Mabon, Deborah A. Feltovic. Members Absent: Albert P. Manzi, Jr., Joseph W. Lynch, Jr., Sean F. McDonough. Staff Members Present: Jennifer A. Hughes, Conservation Administrator, Donna M. Wedge, Conservation Secretary. Pledge of Allegiance Meeting came to Order at: 7:01 PM Quorum Present. Approval of Minutes 8/27/14 A motion to accept the meeting minutes of 8/27/14 as drafted and reviewed is made by Ms. Feltovic, seconded by Mr. Mabon. Vote unanimous. Public Hearings: 7:04 PM 242-1631, Great Pond Road (Lots 53 & 54) (TKZ, LLC) (Christian & Sergi, Inc.) (Request to cont. to 11/5/14) Administrator states the applicant is requesting a continuance to the November 5, 2014 meeting. A motion to grant the request for a continuance to the November 5, 2014 meeting is made by Ms. Feltovic, seconded by Mr. Saal. Vote unanimous. Documents: E/Mail from the applicant Thomas D. Mr. Mabon read the legal notice The Administrator reviews the violation history and subsequent filing before the commission. Mr. Tilton presents a marked up color copy of the plan. He presents the proposed work including native plantings, landscaping and relocation of the bridge. He states that erosion control is in place. The Administrator states the Commission will likely want to see more plantings and a permanent No-Disturbance Zone. Mr. Mabon states the planting needs to continue along the stream to preserve water quality and enhance wildlife diversity. Mr. Mabon r areas. as far as the walk. Mr. Tilton states the owners are ok with a variable width planting area along the resource areas. Mr. Napoli states that when waivers are sought, there needs to be mitigation. Mrs. Wentzel states there was not enough nursery stock to do planting this year. The Commission discusses a small buffer on the opposite side of the stream. Mr. Wentzel discusses moving the bridge because there is a clogging issue. Mr. Saal states the new fountain should not be in its current location. The commission discusses No-Disturb monumentation. Mr. Napoli asks the rest of the commission about the fountain. It is the only item that has been reconstructed closer to the wetland. He advises the applicants to make the most improvements possible. Mr. Mabon asks about the fountain. Water is recirculated, no chemicals are added and there are no fish. The Wentzel,s state the last fountain was leaking and this fountain is mainly for wildlife. The applicants request a continuance. A motion to grant the request for a continuance to November 5, 2014 meeting is made by Ms. Feltovic, seconded by Mr. Mabon. Vote unanimous. The applicant David Steinberg of RCG West Mill NA LLC and Seth Zeren of RCG West Mill NA LLC and Jonathan Ford of Horsley Witten Group, Inc. are present. Mr. Mabon read the legal notice. Mr. Zeren reviews previous drainage improvements and a new proposal for demolition of a portion of the mill building, creation of new mixed use space in remaining buildings and new parking. Mr. Ford reviews the stormwater management plan using LID. 4,400 s.f. of impervious will be removed in the buffer zone. The slab under the demolished building would remain and will be broken where needed for drainage. Mr. Mabon asks about the slope of the property and if the buffer area would be curbed. Mr. Ford answers the site would be curbed. Mr. Mabon asks how problems with the previous drainage improvement area will be addressed. Mr. Zeren reviews errors in initial survey and underground obstructions. States pervious pavers are working and ½ of rain gardens. Repairs will be folded into the new scope of work. Mr. Mabon talks about the need for good communication. The applicants request a continuance to the next meeting. Mr. Cordaro reviews the resurfacing and stormwater improvement project. All improvements will be in the right-of-way. Mr. Egan is the wetland scientist for the project. Reviews wetland resource areas. Project is part of the Impaired Waterways Program. Work is within Riverfront and BLSF. The project will remove concrete swales and increase BLSF. The Commission discusses payment of the local fee. A motion to grant the request for a continuance to the November 5, 2014 meeting is made by Ms. Feltovic, seconded Mr. Saal. Vote unanimous. (cont. 10/8/14) The administrator states the engineer could not be present tonight but the owner would like to move forward without an as-built as it is cost prohibitive at this time. Administrator reviews the discrepancies between the proposed and as-built plans including stairs and a walkway off the back deck, A/C units, a gravel turn around and landscape plantings that are not native species. The applicant Robert Ercolini of 195 Bridle Path is present. The Administrator reviews the discrepancies between the plan of record and the as-built plan including a swale along the driveway. The stormwater infiltrators are not shown on the plan. Mr. Mabon asks why the stone swale is not a grassed swale. Mr. Ercolini states a smaller swale existed previously. He states the as-built plan was done by a different engineer and he did not know the location of the infiltrators. Mr. Ercolini and Mr. Mabon discuss the function of the swale. Administrator states the infiltrators need to be on the as built plan. A motion to issue the COC and hold until infiltrators are shown on the as built plan is made by Mr. Saal, seconded by Ms. Feltovic. Vote unanimous. (cont. from 9/24/14) The applicant Elizabeth J. Perry of 303 Berry Street is present. Mrs. Perry states the wall extension was an oversight since she and Mr. Perry did not know this would be a problem as they were saving two trees. Mr. Napoli states the commission needs to be consistent regarding modifications and they need to be proposed prior to construction. A motion to accept the waiver request is made by Mr. Mabon, seconded by Ms. Feltovic. Vote unanimous. A motion to issue the modification is made by Mr. Mabon, seconded by Ms. Feltovic. Vote unanimous. A motion to issue the COC is made by Ms. Feltovic, seconded by Mr. Mabon. Vote unanimous. The Commission accepts the Order of Conditions as drafted and amended. A motion to accept the Order of Conditions as drafted and amended is made by Ms. Feltovic, seconded by Mr. Mabon. Vote unanimous. Bylaw Regulations Revisions A motion to continue the matter to November 5, 2014 is made by Mr. Mabon, seconded by Ms. Feltovic. Vote unanimous.
