Members Absent: Louis A. Napoli, Chairman, Joseph W. Lynch, Vice Chairman, Albert P. Manzi, Jr. Staff Members Present: Jennifer A. Hughes, Conservation Administrator, Donna M. Wedge, Conservation Secretary. Pledge of Allegiance Meeting came to Order at: 7:05 PM Quorum Present. Public Hearing: 7:06 PM Notice of Intent (NOI) NACC# 126, 107 Campion Drive (Lot 89) (Saragas) (Wetlands Preservation, Inc.) (cont. from 5/14/14) (Request to cont. 7/9/14) A motion to grant the request for a continuance to the July 9, 2014 meeting is made by Mr. McDonough, seconded by Ms. Feltovic. Vote unanimous. (cont. from 5/14/14) (Request to cont. to 6/25/14) A motion to grant the request for a continuance to June 25, 2014 meeting is made by Mr. Saal, seconded by Ms. Feltovic. Vote unanimous. (cont. from 5/28/14) The applicants Kenneth & Christine Heitzmann, Michael Derosa of Derosa Environmental Consulting, Inc. and Erick Swanson of Meridian Associates are present. Mr. Derosa reviews the changes made to the plan per the site visit with the North Andover Conservation Commission. Mr. Mabon states that after the site visit it makes sense to leave the stockade fence in place. He adds that the replication area is adequate. Mr. Derosa states there is 525 s. f. of new plantings being installed on the site and 2 year monitoring of the plantings. Mr. Mabon states this a 1 to 1 ratio and the commission is gaining back resource areas on the site. A motion to accept the waiver request for patio within the 50-foot No-build zone is made by Ms. Feltovic, seconded by Mr. Saal. Vote unanimous. A motion to close and issue a decision within 21 days is made by Mr. McDonough, seconded by Ms. Feltovic. Vote unanimous. The Administrator reviews the requested modifications including a stone retaining wall (already constructed), filter and shed relocation, deck stairs and fence relocation. Homeowner Emily Cordaro states there will be only additional grass inside the fence no patio and the shed will not be constructed until next year. A smaller deck was also -Build Zone. Commission states filter must be moved. Discussion of options. Mr. McDonough states states not much difference between proposed earthen slope and stones. Mr. Saal confirms it will not affect drainage. A motion to accept the modification as written and as proposed is made by Mr. Saal. After further discussion about location of filter, Mr. Saal withdraws this motion. A motion to grant the request for a continuance to the June 25, 2014 meeting in order to move the filter outside of the 50-foot No-Build zone is made by Mr. McDonough, seconded by Ms. Feltovic. Vote unanimous. The Administrator presents the COC request and the file research. As-built plan shows a portion of the house in the No-Build Zone and a portion of the yard is in the No-Disturb. The commission discusses the limit of work shown on the plan. Mr. Saal recommends monumenting the top of the slope with wetland markers where the lawn is in the no-build zone. Mr. Kelly, homeowner, states the boulder slope is the limit of the yard. The commission reviews the Order and the perpetual conditions. Mr. Mabon states the applicant can put some wetland makers up on the property and plant some High Blueberry Bushes on the property and be done with this project. A motion to issue to COC hold till wetland makers/plants are installed is made by Mr. McDonough, seconded by Ms. Feltovic. Vote unanimous. Whalen of 129 Christian Way is present. Administrator states this lot is a non-jurisdictional and there are no stormwater structures. A motion to issue the PCOC for 129 Christian Way Lot 1 only is made by Mr. Saal, seconded by Ms. Feltovic. Vote unanimous. Documents: WPA Form 8A-Request for Certificate of Compliance 242-1296, PCOC Request, 7 Abby Lane (Lot 1) (Dube) (SKM Title and Closing Services, PC) Administrator states this lot non-jurisdictional lot in the Molly Town Road Subdivision. A motion to issue the PCOC for 7 Abby Lane Lot 1 only is made by Mr. McDonough, seconded by Ms. Feltovic. Vote unanimous. Documents: Letter from SKM Title and Closing Services, PC dated May 21, 2014 WPA Form 8A-Request for Certificate of Compliance Decisions 242-1623, 1160 Great Pond Road Administrator reviews the draft Order of Conditions. The Commission accepts Order of Conditions as amended. A motion to accept the Order of Conditions as amended is made by Mr. McDonough, seconded by Ms. Feltovic. Vote unanimous. 242-1624 , 56 Monteiro Way Administrator reviews the draft Order of Conditions. The Commission accepts Order of Conditions as amended. A motion to accept the Order of Conditions as amended is made by Ms. Feltovic, seconded by Mr. McDonough. A motion to adjourn the meeting at: 8:05PM is made by Mr. Saal, seconded by Ms. Feltovic.
