HomeMy WebLinkAbout2017-04-24 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES April 24, 2017 CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:00PM in the Town Hall Meeting Room. The meeting was recorded. ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile, Licensing Commissioner, Phil DeCologero, Regina Kean, Chris Nobile, Town Manager Andrew Maylor, Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. Approximately 10 members of the public were in attendance. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Phil DeCologero made a MOTION, seconded by Chris Nobile, to approve the Open Session Minutes of April 10, 2017. Vote approved 5-0. COMMUNICATIONS AND ANNOUNCEMENTS: Certificate of Achievement for Excellence in Financial Reporting for FY16 The Certificate of Achievement for Excellence in Financial Reporting for FY16 has been awarded to the Town of North Andover by the Government Finance Officers Association (GFOA) for its Comprehensive th Annual Financial Report. This is the 5 year in a row the Town has received this certificate. Rick Gorman, Director of Youth and Recreation Services, provided the Board with a copy of the schedule for the summer band concer Grants-Electric vehicle and charging station and streetlight LED retrofit The Town has received confirmation of grants in the amount of $15,000 to be used towards the purchase of an electric vehicle and charging station and $100,087.95 for retrofitting our streetlights with LED lighting. The Board will accept the grants at the next meeting. Other communications and announcements th May 18 from 5-9PM. th Phil DeCologero reminded residents that the town wide Earth Day cleanup is on April 30. Chairman Vaillancourt stated that the 2016 Water Quality Report is online. PUBLIC HEARING: National Grid and Verizon New England Joint Pole Petition-Phillips Court Rosemary Smedile made a MOTION, seconded by Phil DeCologero to open the public hearing to receive comments on proposed National Grid and Verizon New England Joint Pole Petition for Phillips Court. Vote approved 5-0. Paulo Saffler from National Grid was present to answer any questions regarding the petition. A resident requested the pole be moved because the current one sits in front of their new driveway. Ms. Smedile indicated that she will not support any future pole petitions until the double poles are removed or the Board is at least provided with a time certain for their removal. Rosemary Smedile made a MOTION seconded by Phil DeCologero to close the public hearing to receive comments on proposed National Grid and Verizon New England Joint Pole Petition for Phillips Court. Vote approved 5-0. Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen approve National Grid and Verizon New England Joint Pole Petition #23639542-Phillips Court as presented. Vote approved 5-0. Board of Selectmen Minutes April 24, 2017 2 CONSENT ITEMS: Stevens Pond update and 2017 fees Rick Gorman, Director of Youth & Recreation Services, was present to give the Board an update regarding Stevens Pond. Mr. Gorman recommends no change in the fees for 2017. Rosemary Smedile made a MOTION, seconded by Phil DeCologero to make the Stevens Pond fees for 2017 the same as the 2016 fees. Vote approved 5-0. Request of Eric Kfoury to waive permit fees for the installation of the tent at the Stevens Estate The Board was given a memorandum from Eric Kfoury, Director of Community and Economic Development, requesting permit fees be waived for the installation of the tent and dance floor at Stevens Estate. Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen waive all permit fees for the installation of the tent and dance floor at the Stevens Estate. Vote approved 5-0. Patriotic Observance Committee requests permission to hold the annual Memorial Day parade and ceremony on Monday, May 29, 2017 starting at 10:00AM Rosemary Smedile from the Patriotic Observance Committee explained the request to hold the annual Memorial Day Parade on Monday, May 29, 2017 starting at 10:00AM. All relevant departments have reviewed the request and have no issues. Phil DeCologero made a MOTION, seconded by Regina Kean that the Board of Selectmen approve the request of the Patriotic Observance Committee to hold the annual Memorial Day Parade on Monday, May 29, 2017 starting at 10:00AM. Vote approved 5-0. Columbia Gas of Massachusetts requests permission to excavate on Maple Avenue, Stonington Street, and Dudley Street for the purpose of replacing its gas mains Included in the packet was a request from Columbia Gas of Massachusetts to excavate on Maple Avenue, Stonington Street and Dudley Street for the purpose of replacing its gas mains. All relevant departments have reviewed and have no issues. Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen approve the request of Columbia Gas of Massachusetts to excavate Maple Avenue, Stonington Street and Dudley Street, as presented, for the purpose of replacing its gas mains. Vote approved 5-0. Donations: Accept donation in the amount of $450.81 from Knights of Columbus to the Police Department for Project Life Saver The Knights of Columbus has donated $450.81 to the Police Department to be used for Project Lifesaver for the purchase of a transmitter kit and supplies for Rory Callahan. Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen accept the donation from the Knights of Columbus to be used to purchase a transmitter kit and supplies for Rory Callahan as part of Project Lifesaver. Vote approved 5-0. Accept donation of a Butcher Boy gift card in the amount of $350.00 from Robert Daigle to the Fire Department Rosemary Smedile made a MOTION, seconded by Regina Kean that the Board of Selectmen accept the donation of a Butcher Boy gift card in the amount of $350.00 from Robert Daigle to the Fire Department to be used for food and kitchen supplies. Vote approved 5-0. Vote maximum useful life of equipment-bond authorization The 2016 Annual Town Meeting approved the Capital Improvement Plan for Fiscal Year 2017. By statute, the Board is required to establish the maximum useful life of equipment bonded for a period of more than five years. Chris Nobile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen vote that the maximum useful life of the departmental equipment listed below to be financed with the proceeds of the $633,197 borrowing authorized by the vote of the Town passed May 10, 2016 (Article 24, Lines 8, 10 & 15) is hereby determined pursuant to G.L. c.44, §7(1) to be as follows: Purpose Borrowing Amount Maximum Useful Life Ambulance $268,197 10 Years Equipment Sweeper $185,000 10 Years 6 Wheel Dump Truck $180,000 5 Years Board of Selectmen Minutes April 24, 2017 3 Vote approved 5-0. Request from The Cork Stop Inc. for change of license from wine and malt to all alcohol Attorney Brian Vaughn presented information regarding the request. Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen, acting as Licensing Commissioners, approve the request of the Cork Stop Inc. for a change of license from wine and malt to all alcohol, as presented. Vote approved 5-0. Events at Smolak Farms: Request of Katherine Bagshaw for a one day wine and malt license for a fundraiser on Sunday, May 7, 2017 from 5:00PM -8:00PM Request of Jennifer Kim for a one day all alcohol license for a wedding on Saturday, May 20, 2017 from 4:30PM-9:30PM Request of Olga Levantosky for a one day wine and malt license for a graduation party on Sunday, May 21, 2017 from 3:30PM-8:00PM Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen, acting as Licensing Commissioners, approve the requests for a one day licenses for events at Smolak Farms, as presented. Vote approved 5-0. Request of Dolly Miller to renew the Fortune Teller License for Psychic Readings, 163 Turnpike Street Dolly Miller was present to answer any questions from the Board. Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Dolly Miller to renew the fortune teller license for Psychic Readings, 163 Turnpike Street. Vote approved 5-0. Chris Nobile made a MOTION, seconded by Rosemary Smedile to close a meeting of the North Andover Licensing Commission. Vote approved 5-0. OLD BUSINESS: None NEW BUSINESS: None PUBLIC COMMENT: None Departmental Monthly Reports Included in the packets were the monthly reports for the Fire Department, Opiate Overdoses, Police Department, Job posting/vacancy log, Capital Projects, Legal, Library, Senior Center, Report It and Building Department. Ask the Manager Regina Kean asked about the trash and recycling contracts. The Town Manager explained beginning in August, trash will be handled by a new contractor and recycling will continue to be picked up by Northside Carting. COMMUNICATIONS AND ANNOUNCEMENTS: Recognition- Jennifer Hughes, Environmental Service Award as Conservation Commissioner and Administrator of the Year The Board recognized Conservation Administrator, Jennifer Hughes, for being awarded Conservation Administrator of the Year. Other announcements th Chairman Vaillancourt announced the dates for household hazardous waste day, the 5 grade service project and the Cyr Recycling Center opening. Mr. Vaillancourt also explained mailers residents will be receiving regarding the textile recycling program. Citizen Petitions Article 6-Petition the General Court-Age Exemption-Nicholas L. Martone-Firefighter Nicholas Martone, age 36, explained his petition for an age exemption. Article 7-Petition the General Court-Age Exemption-J. Adam Stagno-Police Officer Jay Stagno, age 35, explained his petition for an age exemption. Article 8-- - questioned if the act was presented in its entirety in the petition. Article 9-Amend Zoning Bylaw-Section 8: Medical Marijuana Treatment Facilities Article 10- Authorization of the Town Manager and Board of Selectmen to negotiate and execute Host Community Agreement with Proposed Medical Marijuana Cultivation Facility Article 11-Amendment to the Zoning Map to Include Expanded Medical Marijuana Overlay District Tom Lee and Dan Leary presented the three citizen petitions regarding Osgood Landing and a medical marijuana facility. Suzanne Egan, Town Counsel, explained that approved medical marijuana facilities will be first in line to get license for recreational cultivation. Additionally, any moratorium will not apply to medical marijuana. In response to a question from the Board about the amount of town water that will be used at the facility, Mr. Lee indicated that the site will have a rainwater collection system and has wells that can generate 450,000 gallons per hour so the only use of town water would be the standard uses in any commercial building (toilets, sinks, etc.). FY18 Community Preservation Committee recommendations John Simons, chair of the Community Preservation Committee presented the recommendations of the Community Preservation Committee. CONSENT ITEMS: Request of the Festival Committee to use the town common on Sunday, May 21, 2017 from 6:00AM to 6:00PM for the Annual Sheep Shearing Festival, close Massachusetts Avenue and Academy Road from Osgood Street to Academy Road and waive all permit fees Jeff Coco, Chair of the Festival Committee, presented his request to the Board. Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen approve the request of the Festival Committee to use the Town Common for the Annual Sheep Shearing Festival on May 21, 2017 from 6:00AM to 6:00PM, to close Massachusetts Avenue from Osgood Street to Academy Road to traffic from 7:00AM to 6:00PM and to waive all permit fees. Board of Selectmen Minutes April 10, 2017 2 Request of North Parish of North Andover to use the Town Common on Sunday, April 30, 2017 for an Immigrant Pride Rally Deb Olander of North Parish Church presented the request. Phil DeCologero made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen approve the request of North Parish of North Andover to use the Town Common on Sunday, April 30, 2017 for an Immigrant Pride Rally, provided participants use only the grass area and not the sidewalks and park at the North Parish church. Vote approved 5-0. Columbia Gas of Massachusetts requests permission to excavate on Patriot Street from Waverly Road to Vinnie Luciano from Columbia Gas was present to answer any questions. Vote approved 5-0. Appointment of Anna Choi to the Cultural Council The appointment subcommittee recommended Anna Choi be appointed to the Cultural Council. Rosemary Smedile made a MOTION seconded by Chris Nobile that the Board of Selectmen appoint Anna Choi to the Cultural Council for a term ending June 30, 2019. Vote approved 5-0. Request of Eric Kfoury to waive building permit fees for bathroom renovations at the Stevens Estate Rosemary Smedile made a MOTION, seconded by Phil DeCologero, that the Board of Selectmen approve the request of Eric Kfoury, to waive all permit fees associated with the bathroom renovations at the Stevens Estate. Vote approved 5-0. Vote to approve transfer from Special Education Stabilization Fund The School Department is requesting a transfer of $200,000 from the Special Education Stabilization Fund to the FY17 General Budget. Finance Committee and School Committee all must vote to approve the transfer. At their last meeting, the School Committee voted in favor of the transfer. Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen approve the transfer of $200,000 from the Special Education Stabilization Fund to the FY17 School . Ask the Manager Mr. DeCologero asked about the intersection of Route 495 and Massachusetts Avenue having gateway signage. The Town Manager is working with DPW on a sign. Mr. DeCologero requested clarification on leaf pick up. Ms. Smedile indicated that neighbors in the library area are not happy about all the double poles. The Town Manager explained that the Town has made many attempts to compel the utility company to remove the double poles; however there is currently no way to enforce compliance.
