Regular Nesting
The PLAI~NINa ~OARD held a regular monthly meeting on Nond~y evening, May 16, 1977
at 7:30 P.N. in the Town Office Nesting Roo~. The following members were present and
voting: Paul R. Lamprey, Chairman; William No Salsmme, Vice-Chairman; William Chepulis;
and~ohn J. ~onteiro.
There were 12 visitors present.
PUBLIC t~ARi~a: PADDOCER~TATES (Scott Properties) - the legal notice was read by
Member Chepulis; F. Salines represented the developer; S. Follansbee was present; Mr.
Gelinas stated that it is a 12 lot subdivision; 18 acres located across the street from
Willow Ridge; serviced by drainage, no co~z~mal water or sewer; the character of the
site is gentle, topography is 10 ft. difference from Boston St. to center of subdivision
and dow~ againl two minor intermittent streams; on watershed of Song River; drainage is
Basically at intersection of Bosto~ ~t. & Paddock Lane, 2 catch Basins; the predominant
amount of water flows through the 30" culvert at lot #1; there is no practical place to
install a dryhydrant with impoundment areal all lots have 150 ~t. frontage and conform
to the ZBL.
Mr. Monteiro stated that with no water provided at all then construction would be a fire
hazard, a great distance from the fire station and felt that the Town is beoo~inga
"Fire ~ox". However, the density is good. Mr. Chepulis cited that Willow Ridge is a
similar situation. Bud C~r sa~d that water is available about 400-~OOft. up the street.
Water could be arranged from Andover, also. Mr. ~elinas interjected that the Town can
.alwa~s~e arrangements to purchase water from an adjacent town but it would~e a
sensitive arrangement for a private developer to make because it becomes political.
~cott Follansbee added that there is a subdivision going in just over the Andover line
that will Bring ~h~rant as close as Jenkins Rd. and there is water at the intersection
of Boston & ~ra~ ~ts. l~ra~k~elinas thought it would benefit Andover to sell us the
water ~ecause their oapasity is way beyond their needs. Ch~lie Foster suggested that
the PI~gh~!q~ ~ get together with the.BPW.~ Mr. Monteiro asked if the developer would
be willing to give an easement -Oelinas. I think our o~n BP~has reservations about
servicing this pam't of Town, there are all kinds of things that have to be resolved.
~uce Horton, 8 Olympic ~y, Andover: brought up the question of drainage near the
proposed road, pond on lst~ drains towam~ithe cul de a~c, it ie dugout right now.
Mr. Cyrrecommended that on any drainage problems that occur during construction of the
road or lots they shall be incorporated into the street drainage system and easements
provided for such. ~his shall be a condition of approval if approved.
Mr. ~elinas was asked if the ponds would be destroyed during building - these c_.~n~ot be
tampered with wi~hout going through the Wetlands Act.
Letters' from Highway, Fire and BPW were read by the 0hairman. Mr. ~elinas told the
members that there are 3 separate ~eeds to the proper~y, Scott Properties owns most of
the land with E & F B~ilders o~ning a small portion. Mr. Ohepulis suggested that the
drainage easement on lot ~5 should be carried through to the lot line and would like to
have the BOARD consider the retention of certain trees if approved. Motion was m~de by
Mr. Monteiro and seconded by Mr. Ohepulis to take the matter under advisement. Vote~
~~I~NE~ Mr. La~preyreiterated that on Dec. 20th the ]~l~J~Dunanimously voted
revokation of the subdivision called ~alem Forest. Read from list of conditions that
had to be corrected in a letter to Mr. Fart. !B~sically, wh~t was found when the site

was walked was that the spillway is still 3-~ ft. below She old culverti~level, the
sea,low isstill being drained oonstantly...it is mar~ed at 1120 but there is a devia-
tion somewhere. The spillway is not aS the elevation it should be and it is drain-
ing the wetland Shat w~a intended to be kept. The BOARD requested certification of
the accuracy of. 1120. Mr, Saleratus requested input as So how much work had been done
since PLANNING BOARD withdrawal of approval - Mr. Cyr amid probably 2/~ of'the ditch
is completed plus a little ledge So be taken away.
Atty. Philip Arsen&ult, representing G. Farr, stated that #3 in our letter had Been
done except as So the qlAeation of accuracy in the elevation. Gelinas confirmed Shat
a certification of this would be forthcoming. Mr. Arsenault suggested that Mr. Parr
was working and trying to cooperate to meet She conditions set by She BOARD, he sub-
stantially complies with all the conditions and will the subdivision be reinstated
if Mr. ~elinas certifies the elevation at 112°? Mr, Lamprey answered Shat She BOARD
wants to see She elevation of that spillway aS She bottom of She stone culvert.
Mr. George Schruender said he understood that all things were being taken care of and
Shat lots could be released. Mr. ~_amprey Sold him that it is still a great concern
inasmuch as it is no different than when it was walked in Jan,,~y. Mr. Chepulis asked
for verification of the 30" and 12" culvert elevation with back-up data. After. more
discussion Mr. MonSeiro made a motion So table the master until Wed. nighs meeting
upon receipt of the data. Mr. Roberts seconded and the vote was unanimous.
GEORGE PAI~: EARTH R]~OVAL - letter read from Board of Appeals; Mr. Parr stated Shat
he had not removed anything from She site but should probably apply for a permit if
I do wans So remove some.
Letter: E. SzSuoinski Re ~toneolemve Estates - letter read by the Chairman re water
supply. Mr. Barbagallo would assure him that no trucks will pass over that road nor
will construction take place on the road. Frank Gelinas brought up Blake Adams' land
and felt that he would never agree So not using this road. Mr. Chepulis felt that
Blake would be free to use iS bus want to assure Mr. Sztucinski that this is not par~
of the subdivision. Barbagallo does no% have easement rights to give to anyone for
use of that road (loSs ~-16 do not have cross easement rights).
JOHNSON CIRCLE -John Willis, Sr. said he spelled out in detail in his letter the
chronology of the development and reiterated same to the BOARD. He also had presented
an ~impaoS study and had been in contact with Reno Construction. Mr. Chepulis asked
if the electric services boxes been corrected yes - Willis thought that the problem
did not exist any more and added because of the widening of the pavement, the hydrants
are too close to She pavement. A good portion of the problem ia m result of the re-
location of these hydrants which the ~ did. Essentially everything that has to be
done is all part and parcel of the finished road job. As of 1~75 it would cost $3,700
and as of 3 weeks ago it would oos~ $11,000. Mr. Cyr stated %has rather th~n get m
separate contractor to do the work we thought it would be better to pus the money into
the total road. Mr. Willis had agreed to Shat but found out Shat the bonding company
won't allow it.
Items remaining to be done: sewerage, gravel, basins on road, level, grading to
Johnson ~t. Mr. Willis suggested that Mr. Cyr, She BPW and himself aught to sis down
and figure out what to do, then it would be a master for She client to decide. Mr.
Willis noted that we need releases from the bonding company, should have a meeting with
Borgesi, client, bonding oompan~ and Cyr. Mr. Willis %o report back when the massing
has taken place so that we can pursue our portion of the road, catch basins repair.

Easement was extended on lots A & B back to She property line and those loss are shown
on the definitive plan such that these easements can be taken at the Sims of She

subdivisi~n. With respect to the dry hydrant, an actual h2~lrant will be put in place in
a different color to distinguish from regular hydrants; the water line will be ex~ended
to the p~nd off the property and N. A. Assoc. will give easement rights all the way to
Mosquito ~rook. He felt they had provided continuous drainage. Drainage computations
were su~nitted. Mr. Cyr okayed the continuous drainage as outlined by Mr. Gelinas.
J. Barl~gallo told the members that i~ would be serviced by artesian wells, 2 gal, per
minute. Mr. Chepulis h_~i reservations with the road following the swale, might cause
problems with drainge. Mr. ~elinas stated that the BPW is satisfied with the standard
he had come up with and the fire chief feels he has to go on record as being opposed
to any subdivision that is no~ serviced by communal water.
Motion and second made by Subdivision Control 3ubcommittee to approve the subdivision
with the usual standard conditions plus conditions imposed by,he Highway Surveyor and
changes requested by the Planning Board to the developer as confirmed in an amending
letter received from developer's representative, Mr. ~elinas. In a&iition, the plan
shall show abutting owners across the street from the development and areas on the defini-
tive plan shall be specified in square footage subject to verification of all pending
areas in the subdivision. ~he easement rights shall not be granted to lots 9-13 inclu-
sive. Mr. Lamprey brought out the fact that the Con. Com. would like land set aside for
public use. We have 3 years under ~he Rules & Regs. to decide to negotia%& for this land.
Gelinas said that before this is done so~e clarification of the law is needed because the
landowner has some rights. Vote: unanimous.

authorized to sign the Agreement from Equity Builders of N. A. upon recording of the
mortgage referred to in said document and specified in the appropriate spaces in said
document. This document is not to be signed until the PLANNING BOARD receives a Release
form covering this. Bo~h documents to be signed at the same time. Monteiro seconded and
