Simons Chairman: The Planning Board meeting for Tuesday, September 6, 2016 was called to order at 7 p.m. 6 7 BOND RELEASE: Merrimack College, Jeffrey W. Koetteritz: Request for release of$5,000 Performance Bond 8 associated with a Site Plan Review Special Permit, 9 Imo. Rudnicki: Noted that both certification letters referenced Phase I but that the project was not reviewed in phases 10 because the other portion of the project was in the Town of Andover. 1 'I J. Simons: Questioned whether any additional work proposed would be in North Andover. 12 F.elipe_Schwarz,Asst. V.P External Affairs,Merrimack College: Confirmed a small amount of work near the 13 Sakowich Center will be located in North Andover. 14 J, Simons: Requested an updated set of construction plans be sent to the Planning Board for review. 15 MOTION: L. Rudnicki made a motion to release the $5K bond with accrued interest for Merrimack College 16 pursuant upon an updated letter(removing the `Phase V reference)certifying the completion of the work in North 17 Andover and requested a set of updated plans be provided to the Board. D. Kellogg seconded the motion, The 18 vote was 5-0, unanimous in favor. 19 20 PUBLIC HEARINGS 21 CONTINUED PUBLIC HEARING: Verizon,Robert Baker/Christopher Swiniarski, Cloud Radio Access 22 Network Antennae on 10 Utility Poles Town Wide: Application for Wireless Facilities Special Permit. 23 Proposal for attachment of disguised Cloud Radio Access Network(CRAM) antennae, a single 24.2"tall 24 cylindrical canister weighing approximately 22 pounds, mounted to existing utility poles. 25 R. Oldham: The Applicant has withdrawn the proposed installation of the 65 degree directional pole located at 635 26 Chickering Road. Although the canister has been designed it has not yet been manufactured, The Applicant will 27 revisit this pole at a later date. This reduces the number of proposed canisters to nine. 28 MOTION: D. Kellogg made a motion to close the public hearing for Verizon-CRAM. L. Rudnicki seconded the 29 motion, The vote was 5-0, unanimous in favor. 30 MOTION: L. Rudnicki made a motion to approve the Wireless Facilities Special Permit, as amended. D, Kellogg 31 seconded the motion. The vote was 5-0, unanimous in favor. 32 33 CONTINUED PUBLIC HEARING: 1210 Osgood Street,Forgetta Development LLC,Robert Bohlen: 34 (Commercial)The Applicant proposes construction of approximately 40,000 square feet of commercial space 35 contained within five(5)separate buildings, parking spaces, stormwater management facilities, landscaping, 36 signage and other improvements to be located on a 4.3-acre portion of currently vacant 13.8 acre parcel. Traffic Engineer: Summarized TEC's review comments and the 47 applicant responses regarding the site plan and traffic study. Discussed the synchronization of signals along the 48 125 corridor for traffic progression. Explained that the State accepts no responsibility for the maintenance of 49 sidewalks along Route 125.Maintenance and the plowing of the sidewalks will revert to the municipality. 50 Tom Dawley,Abutter-95 Hickory Hill. Road: Inquired about traffic light specifics related to right turns on red. 51 J. Peznola.Civil Eneer: Provided an overview of the site visit and answered questions related to the white/red 52 striped pole located to the rear property, survey marker located at the north corner of the property and reviewed a 53 street view rendering of the property. 54 J. Simons: Requested a buffer or screening along the northern property line between the edge of the property and 55 the residential properties. 56 J.Peznola:Noted that a retaining wall will absorb the elevation change in the roadway at that location and 57 Huntress &Associates could add intermittent screening to that location. 58 J. Simons: Questioned how the downward slope in the front of the project would be handled? 59 J. Peznola: Huntress &Associates, Plan L-1 shows added features including a hedgerow and post and rail fence 60 with intermittent trees. 61 J. Peznola: Fire Department comments were just received. There was a preliminary meeting and one additional 62 meeting will be scheduled to resolve these final comments. 63 J. Peznola: We are addressing TEC's and Lisa Eggleston's comments. 64 J. Enright: The peer review consultants have provided their initial review comments and the Applicant responded 65 to those comments in memo format; however,the site plans have not yet been updated and submitted for review of 66 those responses. The revised site plans should be submitted by tine end of this week. 67 J. Brown, Princeton Properties: Described the exterior finishes on the residential buildings as having traditional 68 details, neutral clapboard siding,white trim with accented sections to compliment the commercial buildings. 69 L. Rudnicki: Asked how roof runoff would be handled? 70 J. Peznola: Responded that runoff would be handled by standard gutters and downspouts. 71 J. Brown: Mentioned the roof materials are a mix ofrnetal and shingles. All residential buildings will be 72 constructed to look the same. The Westford project was the closest in design to this project. 73 J. Simons: I still have architectural reservations and would like to look at the Westford project. 74 Tom Dawley, Abutter-95 Hickory Hill.Road: Questioned the grading on the site and mentioned the discrepancies 75 as to the original description of how the topography would benefit the site. 76 P. Boynton: Questioned the"Angle View"rendering and inquired as to where the observer is located and if the 77 view is from eye level height. Requested that the applicant provide a rationale for the request of a height waiver. 78 James Mealey, Asst. Supt. Finance &C)perations,NA Public..Schools: Reviewed the discrepancy between the 79 Applicant projects for school children impact vs his projection. Stated his initial projections did not take into 80 account the income level of the proposed residents and the number of bedrooms is critical. Since there will not be 81 an affordable component for this project and the fact that the project includes only one and two bedroom units the 82 Applicants projections are acceptable. 83 Matthew Tortora,Abutter-39 Longwood Avenue: Expressed his opinions about growing up in a community 84 which he believes is becoming unnecessarily overcrowded. He expressed opposition for another large residential 85 project which he felt strongly would tax the schools, community safety, traffic, and fire and police services. 86 J.. Enright: Provided an update on the project noting that it has been publicly noticed and that the public hearing 94 will open on September 20th. The site plans have been sent to peer review and the hope is that all concerns can be 95 addressed prior to September 20 and a draft Decision can be prepared for that bearing date. 96 Don Lane NE- We are here asking for approval to begin moving parts of the NETTTS operation over to the 97 north area before the Public Hearing on the 20th. 98 J. Simons: The Planning Board is seeing this through the Site Plan Review process. Once we approve the permit 99 you will need to file a building permit which will need the Building Commissioner's approval.
