Mabon, Deborah A. Feltovic, Douglas W. Saal. Members Absent: Albert P. Manzi, Jr., Vice Chairman, Sean F. McDonough. Staff Members Present: Jennifer A. Hughes, Conservation Administrator. Pledge of Allegiance Meeting came to Order at: Quorum Present. Approval of Minutes of 8/10/16 A motion is made by Mr. Mabon and seconded by Ms. Feltovic to approve the minutes of 8/10/16 as drafted. Vote: Unanimous Public Meeting: NACC# 177, 220 Forest Street (Dushane) The homeowner, David Dushane, is present. The Administrator presents the proposal to connect to an existing water service in the street. The applicant has a well that has gone dry. She states the wetland resource area is across the street and no erosion control is needed. Mr. Mabon asks if the submittal is complete. Mr. Lynch asks if dewatering will be necessary. The administrator states it is unlikely. Mr. Mabon asks if any special conditions are necessary. The Administrator states only post construction inspection. Mr. Mabon makes a motion to consid Ms. Feltovic seconds the motion. Vote: Unanimous Mr. Mabon makes a motion to approve the project as proposed with a condition for post construction inspection. Mr. Mabon makes a motion to issue a Negative Determination #3 for the work as proposed with conditions for post construction inspection and the installation of a permanent drip trench around the new structure. Ms. Feltovic seconds the motion. One flag was moved during review and the plan has been updated. The Commission discusses soils and the former use of the site. Mr. Napoli states loam was previously stockpiled in this area. The Commission states they will approve the delineation but a file number is needed. Mr. Mabon votes to continue the matter to the September 28, 2016 meeting. Ms. Feltovic seconds the motion. Ms. Feltovic makes a motion to continue the public hearing to September 28, 2016. Mr. Mabon seconds the motion. Vote: Unanimous Document: E/Mail prepared by Cornerstone Land Associates request for a continuance to the September 28, 2016 meeting dated September 14, 2016 Amendment 242-1629, 4 W High Street (RCG West Mill NA, LLC) (Civil Design Group, LLC) David Steinbergh of RCG West Mill NA, LLC and Phil Henry of Civil Design Group are present. The Administrator introduces the request to amend the Order of Conditions to add a parking lot and stormwater management in the location of the previously demolished building. Mr. Steinbergh reviews the history of the project and introduces Mr. Henry the engineer on the project. Mr. Henry reviews the details of the parking including 108 parking spaces utilizing a rear access drive. This will result in the loss of 6 spaces from the first phase of the proposal. Bioretention will be used for stormwater management. There will be additional mitigation -Disturbance Zone including 13 trees, 70 shrubs and ground cover. The bioretention area will discharge through an existing manhole to Osgood Pond. Impervious area will be reduced on site (from the original design) by 300 s.f. The Administrator states the proposal was reviewed by Eggleston Environmental for stormwater. Mr. Mabon asks if pervious pavement will be used. Mr. Henry states the drainage will go to the bioretention areas which include a forebay and a concrete trench which will allow stormwater to settle then overflow. Curb inlets will let stormwater into the sediment forebay and the extended bioretention area. Photos of the site are presented. Mr. Napoli asks if there will be a cut in the grade for the parking lot. Mr. Henry states the grade will be based on the doors of the new building. The cut will be Mr. Lynch states there will be a net improvement on runoff and treatment. He states a net improvement is needed. The Commission discusses an old treatment pond on the site that will no longer be used. Mr. Mabon asks about the relocated cooling tower. The Administrator states there will be new trees added. . The applicant requests to continue to the next meeting. Ms. Feltovic makes a motion to continue the hearing to September 28, 2016. Mr. Mabon seconds the motion. Mr. Lynch points out that there are successful 40B proposals that do not have enforcement issues. Mr. Mabon asks about the flared end pipes. Mr. Lynch confirms that the Commission received the overlay plan required by the Enforcement Order. The Administrator states grading in the No-Disturbance Zone is shown. Mr. Mabon states the project is out of control. He states the applicant at one point stated that wetland was not being altered. Mr. Mabon makes a motion to approve the modifications as requested. Mr. McKay reviews the difficulty he had installing posts for wetland markers since there is Mr. Lynch states the markers are to identify Riverfront Area and asks if it is all ledge at the site. Mr. Saal asks why Riverfront is being marked. Ms. Feltovic makes a motion to issue a full and final COC to be held until the wetland markers are installed on boulders. Mr. Mabon seconds the motion. Vana, Jr., Trustee is present. The Administrator reviews the Field Inspectors recommendation that no work was ever done on this filing. There is some discussion of understory clearing but it will be made known to future owners that not additional clearing can be done without a permit. Mr. Mabon asks if the work never done box will be checked on the form. It will. She states this easement will be in addition to one held by GLSD on the same parcel. Mr. Lynch confirms that is legitimate to have two easements on one parcel. The Administrator confirms that GLSD knows of the request. Mr. Mabon states we should have a signature from GLSD acknowledging the new easement. Mr. Saal sates National Grid should pay for review of easement language by Town Counsel. The Administrator reads an email from a National Grid representative, Jessica White. Mr. Mabon states National Grid wrote the easement so it is likely in their favor. Mr. Napoli states the town should not pay for review. The Commission requests the Administrator let National Grid know review by counsel is needed and should be expensed to the applicant. A motion to continue the matter to September 28, 2016 is made by Ms. Feltovic and seconded by Mr. Mabon. Vote: Unanimous.
