Mabon, Deborah A. Feltovic, Sean F. McDonough (arrived 7:20 p.m.) Douglas W. Saal. Member Absent: Joseph W. Lynch, Jr., Vice Chairman. Staff Members Present: Jennifer A. Hughes, Conservation Administrator, Donna M. Wedge, Conservation Secretary. Pledge of Allegiance Meeting came to Order at: 7:02 PM Quorum Present. Approval of Minutes of 4/9/14 A motion to accept the meeting minutes of 4/9/14 as drafted and reviewed is made by Ms. Feltovic, seconded by Mr. Mabon. Vote unanimous. Public Hearing: 7:05 PM Request for Determination of Applicability 1080 Turnpike Street (Dan Gill Earthworks) Mr. Saal read the legal notice. Dan Gill of Earthworks, the contractor, presents the proposal to replace a failed tiered retaining wall. He presents photos of the failed wall to the commission and states a more structurally sound block will be used. The wall will be slightly farther away from the wetland than the existing wall. All access will be over the existing drive and no material will be stockpiled. Mr. Mabon asks how the new well would be better. Mr. Gill states there was not a proper footing or stone behind the current wall. Mr. Napoli asks if there will be stairs down from the wall and if there will be additional pavement. Mr. Gill states there will be additional lawn but no additional pavement. Ms. Feltovic asks if the wall will be the same length. The answer is yes. Mr. Saal asks about the existing shrubs. Mr. Gill states they will try to salvage the shrubs. A motion to issue negative determination #3 with conditions for pre and post construction inspection, erosion controls and no stock-piling is made by Mr. Mabon, seconded by Ms. Feltovic. Vote unanimous. Ms. Feltovic read the legal notice. Dave Rimmer of Essex County Greenbelt describes the property and the work required for the new trail. The entire trail is approximately 1,900 linear feet with 500+/- feet in the buffer zone. be done with hand tools and on foot. There may be a chain saw for some larger saplings Mr. Rimmer states the trail will be narrow with signage on trees and educational signage at the potential vernal pool. Waivers are vernal/ephemeral pool. Mr. Mabon states the project is consistent with neighborhood trails and other trails in town. He asks about the timing? Mr. Rimmer states that the work will either be done in June or in the fall. The work should only be one day with volunteers plus some set up by staff. The commission discusses signage. Ms. Feltovic asks where the parking is located. Mr. Rimmer states there is parking along the side of the road. Ms. Feltovic asks about maintenance. Mr. Rimmer responds there will only be maintenance trimming. The commission discusses the waiver request for the vernal pool buffer. Alternatives are analyzed. Mr. Manzi (abutter) states the trail leads people to his hay field and he has had problems with trespassing. Mr. Manzi supports education at the vernal pool and states other signage must let people know the rules. Administrator states there are no other trails that provide education on vernal pools. A motion to approve the waiver requests and issue a negative determination with condition post construction is made by Mr. Mabon, seconded by Ms. Feltovic. Mr. McDonough asks for discussion and states that there are alternatives so there is no basis for locating the pool in this location. The Administrator reviews the delineation review process which has taken several weeks due to the lack of emerged vegetation in the delineation review area. the delineation. He states there is a proposal to work on the slope outside of jurisdiction. Mr. Napoli states he is very familiar with Bear Hill and the conditions on the slope. He states there are many potential issues with development. Abutter Joseph F. Bean states that many trees have been removed and there is soil erosion. A motion to issue the ORAD is made Mr. Mabon, seconded by Ms. Feltovic. Vote unanimous. A motion to close and issue a decision within 21 days is made by Mr. Manzi, seconded by Mr. McDonough. Vote unanimous. 242-1621, 500 Great Pond Road (North Andover Country Club) (The Morin-Cameron Group, Inc.) Mr. Manzi read the legal notice. The Applicant Stephen Kohr General Manger of the North Andover Country Club and Scott Cameron of The Morin-Cameron Group, Inc. are present. Mr. Cameron presents the project. He states there is currently an open order of conditions for the tennis court repair but that should be ready for a COC shortly. He states the Mr. Kohr presents the parking issue that exists during events. Police details are needed and cars parked along the side of the road present an unsafe condition. With the new proposal there will be 23 new spaces and 4 on the road. The Board of Selectmen will need to review the right of way parking. Some work will be in the area of the putting green which will need to be relocated and a new paddle tennis court is proposed. Mr. Mabon discusses the location of the putting green and pedestrian traffic. Mr. Manzi states that stormwater is being reviewed by Eggleston Environmental and that the applicant should work closely with her to resolve the issues in her review letter. Mr. McDonough asks if there will be any waivers. There will not. A motion to grant the request for continuance to May 28, 2014 meeting is made by Ms. Feltovic, seconded by Mr. Manzi. Vote unanimous. Mr. Saal read the legal notice. Benjamin Osgood, Jr. presents the proposal to expand the existing parking, add a retaining wall and repair the foundation of the barn on site. Mr. Osgood states applying the stormwater standards is tricky since this project is neither commercial nor residential but a historic property. He states he provides for sheet flow toward the shed area which drains through a field area to the wetland. Mr. Osgood states the project is time sensitive as funding comes from CPA. - Mr. Osgood states these would be pressure treated or concrete. Mr. Napoli recommends a short wooden guardrail and a stone drainage apron around the perimeter of the parking area. He asks about the height of the fill. Mr. Osgood states it Mr. Saal discusses the wall with Mr. Osgood. Mr. Allegretto an abutter speaks about the view of curbing and railings from his home. Mr. Osgood mentions plantings. Administrator states the proposed pool is outside the 75-foot No-Build Zone to the vernal pool. The shed . Mr. Manzi states this vernal pool should be certified and asks for a better barrier/buffer. The Administrator states a barrier would be difficult because of steep slope and recommends markers along the existing tree line. Marguerite Cooper, abutter, asks where the pool is located in relationship to her property. Ms. Hanley states the pool would be installed in the back yard in an area of maintained lawn. Mr. McDonough reads the legal notice. Curtis Young of Wetlands Preservation, Inc. presents the history of the project and explains the new drainage plan which includes rain gardens and infiltration. The isolated wetland would be filled. There will also be re-vegetation since the lot will be cleared of the scrub and invasive species located there now. The rain gardens will provide treatment and prevent flooding better than existing conditions. Bill Stucky of 47 Cochichewick Drive asks about the house location. A discussion of the house location ensues. It will be a 2-story house. Mr. Stucky is also concerned about the lack of landscaping on the lot once it is cleared. Mr. Young presents the rain garden design. Mr. Mabon states this is a very unique situation as filling of isolated wetlands is not allowed. He also asks about test pits and the sewer line. Mr. Young states more research will be needed on the sewer. The location of the existing service is not known. He also states that a planting plan will be provided. Mr. Napoli asks if the rain gardens should be in the sewer easement. David Anderson, abutter, reminds the commission of the drainage that needed to be installed at Campion Hall and that the soils are clayey and there is a good amount of standing water. He is glad to see something happening on site. Eggleston Environmental is reviewing the project for the Planning Board under the watershed special permit process. Mr. Young a verbal request for a continuance May 28, 2014 meeting. A motion to grant the request for a continuance to the May 28, 2014 meeting is made by Mr. McDonough, seconded by Ms. Feltovic. Documents : Letter from Dalton & Finegold, LLP dated April 29, 2014 WPA Form 8A-Request for Partial Certificate of Compliance Index Map dated April 26, 2014 Trial Maintenance Weir Hill Trail Maintenance Work (The Trustees of Reservation) (TTOR) Kevin Block of The Trustees of Reservation presents the erosion problems that exist at Weir Hill. He provides the details of the boardwalks (untreated hemlock boards on sleepers) that would be installed to prevent erosion. Mr. Block also presents a re-vegetation plan for the eroded beach areas including removal of some invasive species. A berm will also be constructed to stop run-off. Mr. Mabon suggests more signage to make the improvements more effective. Mr. Napoli states this is important work to protect the lake. Mr. Manzi states an EO is the means to get the work done. A motion to issue a Friendly Enforcement Order to stabilize the site is made by Mr. Manzi, seconded by Ms. Feltovic. Vote unanimous.
