HomeMy WebLinkAbout2017-06-19 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES June 19, 2017 CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:OOPM in the Town Hall Meeting Room. The meeting was recorded. ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile, Licensing Commissioner, Phil DeCologero, Regina Kean, Chris Nobile, Town Manager Andrew Maylor and Assistant Town Manager Ray Santilli. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Rosemary Smedile made a MOTION, seconded by Phil DeCologero, to approve the Open Session Minutes of June 5, 2017 as presented. Vote approved 5-0. COMMUNICATIONS AND ANNOUNCEMENTS: Textile Recycling Update The Town Manager gave an update of the Simply Recycling program. During the month of May, a total of 8,576 pounds of textiles were collected resulting in a payment to the Town of$85.76. Update from Conservation Commission This matter was tabled. Other Communications and Announcements Rosemary Smedile indicated that she and Regina Kean attended the Smolak Farm 90th anniversary event. Phil DeCologero announced that the Farmers Market starts on Sunday and will run through October 8th Town Manager, Andrew Maylor, stated he attended the "Wall that Heals" ceremony in Haverhill. Update from Zoning Board of Appeals Albert Manzi, Zoning Board Chair, gave the annual update from the Zoning Board of Appeals. CONSENT ITEMS: Request of Festival Committee to use the Town Common from 7:OOam on July 3, 2017 through 11:00pm on July 4, 2017, to close Massachusetts Avenue from Osgood Street to Academy Road on July 3, 2017 from 5:OOpm to 10:00pm and July 4, 2017 from 6:OOam to 5:OOpm for the Annual 4th of July Celebration, and to waive all municipal fees for the event Jeff Coco of the Festival Committee was present to request the use the Town Common for the Annual 4th of July Celebration from 7:OOam on July 3rd through 11:00pm on July 4th, to close Mass Avenue from Osgood Street to Academy Road on July 3rd from 5:OOpm to 10:00pm and July 4th from 6:OOam to 5:OOpm, and to waive all fees for the event. All relevant municipal departments reviewed the request. The Fire Department will be conducting the appropriate safety checks of food vendors prior to the start of the event. Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen approve the request of the Festival Committee to use the Town Common for the Annual 4th of July Celebration from 7:OOam on July 3, 2017 through 11:00pm on July 4, 2017, to close Massachusetts Avenue from Osgood Street to Academy Road on July 3, 2017 from 5:OOpm to 10:OOpm and July 4, 2017 from 6:OOam to 5:OOpm, and to waive all municipal fees for the event. Vote approved 5-0. Accept donations for 2017 Summer Event Series The Youth and Recreation Services Department received the following donations to be used towards the Sunday Concerts on the Common and the weekly Children Shows: Trombly Brothers, Inc- $50, M.P. Roberts Insurance Agency-$200, Wheelabrator Technologies -$2,000, and St. Michael Parish - $500. Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen accept the following donations for the 2017 Summer Event Series: Trombly Brothers, Inc -$50, M.P. Board of Selectmen Minutes June 19, 2017 2 Appointments Included in the packet is a list of re-appointments and appointments by the Board of Selectmen to various Boards and Commissions that will be effective July 1, 2017. Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen approve the re-appointments and appointments to various Boards and Commissions, as listed, effective July 1, 2017. Vote approved 5-0. The Board was asked to re-appoint the firms of Kopelman & Paige, P.C. and Collins, Loughran & Peloquin as `Special Counsel'. Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen approve the appointment of the firm of Kopelman & Paige, P.C. as Special Counsel through June 30, 2018. Vote approved 5-0. Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen approve the appointment of the firm of Collins, Loughran & Peloquin as Special Counsel through June 30, 2018. Vote approved 5-0. Per Town Charter, the Board must approve the Town Manager's appointments to the Board of Assessors. Rosemary Smedile made a MOTION seconded by Phil DeCologero that the Board of Selectmen accept the Town Manager's appointments to the Board of Assessors. Vote approved 5-0. LICENSING COMMISSIONERS: Rosemary Smedile made a MOTION, seconded by Phil DeCologero, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Vote approved 5-0. Request from Jamie Green Klopotoski of Ipswich Ale Brewery for one day wine and malt license for 4th of July festivities on the Town Common on Monday, July 3, 2017 from 5:00pm-11:00pm and Tuesday, July 4, 2017 from 10:00am-4:00pm Jeff Coco of the Festival Committee and Chris Marshall of the Borderline Running Club presented the request. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Jamie Green Klopotoski of Ipswich Ale Brewery for one day wine and malt licenses, for 41h of July festivities on the Town Common on Monday, July 3, 2017 from 5:00pm-11:00pm and Tuesday, July 4, 2017 from 10:00am- 4:00pm, subject to same conditions set forth in prior years. Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt to close a meeting of the North Andover Licensing Commission. Vote approved 5-0. OLD BUSINESS: None NEW BUSINESS: None BOARD REORGANIZATION: Nomination and vote for Officers (Chair and Clerk) Regina Kean made a MOTION, seconded by Chris Nobile that Phil DeCologero serve as Chairman of the Board of Selectmen. Vote approved 4-1. Rosemary Smedile opposed. Phil DeCologero made a MOTION seconded by Rosemary Smedile that Regina Kean serve as Clerk of the Board of Selectmen. Vote approved 5-0. Nomination and vote for Licensing Chair Rosemary Smedile made a MOTION seconded by Chris Nobile that Richard Vaillancourt serve as Chairman of the Licensing Board. Vote approved 5-0. Nomination and vote for Appointment Subcommittee Phil DeCologero made a MOTION, seconded by Rosemary Smedile that Chris Nobile serve on the Appointment Subcommittee. Vote approved 5-0. Phil DeColgoero made a MOTION, seconded by Rosemary Smedile that Regina Kean serve on the Appointment Subcommittee. Vote approved 5-0. PUBLIC COMMENT(taken out of order): Donald Stewart of Prospect Street thanked Mr. Vaillancourt for his great job as chair and Ms. Smedile for her service on the Appointment Subcommittee. Mr. Stewart also stated to Mr. DeCologero that serving as chair in an election year is unprecedented and shouldn't be done. Mr. Vaillancourt stated that he served as chair in his election year of 2014-2015. TOWN MANAGER'S REPORT: Stevens Estate and OPEB committees Town Manager, Andrew Maylor, reviewed the memorandum in the packets regarding possible initiatives in the future relating to the Stevens Estate and OPEB. The Board will discuss both issues at a future meeting. Monthly Reports Included in the packets were the departmental monthly reports. The Board discussed in depth the legal report, the building department report, and the IT report. Chairman Vaillancourt announced that the Town's new website will be live on July 26tH Ask the Manager Phil DeCologero asked for an update on the old Bradstreet School property. The Town Manager indicated that they are close to getting and occupancy permit and are pursuing tenants. The IT grant will be used to scan documents to Laserfiche and the disability,grant will be used to Inatall automatic door openers at the rear entrance of town hall. Vote to accept revised Alcoholic Beverages Regulations Town Counsel, Suzanne Egan, summarized the proposed changes to the Alcoholic Beverages Regulations first presented at the meeting on May 8, 2017. The Board discussed changes and asked Attorney Egan to review the changes and provide feedback by the next meeting. The Board took no action on the item. If a licensee is charged with permitting the service, delivery, or possession of alcoholic beverages by a person under twenty one years of age, under current state law, a licensee has a defense only if the licensee can affirmatively prove that prior to permitting the service, delivery or possession of alcoholic beverages by a person,the licensee requested,was shown,examined and reasonably relied on either: 1.A Massachusetts Driver's License; 2.A Massachusetts Liquor Identification Card; 3.A Massachusetts Identification Card; 4.A Passport Issued by the United States or a government that is officially recognized by the United States; 5.A Passport Card for a Passport issued by the United States; and 6.A Military Identification Card. Reliance by a licensee on any other form of identification to determine proof of age does not give the licensee a defense. Each licensee is left to decide for itself what policy to establish on checking identification prior accepting orders for, selling and delivering alcoholic beverages. Some licensees adopt a conservative policy, as they may legally do under the Liquor Control Act and the ABCC regulations, and require proof of age from any person who appears to be younger than thirty years of age and accept as proof of age only the six pieces of identification that give a licensee a defense to any criminal conviction, civil liability and/or administrative prosecution. Therefore, while a licensee may choose to rely upon any form of identification to obtain proof of age, only these specific six forms of identification provide a defense to a charge of service,delivery, or possession of alcoholic beverages by a person under twenty-one years of age. 31. If a patron is not driving,does it matter how many drinks s/he is served? Yes- Massachusetts state law prohibits the service of alcoholic beverages to an intoxicated patron. It is still a violation to serve to an intoxicated person even if person is not driving. In fact, 12-20%of alcohol-related accidents involve pedestrians. 32. These spirit tastings can only be held at premises licensed under Section 15 ("package stores") or restaurants, hotels or function halls licensed under Section 12. Re: Looking Beyond The Next 12 Months r With Town Meeting in the rear view mirror i wanted to start a conversation with the Board about possible initiatives for the period beginning in late calendar 2818 through calendar 2019. Stevens Estate More than two decades ago,Town Meeting authorized the purchase of the Stevens Estate and 150+ acres of open space adjoining the estate known as Osgood Full.At the time the selectmen charged a committee with providing recommendations about the use/re-use of the estate and the surrounding property.That committee was constituted and given twelve months to complete its work.Today that committee still exists (with mostly different members), has never provided a report or recommendations regarding the options available to the town, and has morphed into an advisory group regarding the maintenance and operation of the actual Estate where the functions are held.With the bonds for the purchase of the entire estate and open space ($5,000,000 was borrowed in the 1990''s) due to be paid off,the open space not currently protected from development, and the town facing major costs to renovate or maintain the carriage house and gate house, it seems like the original charge of that committee should be carried out soon.This time however, I would recommend a committee of five or so led by a member of the Board of Selectmen and the Director of Community and Economic Development. The goal would be to recommend back to the full Board options that would result in a plan for the future of the property and action items to deliver on that plan. 4PYEB We have made substantial strides from a financial perspective during the past several years. Although l am confident that if we remain on the current course we can continue to accomplish wonderful things for years to come,the cost of employee benefits and retiree health insurance will remain a regular challenge.Specifically, Other Post Employee Benefits (OPER),the liability associated with town funded health insurance for retirees, represents a real risk to our financial future.The Finance Committee recently recommended a committee be formed to explore ways to address the funding of the OPEB liability and/or ways to reduce that liability.Again, I recommend that the Selectmen take the lead and form a committee which would include a selectman,the Finance Director, and a member of the Finance Committee amongst others.This committee would be charged with providing recommendations back to the Board on components of a plan to mitigate and fund the OPEB liability. Support Town Counsel and I would provide regular support and assistance to both of these committees if they are formed and I would commit the necessary resources to staff the committees to make sure that minutes were taken and agendas posted. i Next Steps If you agree with these recommendations you may want to add them as discussion topics at are our strategic planning meeting in September or place them on a future selectmen's meeting agenda for further discussion. All 36 public library members of the Merrimack Valley Library Consortium (MVLQ were upgraded on the same day. Although there were 4 days of limited services to our patrons (a required step of all 36 libraries), early notification and town-wide publicity helped prepare our patrons. The migration went well; patrons are finding the new Online Catalog intuitive and based on feedback we received, it was a relatively easy migration for theta. Like any migration to new software,the staff-level implementation identified some unexpected results,. The MVLC Helpdesk is doing; a great job addressing any issues we have and anticipating adjustments before they become an issue. The end result was an effort of cooperation and support that ultimately kept issues behind the scenes from impacting our patrons, The Friends of the Stevens Library held their Spring Book Sale in May and it was a success. Funds earned at the Spring; and Fall. Book Sales fund our wide selection of discounted Museum Passes available to Stevens' patrons. These funds also support all our great Sunnneri at the Stevens programs, for all ages. Sudden cardiac arrest usually results froze an electrical disturbance in your heart that disrupts its pumping action,stopping blood flow to the rest of your body. These patients are provided resuscitation efforts with cardiopulmonary resuscitation, airway management and automatic external defibrillator. Cocaine. is a strong stimulant mostly used as a recreational drug. Cocaine has powerful negative effects on the heart and brain. Occasional users run the risk of sudden death with cocaine use. Cocaine use is bad for the heart. Cocaine:increases heart rate and blood pressure while constricting the arteries supplying blood to the heart. The result interrupts blood flow to the heart muscle itself, which can cause a heart attack even in young people without heart disease. Dead on Arrival(DOA): Is a term used to indicate that a patient was found to be already clinically dead upon the arrival of professional medical assistance. Examples of Dead on Arrival according to the Massachusetts Department of Public Health are as follows; Date of Service(DOS): The date in which the fire department responded to a call for assistance. Fentanyl:Is a potent, synthetic opioid analgesic with a rapid onset and short duration of action. Opiate: Opiates are a group of drugs that are used.for treating pain. They are derived from opium which comes from the poppy plant. Opiates go by a variety of names including opiates, opioids, and narcotics. The term opiates is sometimes used for close relatives of opium such as codeine, morphine and heroin,while the term opioids is used for the entire class of drugs including synthetic opiates such as Oxycontin. Some of the more common opiates are Codeine, Vicodin, Hycodan, Morphine, Oxycontin,Percoset,Dilaudid, and Fentanyl. Polysubstanee Overdose: A polysubstance overdose is when a person is in an intoxicated state without a preference for one particular substance as several substances have been mixed together. Although any combination of three drugs can be used,more likely alcohol is commonly used with other substances such as cocaine and heroin. In the substance abuse context, it usually refers to the use of multiple illicit drugs, however, it can also apply to prescription medications used for nonmedical purposes.
