Pledge of Allegiance Public Hearings: Request for Determination of Applicability 37 Millpond (Stevens Pond) (DPW) Eugene Willis Town Engineer of Division of Public Works states the project is to add safety grates to outlet structure at Millpond. Mr. Willis states two shrubs will be removed. Mr. Lynch discusses the location of the outlet and the safety issue. Ms. Feltovic asks about the O&M plan and asks about inspections. Mr. Saal requests that the shrubs be planted away from the outlet to make maintenance easier. A motion to issue a negative determination with a condition for post construction inspectionmade by Mr. Lynch, seconded by Ms. Feltovic. Zahoruiko of TLD, LLC, is present. The Administrator presents a new planMr. Zahoruiko prepared to address stormwater issues (Lisa Eggleston reviewed an adjacent parcel and made recommendations). Mr. Zahoruiko describes the project and the subdivision of the larger property. This is an ANR lot. Mr. Zahoruiko states other access routes to the house were researched. The water and sewer lines will connect out to the street to minimize impacts. A stonewall will be installed at the 25’ No-Disturb and another line of erosion control added. He is trying to keep mature trees to blockviews for abutter, Mr. Coleman at 56 Great Pond Rd. Mr. Lynch states there are alternatives to this project. The lots could be designed differently.Mr. Lynch wants to see analternativesanalysis showing the whole project with the 3 Lots. Mr. Zahoruiko states he discussed other alternatives including dual driveways with the Planning Board and is trying to balance the requirements of the different boards. He would like the commission to see the lot in person to appreciate many of the unique features. Mr. Manzi states the applicant is not requesting any waivers. Mr. Mabon discusses the plan for the wall and the 25’ No-Disturb Zone. Ms. Feltovic asks about the mowing of the field. The Conservation Commissiondiscusses options to access the house and keep the driveway off the slope and out of the buffer zone. Mr. Saal states the applicant couldraze the exiting house create ashorter roadway for cluster subdivision. Mr. Zahoruiko there is not enough frontage for that option. The Commission would like to see alternatives plans. The Conservation Commission scheduled a site visit on December 1, 2012 at 10:00 AM on site to be confirmed by the administrator. Mr. Coleman, the abutter at 56 Great Pond Road, states his support for maintaining the large trees on the property. The applicant Jeffrey Mangiameli of 998 Salem Street is present. Administrator statesthe Field Inspector reviewed theplans and inspected the site and itis in compliance with the Order of Conditions. There was clearing of brushin the 25’ No-Disturbance zone whenthe fence was installed but the Field Inspector said it should grow back. The deck has aslightly differentshape and did not have stairs installed. A small set of stairs was added to the rear of the house. Administrator states she has read the entire understands there were many problems with this project during development. There is a discussion of the drainage and a need for third party review.The catch basins have had hoods added and have been cleaned. Administrator states the detention basin has not been maintained and is overgrown. Mr. Lynch reviews the record plans to determine how many catch basins were required. It appears all catch basins are in and properly located. The Administrator states that easements on the property have not been recorded. There is discussion and the commission believes the Planning Board will handle this. The Commission requires the applicant to clean the detention basin before a COC is issued. There are violations on two house lots that will be handled separately. There is discussion of what amount of bond can be released at this time. A motion to issue a partial bond releasein the amount of $5,000 made by Mr. Manzi, seconded by Mr.Lynch. A motion to grant the request for a continuance for detention basin cleaning of trees to the December 12, 2012 meeting made by Mr. Manzi, seconded by Mr. McDonough. Vote unanimous. Administrator states that Eggleston Environmental has provided a review letter and that theStormwater Management Planhasnot beensubmittedyet. Mr. Lania reviews the work that has been done to date. Mr. Manzi states the PCOC request are premature the site is not stable and we would not issue PCOC for this project it would be for a whole COC when all work completed and site stabilized. Mr. Napoli statesthat the stormwater management plan is the most important piece of the work. Mr. Lynch states that Mr. Lania is doing great work analytically and that the O&M plan is good. Mr. Manzi discusses the Eggleston Environmental letter. Mr. Lania states he has meet the Eugene Willis Town of North Andover Engineer and making some progress on what needs to be done with the this area of the Town. Mr. Lynch states that release of additional bond money will be discussed again at the next meeting. Mr. Lania stats he hopes to have a complete submittal by the end of the year.
