Manzi, Jr.;Sean F. McDonough. Members Absent: Joseph W. Lynch, Jr., Deborah A. Feltovic, Douglas W. Saal. Staff Members Present: Jennifer A. Hughes, Conservation Administrator;Heidi M. Gaffney, Conservation Field Inspector;Donna M. Wedge, Conservation Secretary. Pledge of Allegiance Meeting came to Order at: 7:45 PM QuorumPresent. Public Hearings at: 7:45PM Approval of Minutes of 4/11/12 & 4/25/12 A motion to accept the meeting minutes of 4/11/12 & 4/25/12 as drafted and reviewed made by Mr. Mabon, seconded by Mr. McDonough. Vote unanimous. Eagle Scout Project Edgewood Farm Trail Boardwalk (TTOR) (John Busanovich) The applicant John Busanovich,Geddie John Busanovich and Karen A. Busanovich are present. The field inspector states thatEagle Scout candidate John Busanovich has been working with Chris Ward of The Trustees of Reservation to prepare a plan to replace the existing boardwalk on the Edgewood Farm Trail at Weir Hill. He is proposing pressure treated sleepers anduntreated rough cut hemlock for the treads. The new boardwalk will be approximately the same length and width as the existing boardwalk. Mr. Busanovich discusses his project and statesthatthe work would probably take 5 weeks with volunteer help. Mr. Mabon states that Mr. Busanovich needs to notify the Conservation Department 1 week prior to the work beginning. Small Project NACC#96, 25 Margate Road (Bailey) (Drainage & Landscaping) (cont. from 6/6/12) The administrator states thatneither the police department nor the court hasany information on this case. The commission discusses the lack of paperwork. A motion to grant a continuance to the July 11, 2012 meeting is made by Mr. McDonough, seconded by Mr. Manzi. Vote unanimous. Mr. Tusa requests to remove a large limb of atree that is leaningtowards his house. The Commission discusses the pruning of the tree and states that the removal of the limb is acceptable and that the administrator will issue an approval letter. Mr. Tusa requests to continue the hearing regarding his deck. A motion to grant the request for continuance to the July 11, 2012 meetingismade by Mr. Manzi, seconded by Mr. McDonough. Mr. McDonough reads the legal ad. Ms. Norton presents the project and requests a negative determination with conditions and states that the area needs to be re-paved. She states that the debris will go into a truck as it is milled and that they will be putting new grates on the stormwater structures. Mr. Manzidiscusses the project and the claimed limited project exemption as well as the claim that it is exempt from the bylaw. Ms. Norton discusses the exemption issues. Mr. Manzi reads the e-mail/letter that Ms. Norton handed him. The commission and Ms. Norton discuss the proper filing procedures and fees. The administrator discusses the guidance from MA DEP about the exemptionregulations for large projects. Mr. Mabon discusses the conditions of the approval. Mr. Napoli asks if the bridge section will be milled. Ms. Norton states that yes it will. A motion to grant a negativedetermination #3 with conditions including a pre- construction and post-construction meeting and necessary erosion controlsismade by Mr. Mabon seconded by Mr. McDonough. Vote unanimous. The administrator briefly reviews the project and the changes to the plan. Mr. Sullivan presents the revisions that have been made to the plan including the 25’ No- Disturb barrier. Mr. Manzi asks what year the house was built. Mr. Cristaldi states 1965. Mr. Sullivan and Mr. Mabon discuss the planting of blueberry bushes. The administrator discusses the previous violation from three years ago that involved the grading, loaming and re-seeding of the lawn. The administrator and the commission reviewhistoric GIS aerial photos. Mr. Napolidiscusses the 25’ No-Disturb Zone. Mr. Arria discusses the stone wall. The administrator reviewsthe violation from 3 years ago as well as the recent violation and subsequent filing. Plants are discussed including sweet pepperbush and northern arrowwood for planting the 25’ No-Disturb Zone. The applicant requests a continuance. A motion to grant the request for a continuancetotheJuly 11, 2012 meetingis made by Mr. Manzi, seconded by Mr. Mabon. Vote unanimous. The applicant Peter Breen of Breenmore Realty Trustand John Morin of the Neve-Morin Group, Inc are present. Abutter Michelle Saracusaof 210 Andover Streetis present. Mr. McDonough readslegal notice. Mr. Morin presents the amendment request and states that the proposedchanges result in a 50 s.f. reduction in impervious area. The administrator discusses the amendment request and how it relates to the bylaw and states that the state will need to approve the amendment under the SOOC. She discusses the changes to the project. Mr. Napoli statesthatthere should be crushed stone and agrassed swale along the side of the driveway for better drainage in this area. Mr. Breen discusses the project and the changes. The commission discusses a grass swale and the calculation of impervious area. The applicant requests a continuance. Mr. Thomson discusses the need to revise the plans due to the location of the existing force main being incorrectly shown in one area on the original plans. The Conservation Commission discussesthe modification and states that it would be less disturbance to the utilities in this area, and less disturbance within the Buffer Zone. Mr. Mabon asksabout the two 48” culverts. Mr. Thomson states that they will remain similar to the original proposal. Mr. Weare states that the steel header pipe may change the construction schedule slightly. A motion to approve the modificationas proposed ismade by Mr. Manzi, seconded by Mr. Mabon. Vote unanimous. The field inspector states that theseptic system and tank have been constructed in accordance with the Order of Conditions, the wall was built as a vertical retaining wall but the proposed was to beasloped wall. The wall is approximately 5-feet high. A motion to issue the COC and release the bondismade by Mr. Manzi, seconded Mr. McDonough. Vote unanimous. The applicant was asked to provide a plan with the wetland line and setbacks shown.The applicant requests a continuance to allow time to revise the plan. Mr. Manzi discusses the hunting. A motion to accept the Conservation Restriction as drafted,amendedand discussed and to be approved by town counsel ismade by Mr. Mabon, seconded by Mr. Manzi. Vote unanimous. Election of Officers A motion to elect Louis A. Napoli as Chairmanismade by Mr. Manzi, seconded by Mr. Mabon. Vote unanimous. A motion to elect Joseph W. Lynch, Jr. as Vice Chairmanismade by Mr. McDonough, seconded by Mr. Manzi. Vote unanimous. A motion to grant to adjourn meeting at: 9:15PM made by Mr. Manzi, seconded by Mr. Mabon. Vote unanimous.
