The vote was 5-0 unanimous in favor. 14 15 PUBLIC HEARINGS 16 CONTINUED PUBLIC HEAIZING: 121.0 Osgood Street,Forgetta Development LLC,Robert Bohlen: The 17 Applicant seeks a Site Plan Review Special Permit, a Common Driveway Special Permit and Parking Reduction 18 Special Permit for the construction of approximately 40,000 square feet of commercial space contained within five 19 (5)separate buildings, parking spaces, stormwater management facilities, landscaping, signage and other 20 improvements to be located on a 4.3-acre portion of currently vacant 13.8 acre parcel. This project is within the B- 21 2 Zoning District. 22 23 CONTINUED PUBLIC HEARING: 1210 Osmood Street,Princeton Development LLC,Andrew Cliaban: 24 The Applicant seeks a Site Plan Review Special Permit, a Multi-Family Use Special Permit, a Common Driveway 25 Special Permit, a Building Height Waiver Special Permit and a Parking Reduction Special Permit for the 26 construction of a market rate rental residential community to be known as Princeton at North Andover Apartment 27 Homes, consisting of a total of 192 one-and two-bedroom units to be contained within four(4)separate four- 28 story garden-style buildings each having a building footprint of 15,050 square feet, along with a clubhouse/leasing 29 management office,pool,parking spaces, stormwater management facilities, landscaping, signage and other 30 improvements to be located on approximately 9.5 acres of land on a currently vacant 13.8 acre parcel. This project 31 is located within the B-2 Zoning District. r 32 33 J. Enright: Reviewed the final number of parking spaces provided versus the required numbers for each 34 application. L. Eggleston has provided final comments regarding the design and has requested a couple of 35 additions to the O&M and Plan. Each of her comments has been conditioned in the draft decisions. The Applicant 36 is currently before the Conservation Commission. I..,. Eggleston attended the past hearing and provided a thorough 37 overview of the stormwater management design. The Commission appears to have accepted the overall design; 38 however, did not close the hearing. They have asked the applicants for a more detailed construction sequencing 39 plan and would like to review and discuss the O&M Plan in more detail. The last item outstanding item is the 40 sewer design. Woodard &Curran,the DPW Peer Review Consultant, reviewed the design of the system both on- 41 site and off=site. They performed a flow analysis and capacity study;minor changes will need to be made to the 42 on-site Plans. Again,the draft decisions condition updates. There are off-site improvernents recommended to two 43 sewer segments; one on Old Farm Road and one off of the end of French Farm.Road, in a wooded area between 44 the roadway and Rea's pump station. Brown, Princeton Properties: This condition causes us concern because we cannot get an occupancy permit for 48 any of our buildings until this work occurs and we have no control when, and if,this work will take place. 49 However,we are willing to go forward in good faith that this will happen and agree to work together with the 50 Town to formulate a more solid agreement. 51 52 MOTION: D. Peter Boynton made a motion to amend the main Height Waiver to 85 inewporate Buildings (,, .D&E only(excluding Building B). Building B does not take advantage of the site's 86 topography to absorb floors as outlinedfor the basis of the original height waiver. The motion was not seconded 87 by any Board member;suggested amendments were not adopted, discussed nor debated, therefore the original 88 motion on the floor remains. The Applicant 1.00 proposes to subdivide a 7.80 acre parcel into 3 building lots;with one lot(Lot 3)conforming to R-2 zoning j 101 regulations in area and frontage. For the remaining 2 lots the Applicant seeks frontage exception special permits, i 102 Access Other Than Legal Frontage, and a Common Driveway special permit.The property is located in the 103 Residential 2 (R-2) zoning district. 104 [Continued to December 20, 2016 Planning;Board meeting] 105 106 NEW PUBLIC HEARING: 575 Turnpike Street-Chestnut Green,Steve Stapinski: Application for Special 107 Permit—Site Plan Review under sections 8.1, 8.3, 10.3 and 10.31 of the North Andover Zoning Bylaw. Applicant 108 proposes to construct nine (9) parking spaces located at the end of Hillside Road. The proposed project is within 109 the Business 4(B-4)Zoning District. 110 R. Oldham: ]'his project was originally brought before the Board in the form of a waiver request at a previous ill meeting. We circulated the application to all appropriate departments,The NAI"D has submitted comments stating 11.2 they do not believe this will impede their emergency response to the complex; the existing roadway is currently 113 not sufficient for their fire trucks. Building reviewed the parking plan and commented that there is not sufficient 114 parking at this site currently;they are in favor of additional parking, DPW had no issues except that as park of any 115 approval the Board condition that conceptual right for the Roadway Easement be established and conveyed to the 1.16 Town as well as recorded with the Registry of Deeds. The stormwater consultant had no issues with the design. 117 Her comments involved maintenance of the porous pavement which she recommended be conditioned. 118 Steve Stapinski,Merrimack Engineerin : Previously,the Board decided we should pursue Site Plan Review based 1.19 on emergency vehicle access and stormwater review. (Displayed colored site plan)A portion of the paved 120 roadway is on the Chestnut Green property.After several serious accidents,the Town and Board of Selectmen 121 closed Hillside Road at Route 114 (MA Highway paid for this), prior to Chestnut Green being built. The 122 Fellowship Bible Church sold the property to the Chestnut Green developers.The easement was never taken for 123 the turnaround; it never went to Town Meeting. The nine additional parking spaces would begin at the edge of the 124 existing pavement. Vehicles could still turn around, as they do now. Wetlands nearby lit-nit parking options. These 125 new parking spaces will be dedicated to employees; providing more options for patrons. 126 Mark Brissenden, 250 Hillside Road Abutter: Requested explanation of the proposed site layout and description 127 of lighting levels.No additional lighting is proposed. 128 Craig Burns, 234 Hillside Road Abutter: This site is congested with commercial delivery trucks using the area. 129 Twenty years of growth was originally taken down to add a couple of parking spaces and a dumpster. People cut 130 from Route 114 through to'route 125. It's dangerous, I've had my fence and mailbox taken down and basketball 131 net dragged down Route 125. The complex is encroaching on the neighborhood.There's no buffer. We have to J 132 watch our cars backing in and out. Simons: Is this the best solution?Will this parking solution make it better or worse? 134 C. Burns: My fear is that it will make it more congested. Medical vehicles drop off and pick up people; however, 1.35 designating the spaces as employee parking spots may help. 136 Jill Burns, 234 Hillside Road Abutter: There are frequent van transports for elderly people that wait in that circle. 137 I'm not sure where these vehicles will end up. 13$ P. Baynton: If parking spaces will occur where it's currently landscaped; it might make it less possible for other 139 vehicles to loiter there; forcing vehicles toward the existing parking lot; creating relief for the neighborhood. 140 John Kin& 591 Turnoike,abutter: I rent out the home at the edge of the closed road. The turnaround isn't big 1.41 enough;I would question a firetruck can navigate it. There's a deteriorated drainage opening on the opposite end 142 of Hillside that the town has not addressed. Questioned the gross building square footage v. the total number of 143 current spaces, snow storage areas, and the construction and maintenance of the porous paving material. 144 R. Oldham: There is currently 84,1.22 sq. ft. of gross floor area in three buildings; if decmed medical,they would 145 be required to have 378 parking spaces and there are 259 spaces on site. 1.46 S. Sta nski: Chestnut.Green has tried unsuccessfully to rent spaces from Rite Aid. 147 J. Simons: We agree this is a situation that needs improvement and recommend you meet with the abutters,review 148 our drainage study and together we should be able to make this better than it is today. 149 P. Enrig: This building has been purchased by H. Kanellos. A condition stated in a Modification Site Plan 155 Review Special Permit required a parking analysis to be completed after the issuance of a Certificate of 156 Occupancy for a restaurant that opened in the plaza. The analysis was supposed to done at a 6 month and one year 157 interval. H. Kanellos has provided a 6 month pat-king analysis that indicates the parking lot is not at capacity at this 158 point. He plans to open a"fast food restaurant"after January 2017. The fellow-up analysis will show the impact 159 of his restaurant on the parking. 160 H. Kanellos: Agreed to supply an additional study in April. 1.61. 162 Rudick Place, 1046 Great Pond Road,Arthur Watson: Request an Insubstantial Change for the Definitive 163 Subdivision approved on March 17,2015 and a Special.Permit Extension for the Watershed Special.Permit also 164 approved on March 17, 2015. 165 Arthur Watson: Explained that his original house mover has backed out,therefore it may not occur until spring. 166 MOTION: L.
