Lynch, Jr. Deborah A. Feltovic. Member Absent: AlbertP. Manzi, Jr., Scott L. Masse, Sean F. McDonough. Staff Members Present: Jennifer A. Hughes, Conservation Administrator, Donna M. Wedge, Conservation Secretary. Pledge of Allegiance Meeting came to Order at: 7:05 PM Quorum Present. Notice of Intent (s) 242-1428, Lot 4N Turnpike Street (Merrimac Condominiums)(One Hundred Fourteen Trust) (Patrick C. Garner Company, Inc.)(cont. from 7/14/10) Lisa Eggleston, P.E. peer reviewer for the Conservation Commission was present. Peter Hingorani (Applicant), Tim Barlow (Builder) and Patrick Garner (Consultant) were present. Mr. Garner recaps the technical review held last Friday 7/16/10. Mr. Garner reviews revisions to construction phasing, the Operation & Maintenance (O&M) Plan, and the comprehensive hydrological study. Mr. Garner will provide “wet stamped” plans. Lisa Eggleston summarizes her review. Some items will need to be formalized in the Order of Conditions (OOC). Mr. Lynch and Ms. Eggleston discuss performance bond. Both agree much of the roadway bonding should be for the roadway sub-base. Patrick Garner initiates discussion on performance bond “phasing”. Ms. Eggleston discusses site clearing and relation to performance bond. Includes discussion of vernal pools and “heat island effects” and the overland flow of water. Ms. Eggleston states there must be front end protections in the OOC. Mr. Napoli points out there must be consistency in bonding required by the commission. Mr. Napoli discusses bonding the entire project Mr. Mabon discusses ½ cash, ½ surety. Mr. Hingorani states that surety will not work. Mr. Lynch notes that the amounts the commission is discussing are not huge numbers relative to the size of the project. Specific amounts are discussed for the units, replication and roadway. Bond amounts are set as Phase 1 & 2: $15,000 for 5 building units, $50,000 for roadway and $4,000 for replication, $7,500 infiltration units and $6,500 for buffer zone restoration (Total $83,000). Phases 3 & 4 $30,000 for 10 building units. Ms. Eggleston asks that the O&M plan be updated on page 5 to require records to be kept for 3 years. OOC needs a vernal pool monitoring condition to include what parameters shall be monitored and for how long. Discussion of Conservation Restriction on Lot 4N-A OOC discussed and modified. Motion by Mr. Lynch to close the public hearing and issue an OOC. Ms. Feltovic seconds. Vote is unanimous. Motion by Mr. Mabon to approve the OOC as drafted and amended. Second by Ms. Feltovic. Vote is unanimous. 242-1481, 22-24 Ashland Street Motion by Ms. Feltovic to approve OOC as drafted. Second by Mr. Lynch. Vote is unanimous. A motion to adjourn the meeting at: 9:00 PM made by Ms. Feltovic, seconded by Mr. Mabon. Vote unanimous.
