Manzi, Vice Chairman, John T. Mabon, Deborah A. Feltovic, Sean F. McDonough Members Absent: Joseph W. Lynch, Jr., Douglas W. Saal. Staff Member Present: Jennifer A. Hughes, Conservation Administrator Pledge of Allegiance Meeting came to Order at: 7:05 PM Quorum Present. Approval of Minutes 11/16/16 The minutes have not been circulated for review. Will be added to the next meeting. Conservation Restriction & Stewardship Memorandum of Understanding (MOU) Leonard Farm CR (Essex County Greenbelt) (cont. from 11/30/16) Vanessa Johnson-Hall of Essex County Greenbelt, Inc. presents the final Conservation Understanding between Greenbelt and the town stating that as co-holders of the restriction Greenbelt will be the primary for monitoring and enforcement. She asks that the Commission recommend to the Board of Selectmen that they sign the agreement. A motion to recommend that the Board of Selectmen sign the Memorandum of Understanding is made by Mr. Manzi and seconded by Ms. Feltovic. Vote: unanimous A motion to approve the acceptance of the Conservation Restriction as presented is made by Mr. Manzi and seconded by Ms. Feltovic. The Commission was unable to close the hearing at the last meeting because a DEP file number had not issued. A file number has now been issued and there are no comments. Mr. Manzi asks if the Administrator is satisfied with the delineation. The Administrator states she reviewed all of the flags and nothing was changed. A motion to approve the delineation of the on-site wetland flags and the buffer zone on the property associated with off-site flags is made by Mr. Manzi and seconded by Ms. Feltovic. At the last hearing a DEP file number had not been issued. A file number has now been issued and he has spoken to the DEP reviewer, Heidi Davis, and she has no comments. A motion to close the public hearing and issue a decision in 21 days is made by Ms. Feltovic and seconded by Mr. Manzi. (cont. from 11/30/16) A motion to continue the hearing until the meeting on 1/11/17 is made by Ms. Feltovic and seconded by Mr. Manzi. Vote: unanimous Document: E/Mail request to continue from Elizabeth Wallis of Hayes Engineering, Inc. dated December 13, 2016 242-1692, 1210 Osgood Street (Princeton Development, LLC & Forgetta Development, LLC) (Epsilon Associates, Inc.) (cont. from 11/30/16) Mike Howard of Epsilon Associates is present to represent the applicant. He states this is the third hearing on the project. He states an action item for the applicant is the construction sequence. He reviews the updated materials provided to the commission including an O&M Plan, a maintenance schedule for the Bayfilter system, snow storage and the proposal for a maintenance contract. He states construction sequencing will be further finalized when a contractor is on board. Mr. Howard has also proposed some language for special conditions based on comments from the last meeting. Mr. Mabon states the proposal is for 100% buildout and managing the site during construction will be important. He states the current sequencing plan is not all the way there yet. Mr. Howard refers to the condition he drafted for the approval of the SWPPP. Mr. Napoli states there should be a subcommittee to review the SWPPP similar to what was done at Merrimack Condominiums. Mr. Howard states he proposes that the review of the updated SWPPP be 30 days before construction begins. If Eggleston Environmental will be involved the Administrator states escrow will be needed. The commission discusses erosion control for the site. Mr. Howard states there can be a special condition to address the placement of additional controls. The special condition is reviewed. Mr. Mabon states the site will need int should make the call when there are changes. The Administrator will draft the special conditions for the next meeting. The applicant agrees to continue due to the extended time between meetings. A motion to continue the public hearing until the January 11, 2017 meeting is made by Mr. Manzi and seconded by Ms. Feltovic. The Administrator states there has been tree clearing done in the buffer zone. Kenneth Lania is present to represent the applicant. He states that he withdrew the prior filing and is here tonight to present the resubmission. He explains the history of the project and the current drainage problems. He reviews the location of the proposed project. It includes a 30 acre drainage area including the closed drainage systems on Monteiro Way and Quail Run. He states the swale and the outlet of these systems overflows regularly and ices the parking lot. His proposal includes a forebay and weir and a bio retention cell that is 4,000 s.f. larger than the wetland area. He reviews the disturbance to bank and the Wildlife Habitat Study done due to that impact. Mr. Napoli states that stormwater review is needed. Mr. Lania states Lisa Eggleston has received the filing. Mr. Mabon asks about the tree clearing. Mr. Lania states the clearing was not approved. He states National Grid is replacing direct burial services. He thought the channel did not qualify as BVW. He estimates the closest The Administrator states she issued an EO for the unauthorized work. Mr. Mabon asks about the two different trains of runoff. Mr. Lania reviews the drainage plan. A motion to continue the public hearing to the January 11, 2017 meeting for stormwater review is made by Mr. Mabon and seconded by Mr. McDonough. Mr. Napoli states that 6 months is extremely generous. Mr. Mabon and Ms. Feltovic agree. Mr. McDonough does not necessarily agree due to the violation. The Administrator explains the work done on the wall.
