Lynch, Jr., Deborah A. Feltovic, Sean F. McDonough arrived at 7:10PM. Members Absent: Scott L. Masse, Albert P. Manzi, Jr. Staff Members Present: Jennifer A. Hughes, Conservation Administrator, Heidi M. Gaffney, Conservation Field Inspector, Donna M. Wedge, Conservation Secretary. Pledge of Allegiance Meeting came to Order at: 7:06PM Quorum Present. General Business A motion to approve the meeting minutes of 7/28/10 made by Mr. Mabon, seconded by Ms. Feltovic. Vote: unanimous. 242-1410, COC Request, 129 Berry Street (Lot 1N-A) (One Hundred Fourteen Trust) (cont. from 10/13/10) The administrator states that the driveway is scheduled to be paved next week, and the applicant has requested a continuance to November 10, 2010. A motion to grant the request for a continuance to November 10, 2010 meeting made by Mr. Mabon, seconded by Ms. Feltovic. Vote unanimous. NACC#68, COC Request, 99 Bear Hill Road (Conaton) (Sullivan Engineering Group, LLC) (cont. from 10/13/10) The applicant John Conaton is present. The field inspector states that a small area that had not been sodded with rest of lot has now been stabilized with wood chips. A motion to issue the COC and bond release is made by Mr. Mabon, seconded by Ms. Feltovic. Vote 4 to 1 (Mr. McDonough abstained from voting) 242-1443, COC Request, 219 Berry Street (Lot 5) (Brooks) (Norse Environmental Services, Inc.) The applicant Nathan Brooks is present. The administrator presents that the house has been constructed in accordance with the record plan. A bulkhead was added and incurs slightly into the 50-foot No-Build zone. The stonewall does not quite meet the property line on either end and incurs a few feet into the 25-foot No-Disturbance zone at the well location. The installation of the well was right at the 25-foot No-Disturbance zone. Mr. Lynch states that the stone wall does not provide a physical barrier as is the intention No-Build Zone. The Conservation Commission discusses the need for the applicant to file for a modification for the bulkhead in the 50-foot No-Build zone, and to rebuild the stonewall along the - Disturb Zone. Mr. Lynch discusses the stonewall needs to be moved outside of the 25-foot No-Disturbance zone in the area of the well and that it needs to be complete from property line to property line. The commission discusses the options for bringing the wall into compliance with the applicant. The applicant requests a continuance to the November 10, 2010 meeting. A motion to grant the request for a continuance to the November 10, 2010 meeting is made by Mr. Lynch, seconded by Ms. Feltovic. Vote unanimous. The applicant Robert Ercolini is present. Mr. Ercolini discusses the proposed changes to the plan and states that the impervious area will be reduced from the originally approved plan. He states that he would like to put the -build zone, and -build zone. Mr. Ercolini spoke about the wetland and that it was created and was not existing when the houses in the area were built. entation. The administrator presents that the new proposal discusses the gas line installation and that it was made clear to the applicant that the installation of the gas line shall not create a hardship where the stairs - build zone. Mr. Lynch states that re-plumbing the gas line is the best option and that the work needs to comply with the setbacks. Mr. Ercolini requests a continuance to November 10, 2011. A motion grant the continuance to November 10, 2011 is made by Ms. Feltovic, seconded by Mr. Mabon. Vote unanimous. The applicant Nancy Leland and Curtis Young of Wetlands Preservation, Inc. are present. The administrator states that all of the construction is proposed outside t jurisdiction. Mr. Young discusses that the applicant may want to fix the cemented stairs where the barn is located which is within jurisdiction. A motion to issue a negative determination #3 with a pre-construction meeting and a post- construction meeting is made by Mr. Mabon, seconded by Ms. Feltovic. Vote unanimous. Abbreviated Notice of Resource Area Delineation 242-1500, Lot A-1 Forest Street (Greenscape Property and Building, LLC) (Norse Environmental Services, Inc.) Ms. Feltovic reads the legal notice. The applicant George Haseltine and Steven Eriksen of Norse Environmental Services, Inc. are present. The administrator states that she has reviewed the delineation with Steve Eriksen and made one flag change and also requested that the 50-foot No-Disturbance zone and 75-foot No- Build zone be shown on the plan. A motion to accept the wetland line and issue an ORAD is made by Mr. Lynch, seconded by Ms. Feltovic. Vote unanimous Documents: Abbreviated Notice of Resource Area Delineation and associated documents o Plan o 242-1501, O Methuen Ave. (Pollina) (Basbanes Wetland Consulting) Ms. Feltovic reads the legal notice. The applicant Ronald Pollina and Leah Basbanes of Associates Wetlands Consulting are present. Abutter V. Funaro of 410 Sutton Street is present. Ms. Basbanes presents the findings of the wetland delineation and discusses the delineation process for this site stating that she conducted 15-20 soil probes to determine the wetland line. Mr. Lynch states that the ORAD should reflect the buffer zone. The administrator states that there has been a lot of abutter concern for this property. Mr. Funaro states that he has lived in this area since 1982 and that he has always had basement issues and he has concerns about water problems if this site is developed. A motion to accept the wetland line and issue the ORAD is made by Mr. Lynch, seconded by Mr. Mabon. Vote unanimous. (cont. from 10/13/10) The applicant Dale Jenkins, and John Morin of the Neve-Morin Group, Inc. are present. The administrator states that revised plans have been submitted and some mitigation has been added. A timber retaining wall will be removed and small portion of the 25-No-Disturbance zone will be restored. The access drive will be gravel but portions are still within the 25-foot No-Disturbance zone. - that the pool and garage have been moved further from the wetland and that the access drive for the garage will be gravel, there will be an overhead deck on the pool house. Mr. McDonough asks what the closest point of work is to the wetland. Mr. Morin states 6-7 feet. Mr. Napoli discusses his concer- Disturb, he would like to see the access in the front of the yard be considered. The commission discusses the construction access. The administrator states that there would need to be waiver request submitted and a mitigation plan to allow areas to grow back naturally. Mr. Mabon states that the project is moving in a good direction and that he would like to see Mr. Lynch discusses there is tremendous large boulders in this area and the infiltrator trench, he asks if test pits have been done. The Conservation Commission would like to set up a site visit on Monday November 1, 2010 at 5:30 PM. A motion to grant the request for a continuance to the November 10, 2010 meeting is made by Mr. McDonough, seconded by Ms. Feltovic. Vote unanimous. A motion to close the hearing and issue a decision within 21 days is made by Mr. Lynch, seconded by Ms. Feltovic. Vote unanimous. E. of Pennoni Associates, Inc. are present. Ms. Feltovic reads the legal notice. The administrator states that this project would take 2 days for the work to be done and proposes to knock the wall down and then bury it in place. Silt fence alone should be adequate for erosion control, and the applicant wishes to have the monitoring requirement waived. Mr. Lynch discusses the grading and the need to support the parking area. The administrator states that there is not yet a DEP file number and will need to continue. Vote unanimous. 242-1499, Ciderpress Way (Meetinghouse Commons, LLC) The administrator reviews the draft Order of Conditions. The commission amends the OOC to add a new condition regarding stormwater. A motion to accept the Order of Conditions as amended is made by Mr. Mabon, seconded by Ms. Feltovic.
