The following members were present and voting~ Fritz Ostherr, Chairman; William Chepulis, Vice-Chairman; William 1~. ~lewme, Clerk; a~d John J. ~onteiro. The Xinutee of Aug. 16, l~ were approved as received upon mo%ion of ~r. Monteiro and second By ~r. ~emme. PLa~S NO~ I~E~; ~I~OVAL~ 1. ~ILLOW RIDGE - Ja~co 0~stru~tion Co., Inc.: Lots lOA, llA and l~A-17A; lot lines have Been changed but all have the some frontage and over an acre of la~d. ~r. Mon%eiro made & action to endorse the plan of land dated ~0/4/76 as not requiring approval Under subdivision control law. ~r. Saleratus seconded and the vote was unaaim~.,e. 2. PE~[I LAN~ - ~ott Properties: The plan dated Oct. 29, ~76 dendtes a change in lot lines. A motion was made By ~r. Salem,s to endorse the plan aBov~ as not requiring approval under subdivision control law and seconded By l~r. Non%circ. The vote wa~ ~,']~.l~l. mons. ' ' · APPLEDORE~ The Chair,~.- reiterated what has happened i~ the past few months; it is complex subdivision. The developer agrees ~ith ~r. C~rts letters and wants to finish everything By Dec. ~ with the exception of the cro~m in the road which they tb4-~ a mistake and is is worth correcting? They are suggesting that there is no need for the crown because of the Hillside Rd. counection, etc. ~r. Ostherr stated that he told outside this meeting that since they propose to finish the work By Dee. ~ and no one is here representing them therefore would like to refer ~r. Oyr's letters to the BOARD for review. A letter from the Board of Public Works was read. The Chairman sug- gested tabling the matter until further input was received from the developer. ~r. Monteiro questioned whether or not ~r. Cyr was satisfied and whether ;~r. ~orgesi had done anything on the lif~ station~, to benefit the ?owe. Mr. Monteiro felt that the To~n should not Be responsible for the li~t station. The suggestion was made that the lift station business Be pursued with the ~oard of Selectmen. The developer clai~ ~hat the ~ d~es not hold a Bond on the subdivision any more. Dr..%ccarecoio asked if that ~ould mean that the Town has lost all leverage - Mr. Ostherr explained that the Bond has not Been released, what the enabling legislati~ s~tes, and that it is a ~tter for the courts to decide.. ~r. Chepulis asked what could Be done if it is true tha~ we hold no Bond - Mr. co,herr suggested that the BC~F~D see what is done by Dec. ~ and ~ithhold releasin~ the Bond until the corrections are made. Mr. Chepulis then made a m~tion that the Bond not Be released until the items contained in the High- wa~ Surveyorts correspondence of OCt. 2~, ~76 Be completed as specified and the June ~, ~76 letter to the High~y Surveyor from Nethuen Construction wherein a ~ year g~_~_~antee will Be in effect until June ~, ~77. ~r; Non~eiro seconded and the vote was unanimous. ANDREW CIRCLE - Mr. Oyr repox-ted that no action h_~d Been taken and there had been no coe~a~uication from the developer. ~wmmr~O~ ~EST - A hearing date of Nov. ~5, ~76 was set by unanimous consent of the BOARD. PO~D W0~DLAND - A Jul~ 1, 1980 date was set for total cce~letion per John Turtle. will Be made part of the covenant and/or Bond. The eubdivisicm will be completed in 3 phases.
