr. Burke VOTE: In favor - 2 - (Burke, Roberts) Opposed - 1 - (Nitzsche) Motion carries. MOTION: by Hr. Nitzsche to re-open the Gilman Lane Subdivision for the reason that all the information was not shown to the Planning Board at the public hearing and on the subdivision plan, both to the Conservation Commission and the Planning Board. No second motion fails. CLUSTER ZONING The Board reviewed the list of applicants. MOTION: by Mr. Burke to appoint John Blottman, III; Joyce Bliss; and Patrick Cone. SECOND: by Mr. Roberts VOTE: ~ In favor - 3 - (Roberts, Burke, Nitzsche) Opposed - 1 - (Turano) Motion carries.
