Enright: This ANR was conditioned in the Special Permits for the recent approval for the"Sinall Home" I I concept development.It combines the 20 acre parcel with the existing Edgewood parcel.The property lines of the 12 pre-school and Half Mile Hill need confirmation. If you approve the AMR this evening, I would ask that it be 13 contingent upon myself and Town Counsel reviewing and approving any revisions necessary to properly depict the 14 boundary lines and the owners of record, 15 MOTION: D. Kellogg made a motion to approve the ANR after the plans are in proper order. P. Boynton 16 seconded the motion. The vote was 5-0, unanimous in favor. 17 18 BOND RELEASE: 19 1275 Turnpike Street,BHE!htview,North Andover,LLC-Request for release of Slope Stabilization Bond. 20 J. Enright: The Continuing Care Retirement Center(CCRC) Special Permit was for the construction of a 125 unit 21 CCRC with associated grading, parking, utilities and landscaping. The project is frilly constructed;previously you 22 released the $40K performance bond;the applicant is requesting the release of the $100K slope stabilization bond. 23 The decision instructed that the Environmental and Construction Monitor must certify that the slopes and retaining 24 walls have been constructed according to plan. That certification was provided in December of 2013.T'he 25 Applicant could then request the release of the bond three years after the certification. I conducted a site visit and 26 did not observe any obvious defect in the retaining walls. I asked the Town Engineer to provide comment; 27 however, he was not employed with the Town at the time of the development thus had no involvement in the 28 design, construction, or inspections of the retaining walls. Therefore,he could not provide a formal response. 29 MOTION: L. Rudnicki made a motion to approve the full slope stabilization bond release,plus interest for 1275 30 Turnpike Street, Brightview; subject to receiving written certification from the"Town Engineer that there are no 31 obvious defects in the wall and the Applicant is required to supply additional landscaping in front of the complex. 32 P. Boynton seconded the motion. The vote was 5-0, unanimous in favor. 33 34 PUBLIC HEARINGS 35 CONTINUED PUBLIC HEARING: 30 Ironwood Road John and Kara Guinee: Application for a Watershed 36 Protection District Special Permit to authorize work within the Non-Discharge Zone and Non-Disturbance Zone of 37 the Watershed Protection District. The project consists of patio construction, driveway extension, addition of 38 planting(landscape) areas, and tree removal. This project is within the R-1 Zoning District, 39 R. Oldham: The Applicant is requesting to withdraw without prejudice. 40 MOTION: L, Rudnicki made a motion to accept the withdrawal without prejudice of 30 Ironwood R. for a 41 Watershed Special Permit. D. Kellogg seconded the motion. The vote was 4-0, unanimous in favor. (J. The 45 Applicant proposes to subdivide a 7.8 acre parcel into 3 building lots; with one lot(Lot 3)conforming to R-2 46 zoning regulations in area and frontage. For the remaining 2 lots the Applicant seeks Frontage Exception special 47 permits,Access Other Than Legal Frontage, and a Common Driveway special permit. The property is located in 48 the Residential 2 (R-2)zoning district. 49 R. Oldham: The plans have been reviewed by the Building Commissioner;the lots, other than what they are 50 seeking Special Permits for, comply. This lot has not gone through the ANR process and if the proposed plan 51 remains, a Land Disturbance permit will be necessary and stormwater review will be required due to the 52 substantial slope on the site. The Applicant has been before the Conservation Commission as a discussion item 53 and has filed an NOI for the driveways. 54 P. Christiansen, Engineer: There is potential for a 5 lot subdivision; with challenges, i.e. riverfronts, endangered 55 species, wetlands,vernal pools, etc. Therefore, we proposed this 3 lot design to limit disturbance. There is approx. 56 7.8 acres total; we will designate approx. 2 acres to a Conservation Easement for endangered species. We are 57 working with Natural Heritage to determine those details. We are requesting two Frontage Exceptions, a Common 58 Driveway and two Access Othei-Than Legal Frontage Special Permits. This project will require a filing with 59 Conservation. The Form.A would be initiated after the granting of the Special Permits. 60 R Christiansen: The frontage exception lots are 136,731 sq. ft. & 134,570 sq. ft.;the single lot is 60,000 sq. ft. 61 They all meet the one acre lot requirement for R-2. Steep slopes are approx. 15-18%, I will provide the Board an 62 accurate Proof Plan and more information on the slopes. The driveway configurations minimize the Conservation 63 disturbance. Our drainage calculations for stormwater management are designed to the 100 year storm event with 64 the new flow rates of tap to 8.6 inches of rain per hour. Driveways may slope approx.12%. 65 J. Enright: If you disturb more than an acre of land a Land Disturbance permit will be required. This is more than 66 an acre of land. Conservation only has jurisdiction at the lower end of the driveway. They will need to appear 67 before the Planning Board for a Land Disturbance permit requiring a stormwater review. Did Conservation request 68 a Construction. Sequence plan? 69 P. Christiansen. Yes they did, and Conservation is focusing on wetland issues;the current plan seemed agreeable 70 to them but we have not formally submitted it yet. 71 J. Simons: Requested staking of the lot in the field, driveways on the lot, etc. for a potential site assessment to 72 understand the impact of the topography. Have you completed septic testing? 73 P. Christiansen: Test pis are shown on the plan; soils are all"A type"; rapidly drainable soils. It makes it difficult 74 to deal with the increase in flow when you remove the trees, soil, etc. Restricting the flow to existing conditions 75 will be expensive. The proposed project 81 is within the Business 4 (B-4)Zoning District. 82 MOTION: D. In the original approved permit, the antenna specified for pole#SC31 located at 635 92 Chickering Road has not yet been manufactured so they removed the pole from the permit, They have found a new 93 location to cover that data gap located at 660 Chickering Road and would like to add this into the original permit 94 as air insubstantial change. We had the location reviewed by the radiation safety specialist who confirms the 95 proposed equipment complies with the FCC RF exposure guidelines including residential areas and surrounding 96 neighborhoods.The main concern throughout this process has been abutter notification. In this new location there 97 are some abutters on Walker Road that were not notified through the initial process for the original permit and 98 therefore would not be notified of the new pole through the insubstantial change. "Therefore we are asking the 99 Board to determine if this can be an insubstantial change or if a modification and/or new permit is necessary. 100 J. Simons: This pole did not appear in their original application therefore it is a new application to modify the 101 Special Permit. However,due to the circumstances we agree to waive the fee for the application. 102 1.03 980 OsIzood. Street,John Smolak: Proposed Redevelopment Project. 104 J. Smolak,Attorney for prospective applicant and a representative from TM Crowley, presented a schematic 105 proposal for a 1.3 acre Cumberland Farms project along Route 125 (current location of NA Shell Gas Station), The 106 site is within the B2 zoning district and within the Watershed Protection District.The lot was created in 1959 and 107 adheres to previously established setback requirements, The proposed improvements are within the Non-Discharge 108 Zone; 100-325 feet from the wetland.There are two existing buildings on site constructed in 1965 and a vacant 109 building that had contained a Dunkin Donuts and a flower shop. The proposal is for a new retail convenience store 110 approx. 4,700 sq. ft. and gas services consisting of a new overhead canopy with new gas dispensers. The 25 year 111 old underground gas tanks will be replaced with new state of the art piping and tanks.New landscaping and 112 signage will be provided.Due to Town regulations stated in the bylaw you could not build this gas station project 1.13 today in the Watershed Protection District. In order to move forward with this project,the Applicant will need to 114 go before the Zoning Board of Appeals to extend a preexisting non-conforming use and a variance for a new 115 structure in the Watershed. In addition the proposal requires a side setback variance. In addition, a Watershed 116 Special Permit and Site Plan Review Special Permit are required as well as an ANR.AD from Conservation. The 117 Applicant will be seeking to increase underground storage for petroleum products. 'Zoning issues need to be 118 finalized with the Building Commissioner before any application can be filed. The site is not in a flight path; 119 there's no height issue and we don't anticipate any issues with the FAA and MassDOT Flight Division. We have 120 had conversations with MassDOT and they have no issues with respect to the proposed configuration; we'll 121 produce a traffic study;however, it is important to note that this is not a drive thru facility. Provided an overview 122 of the overall proposed site layout. 123 BOARD DISCUSSION: The main concern was the new underground tanks in the Watershed. The location is in 124 close proximity to the Lake. In addition, queuing and Rt. 125 traffic impact were discussed. 125 126 Selection process for a Master Plan Committee: 127 E. Kfoury, Director of Community&Economic Development appeared before the Board to discuss the Master 128 Plan Selection Committee process. The Master Plan process is estimated to be at least an 18 month 130 process.A consultant will be hired and their role will be further defined. It will be a team led by RKG Associates. 131 They will review the'T'own's existing doctunents, actively engage the community, lead public outreach, deal with 132 feasibility and economics. 133 Board.: General discussion regarding whether Planning Board members should serve on the Master Plan 1.34 Committee and will it be a`steering committee' or an `advisory committee'. Requested additional information 1.35 related to the defined rolls and responsibility of the Selection Committee, Consultant, and"Advisory Committee" 136 (Master Plan Committee). Recommended that L. Rudnicki and P. Boynton serve on the Committee as ex-officio 137 members. Selected L. McSherry and L.
