HomeMy WebLinkAbout1976-12-06December 6, 1976 - Nonda~r Regular ~esting - The ~.AWNING BOARD held a regular monthly meeting on Nonday evening, December 6, 1976 at 7:30 P.M. in the Town Office ~eeting Room. The following members were present and voting: Fritz Ostherr, Chairman; William Chepulie, Vice-Chairman; William N. Saleratus, Clerk; Paul R. Lamprey and John J. ~onteiro. P~BLIC ~ING: TRAFALGAR ESTATES The Clerk read the legal notice. Atty. John Jo Willis, Sr. represented the applieant and stated t~a_t this definitive plan represents all modifications that the ~ requested at the preliminary discussion. The land was eriginally purchased by Hr. Flatley who is in the multi-family development Business, not single-family. They propose this develop- ment as a single-family dwelling parcel with the reservation that if a lot was sold to an individual a duplex could be built Because the R-~ zoning allows it. He continued that he was before-the BOARD for Several reasons: the land was purchased maay years ago and must be put to some use; there exists a fantastic drainage problem at Summit Ave. and Andover st. where the drain enters into the State Highway~ Becky's Poud area, etc.; the development of this parcel will eliminate a seri~a~ drainage problem at this point. He mentioned the definitive schematic and the fact that the drainage would be thr~,_gh an easement to another~portion of Andover St. which.will.maintain the integrity of Becky's. There will be sufficient water going that way to replenish the pond. Hr. ~elinas said that the hydraulic' engineer was present to explain in more detail. They do not inten4 to subdivide the portic~ on Pro_epect Terracez~r ~ileen Rd. They eliminated the oul de sac and are providing-& walk-way to the Franklin School. This development, said Mr. Willie, will pr~ide the price of house that is reachable in North Andover, the lot areas exceed other developed in this Aietrict of Town, and the Town will be vex-g proud of the development. He announced that Mr. gane, engineer for the developer, was a/so present to answer any questions. Hr. Monteiro asked what would happen to the two lots on Prospect Terrace - nothing right now. Member Monteiro suggested using it for conservation purposes. Mr. Willis felt that the logical thing to do would be to sell it with the lots on Summit Ave. Mr. Saleratus suggested changing the n~mee of ~umait and Farnham Rd. inasmuch as it is a duplication of existing names of streets in the Town. Mr. Willis left that up to the BOARD'S dis- oretion. Mr. Ostherr questioned the easement - Atty. Willie said that he has a representation from Hr. Hammond and his attorney provided that the ditch remain open to Andover St. The easement to the school could Be deeded over to the Town. Mr. Cyr mentioned that this would have to be done in order for the Town to maintain it in the winter. Mr. Ostherr felt that a network of sidewalks Should be incorporated into the plan - the right of way includes space for them, said Willie, but they are not on the plan now. Mr. ~elinas re the draina~e~ there is presently a 36# pipe that ter~L~tes at Lot ~ and a ditch which was built in conjunction with Rc~j~l Crest Estates. '~he system that this enters into can h~dle a 18 mo. storm which bears out the fact of the severe draAn- age problem. There is another ditch that enters into the intersection of Andover St. and Chickering Rd. A solution to these problems along with those caused by Flatley's present development have Been worked on By DPW, etc~ He then drew a drainage network on the plan for all to view. The last restriction of this drainage watershed ends in Ba~k cf De~oul~s, then Ipswich Rd. and Ohiokering Rd. culvert. A 30" pipe in and out with a ~2" pipe below will carry the water 80-90% of the time. We have sat down 2 or 3 December 6, 1~76 - canto times in the past few months ~ith the DPW who ~ill review the pla~s Before tying in with an~ drainage on the ~tate highway. T~ere is a 45 c.f. cap. going under Andover St. to Ohiokering and the easement fro~ the Has.nond*s will enable the use of a 30# p~p~ going .to it. Re sewer: ~.~,OO i~. of r~ in the subdivision to be tied in at the intersection of ~dover St. with the proposed ~_mit Ave. ~he water line more or less follo~s the ro~d and connects at Audover I~1;. and ~m~!t Ave. Re traffic flow: the developer*s representatives stated that they w~uld rather listen to input from the public hearing. There are 64 .lots ,~ithin the eU]xlivieio~ ~hich has no connection with Royal Cres~. Mr. Mm%elto felt there could be a safety hazard on Tolland and ~erkeley. ~rs. ~ Armitage~ ~utton Hi'll Rd.: voiced 'concern in terms of the school sy~em and the numbers that would go to %he l~lin ~chool. ·Grades 1,2, '& 5, because of over- ore. ding, are now sending children to ~he A%kinson and ICi%tredge. ~ ~rmitage read fro~ the superintendent~s repor~ which stated that if development c~nti~ues & school would be needed in precinct 5 by early 1~80; Appledore and Flatley were mentioned. She s~id he did not include the Waverly Rd. development nor Greenwood. ~he also was con- corned about police, fire, trash collection, etc. ~gnioh coupled with the school situa- tion would result in a serious impact on the oc~munity. It was subs%ed that a. stu~ly ou the impact of our school s~tem be undertaken before approval of these plane is given ° Mr. Os%herr thanked ~rs. Armitage for her thoughts but pointed out %hat there are cer- tain things the. BOAP~D can and cannot do. The To~n has to prmvide, services and this h~s Been proven in the courts. ~[r. Cyr added that it would be a tremendous strain on the Highway Dept. budget to have to service all these roads. Mrs. Lucy Palmer, Tolland Rd.: que~tioued the widening of. Tolland Rd. Mr. Mouteiro clarified the c~uestion by stating a decision had to be ma~$ whether or not to open i% up. The Highwa~ ~urveyor felt that if Tolland and Berkeley were opened u~ it would Be difficult to provide To~n services, Mrs. Dorott~y Le~is, Highland Terrace: asked if %hey were p]a~ing ou sending water onto Rte. 11~- Mr. ~illis said, no. Mr. Chepulis ashed how Mr. Flatley plans to develop this parcel - 2he general plan is to put in the facilities and then put them available to the ~arket with the hope that a local building contractor would be interested im building the homes; they will be on an individual purchase basis~ there will be sc~e control as to the type of home that will be constructed .in order to maintain the character of the development;~they will not be on a rental basis. Mr. ~ark Donovan, representative of Mr. Flatley, also stated that l~latley will stick through with the development because he is known for his go~d taste in whatever he has undertaken. Ja~ Burke= asked if when they spread the ~rainage going from one watershed to ~nother will it be necessa~ in the ~uture for any retent'ion; mentioned the capacity on Chicker- lng Rd. and Andover S~t. and felt the most important cue was ~n Waverly Rd. - these c~tlvex-ts have the capacity of handling the present flow and an additional split-off flow and flow from a~ development do. ns%ream. In addition, the State has jurisdiction on the A~dover St. and Waverly Rd. culverts and intend to review Flatley~s drainage figures. Mr. Chepuli-s requested a document be su~tted .to reflect 'the numbers stated. It was agreed to do so. Dec. 6, 1976 cont. Mr. 0yr, Highway ~u-veyor, thought that all drainage would Be to St. used for Peak timesi if the .Town had obtained easements 10 to 15 years ago we wouldn't have had these drainage easements blocked; felt too much emphasis was Being placed on the 36" culvert and suggested that the drainage system be tied in with the system on Rte. AlfredAdam, Hammond residence, asked if there would be access to the drain in,he ease- ment -Mr. ~elinas stated that the pip, will be covered and th,few ill be a catch basin. There will be a manhold structure at the intersection of Andover St. Mr. Willis stated that after digging it will be ~estored to its~original state. Mr. Chepulis a~ked how much the land will be cleared - Mr. Willis said they will try to maintain the woods as much as possible and clear just the street areas. Mr. Ohepulis then asked what .could be done by the BOARD or the Town if the drainage system didntt work - Mr. Willis answered that Mr. Gel;nas is a qualified engineer with integrity who has applied all the knowledge at hand and with these facts it should work; it is not to our advantage if it doesn'~ work. Mr. Gelinas added that they dc need State approval to enter its drainage ways, the DPW is not going to allow their systems to be overworked and the Con. Com. has restrictions so alot o£ professional scrutiny is go&rig to go into these plans. The subject of some residents cellar drains Being hooked up into street drains was brought up by Mr. Cyr who felt that the BPW is going ~o take measures to prevent cellar drainage from going into the sewers. ' Letters from the Highway Surveyor, Board of Public Works and Conservation Commission were read, Mr. Monteiro made a motion to take the matter under advisement and place it on the Jan. 3, 1977 Agenda. Mr. Saleratus seconded and the vote was unanimous. PLANS NOT RE~d~RIN~ APPROVAL: 1. aEORGE 30~ - Lacy St.: Plan of land in North Andover for Daniel E. Hogan dated Nov. 1976 showing a 20 ft. drainage easement on the brook and Lots ~-~2 with frontage on Lacy S~. Also Lots A, ~, & O shown. The Highway Surveyor said that he plows only as far as Whippoorwill Farm and this particular piece of road is exactly the same status as Chestnut St. was up until this year. A motion was made by Mr. Lamprey to table the matter until we review it with Town Counsel and have the subdivision control subcom- mittee view the site. Mr. Salemme seconded and the vote was unanimous. ' The BOARD agreed to meet on N~nday, Dec. 13, 1976 in the Meeting Room at 7:30 P.]~. ANDREW CIRCLE: AttY. Maurice Schwartz was present for Mr. Sorbo. Letter from the Highway Dept. dated Dec. 6 was read. Mr. Non%,irc made a motion to release all but $1,000 - $14,000 was released. This was changed so that upon receipt of security in the amount of a $1,000 bank passbook the BOARD would release the $15,000 bond. The chairman was so authorized to sign the form when completed. Mr. 3alemme seconded and the vote was ~i~OUS. MRS. NARY ARMITA~E: ~or 3~years I have been trying ba~dto preserve the ponds of Appledore. I am interested in their preservation and am here to make one more try. Referred to Appledore Notice of Intent in which it states "recreation areas" and asked for fulfillment of this by the Appledore people. ~mitted Article for the Town Warrant for protection of ail tributaries to the Town water supply (see Planning Board copy). Hr. Monteiro suggested that the BOARD accept the Article and request Town Counsel to review it and that the Chairman send a letter to Appledore principles andMr. Lev;ne regarding a Conservation Restriction. Hr. Ostherr then suggested inviting Mr. ]~tem and Hr. Lev;ne to the Jan,,-~y meeting regarding this matter and the membership agreed. Dec. 6, 1976 cont. Letter from Board of Selectmen: d~%ed Dec. 6, 197~; Re Northeast Solid Waste site loca- %ion requesting support from the Pla-~ing Board on their proposal. Nr. Cyr said he would give the BOARD a list of the ~criteria for the location and th&t N. A. hms every- thing but access. A motion was m~de by Nr. Nonteiro that the PLANNING BOARD support the endeavor of the Selectmen and other departments in ~cquiring this site for the structure in the To~n of North Andover. Nr, Chepulis seconded.. A short discussion was held regarding the proximity of the airport (no problem per FAA). Nr. Lamprey felt that we m~y have trouble getting the required number of Towns to paa'tictpate; Nr. Salemme also had reservations. The vote on the motion was unanimous. The Chairman was authorized to reply to the Board of Selec~en. P~C~ESSI0~AL PE~S~: Mr. Salemme submitted an outline with a suggested pay scale and asked the Board to note GE 8 or 9. Input was requested for the next meeting. PLANS NOT RE~IRINO APPROVAL - oont.: 2. G~F~T PO~D W0~DtAW~D: perimeter plan of land; parcel has to go to land cour~ because the title is in question; requires PLA~NIN~ BO~D signature for land court, acceptance. It is an already approved subdivision. Mr. ~elinas, engineer, to put note on the lot that it is par~ of a subdivision plan for land court only. The meeting adjourned at 12 midnight.
