BOARD OF SELECTMEN MINUTES August 28, 2017
CALL TO ORDER: Chairman Phil DeCologero called the meeting to order at 7:00PM in the Town Hall
Meeting Room. The meeting was recorded.
ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Licensing
Chairman, Richard Vaillancourt, Rosemary Smedile, Chris Nobile, Town Manager Andrew Maylor and
Assistant Town Manager Ray Santilli.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
Regina Kean made a MOTION, seconded by Chris Nobile, to approve the Open Session Minutes of
August 14, 2017. Vote approved 5-0.
COMMUNICATIONS AND ANNOUNCEMENTS:
Update from Youth & Recreation Council
Youth & Recreation Council chairman, Kevin Driscoll, gave an update of what is happening on the Youth
and Recreation Council.
Election update
Town Clerk, Joyce Bradshaw, gave an update about the 2018 elections.
Other Communications and Announcements
Regina Kean described the process for selecting candidates for Boards and Committees.

CONSENT ITEMS:
Vote on letter in response to national events involving race
Included in the packet was a proposed letter regarding the national events involving race. Amy Mabley,
chair of the School Committee, who helped draft the letter along with Helen Pickard, indicated the School
Committee supports signing the letter. Mark DiSalvo, Town Moderator, spoke to express his support for
the letter.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen
approve the letter regarding national events involving race. Vote approved 5-0.
Accept donation in the amount of $5,000 from the Friends of the North Andover Senior Center for In
Control Driving course
The Friends of the North Andover Senior Center have generously agreed to donate $5,000 to pay for a
driving course for the seniors. Martha Kashins explained that the Borderline Running Club provided the

donation to the Friends from the proceeds of the 4 of July Road Race. Included in the packet was a
description of the course.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen
accept the donation of $5,000 to be used for the In Control driving course
citizens. Vote approved 5-0.
Vote to approve disbursement of $310,000 from the Affordable Housing Trust Fund to Bread & Roses
Housing, Inc. for the purchase of 51 May Street
The Affordable Housing Trust is once again partnering with Bread & Roses Housing, Inc. to purchase a
property to be renovated and sold as affordable housing. Included in the packet was the grant agreement
awarding $310,000 from the Affordable Housing Trust Fund to Bread & Roses Housing, Inc. for the
purpose of purchasing 51 May Street. Once the unit is sold to a qualified buyer, Bread & Roses will pay
back the trust $87,000, plus the difference between the anticipated expenses and the actual expenses.
Yesenia Gil, Executive Director of Bread & Roses Housing, Inc. was present to answer any questions.
Richard Vaillancourt made a MOTION, seconded by Regina Kean that the Board of Selectmen

authorize Town Manager, Andrew Maylor, to execute a Grant Agreement between the North
Andover Affordable Housing Trust Fund and Bread & Roses Housing, Inc., and approve
disbursement of funds from the Affordable Housing Trust Fund in the amount of $310,000.00 for
the acquisition of property located at 51 May Street, North Andover, MA. Vote approved 5-0.
Acceptance of Grant
The Board was asked to accept a technology grant from the Massachusetts Board of Library
Commissioners to the Stevens Memorial Library.
Richard Vaillancourt made a MOTION, seconded by Regina Kean that the Board of Selectmen
accept the grant from the Massachusetts Board of Library Commissioners in the amount of
$7,500. Vote approved 5-0.
Vote on recommendation of Appointment Subcommittee to repeal the Constitution and Bylaws of the
North Andover Patriotic Observance Committee and establish its mission (continued from 8/14/17)
This matter was continued from the last meeting in order to give the members of the Patriotic Observance
Committee time to review the documents. Dan Lanen, chairman of the Patriotic Observance Committee
spoke about the Committee concerns with repealing the Constitution and Bylaw. Ted Tripp of Boston
Street, former chair of the committee, spoke about the history of the document and his opinion on
membership. John Thompson, a member of the committee, spoke about membership.
Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen repeal the
Patriotic Observance Committee Constitution and Bylaws and replace them with a mission
Officer to promote responsible citizenship and patriotic values throughout the Community by
effectively planning and coordinating parades and ceremonies during public holidays and special
events. In doing so, committee members will thrive to educate and promote a public awareness of
the servic

Appointments
Patriotic Observance Committee
Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen re-appoint
all existing members of the Patriotic Observance Committee except Gerry Maguire, for a term
ending June 30, 2018 with the condition that the appointment subcommittee will work with
Patriotic Observance Committee chairman to define membership guidelines moving forward. Vote
approved. 4-0-1. Rosemary Smedile abstained.
Community Preservation Committee- William Callahan and Laurie Burzlaff
Chris Nobile made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen
appoint William Callahan to the Community Preservation Committee for a term ending June 30,
2020, contingent upon his resignation from the Finance Committee. Vote approved 5-0.

Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen appoint
Jonathan Hurtig to the Youth and Recreation Council for a term ending June 30, 2020.
Right of first refusal-0 Salem Street
Included the packet was
of first refusal for a property located at 0 Salem Street.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen decline the right of first refusal to purchase the property located at 0 Salem Street.

Vote to set date for 2018 Annual Town Meeting
The General Bylaws of the Town of North Andover, §59-
set the date of the Annual Town Meeting in accordance with Chapter 39, Section 9 of the Massachusetts
Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen set the date
of the 2018 Annual Town Meeting for Tuesday, May 15, 2018 at 7:00 p.m. Vote approved 5-0.
Vote to designate new voting equipment as required by Chapter 54, Section 34
Town Clerk, Joyce Bradshaw, provided an explanation for the need for the Board to vote on the voting
equipment.
Richard Vaillancourt made a MOTION, seconded by Regina Kean that the Board of Selectmen
with the Annual Town Election scheduled for March 27, 2018 and to discontinue the use of Accu-
vote voting machines. Vote approved 5-0.
LICENSING COMMISSIONERS:
Rosemary Smedile made a MOTION, seconded by Chris Nobile, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Paul Gallant of Merrimack College requests:
1. A one day wine and malt license for a health sciences grad event at Sakowich Campus Center Patio
on Thursday, August 31, 2017 from 3:30pm-7:00pm
2. A one day wine and malt license for an orientation family reception at Sanctuary Café & Patio on

acting as Licensing Commissioners, approve the three one day licenses for Merrimack College for

Request for change of Officers/Directors of the 99 Restaurant
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners, approve the change of Officers/Directors of the 99
Restaurant. Vote approved 5-0.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero to close a meeting of the North
Andover Licensing Commission. Vote approved 5-0.

Mr. Maylor reminded the Board that the Town will start using a new trash hauler, JRM, on September 1.
Mr. Maylor also informed the Board that in Acton, there is a lawsuit challenging CPC allocation of funds to
a historic church. Town Counsel is following the case as North Andover CPC funds have been allocated
to an historic church.

The Board discussed the textile recycling program.
Regina Kean praised the library for their summer programs and collaboration with the schools.

BOARD OF SELECTMEN MINUTES August 14, 2017
CALL TO ORDER: Chairman Phil DeCologero called the meeting to order at 7:00PM in the Town Hall
Meeting Room. The meeting was recorded.
ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Licensing
Chairman, Richard Vaillancourt, Rosemary Smedile, Chris Nobile, Town Manager Andrew Maylor,
Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. Approximately 12
members of the public were in attendance.

APPROVAL OF MINUTES:
Richard Vaillancourt made a MOTION, seconded by Regina Kean, to approve the Open Session
Minutes of July 18, 2017. Vote approved 5-0.
COMMUNICATIONS AND ANNOUNCEMENTS:
Recognition-Eagle Scout Project-Anuvind Iyer
Eagle Scout, Anuvind Iyer, was recognized for building a boardwalk/bog bridge at Mazurenko Farm.
Recognition-Youth and Recreation Department summer programs
Rick Gorman, Director of Youth and Recreation Services, and members of his staff were recognized for
their outstanding summer programs.
Application Seminars for 70 May Street
Bread & Roses, Inc. is holding 2 application seminars for residents interested in purchasing the affordable
home being built at 70 May Street.
Other Communications and Announcements
Town Manager, Andrew Maylor, explained that the Town is working with the new trash hauler and the
existing recycling company to rework one day of the schedule to make sure recycling is being
picked up when it is supposed to be.
PUBLIC HEARING:
National Grid Pole Petition-Morningside Lane and Meadoview Road (continued from 7/18/17)
This public hearing was continued from the last meeting due to several unanswered questions. National
Grid provided revised documents regarding the pole petition. All relevant departments reviewed the
revised documents and had no issues. Chris Wellington from National Grid presented the information and
answered questions regarding the petition.
Rosemary Smedile made a MOTION seconded by Richard Vaillancourt to close the public hearing
to receive comments on proposed National Grid Pole Petition for Morningside Lane, Meadowview
Road and Woodcrest Drive. Vote approved 5-0.
Rosemary Smedile made a MOTION seconded by Chris Nobile that the Board of Selectmen
approve the National Grid Pole Petition #24184505 for Morningside Lane, Meadowview Road and
Woodcrest Drive as presented. Vote approved 5-0.
Removal of Public Shade Tree-70 May Street
Richard Vaillancourt made a MOTION, seconded by Chris Nobile to open the public hearing to
receive comments on the proposed removal of a public shade tree in front of 70 May Street.
Laurie Burzlaff, Chair of the Affordable Housing Trust spoke on behalf of the owner of the property, Bread
& Roses, Inc. Bread & Roses submitted a request to remove a tree located in the public way in front of 70
May Street. DPW Director, Jim Stanford, recommends removal of the tree as it was in bad shape and
would eventually need to be removed by the Town.
Chris Nobile made a MOTION, seconded by Richard Vaillancourt to close the public hearing to
receive comments on the proposed removal of a public shade tree in front of 70 May Street. Vote
approved 5-0.

Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen approve the request of Bread & Roses, Inc. to remove a public shade tree in front of 70
May Street subject to them planting a new tree. Vote approved 5-0.
CONSENT ITEMS:
Saturday, October 21, 2017 from 10:00am to 11:30am
Included in the packet was a request from Bob Autieri of the Samaritans of the Merrimack Valley
October 21, 2017 from 10:00am to 11:30am. All relevant departments reviewed the request and had no
issues.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen approve the request of Bob Autieri to use Willow Street and Flagship Drive on
Saturday, October 21, 2017 from 10-11:30am as presented. Vote approved 5-0.
Vote to change the abatement rate and number of participants for Senior Property Tax Work Off Program
Included in the packet was a memorandum from Town Manager, Andrew Maylor, recommending an
increase in the abatement rate and an increase the number of participants for the Senior Citizen Property
Tax Work off Program. The recommendation is to increase the rate from $10 to $11 per hour and the
number of participants from 40 to 50.
Richard Vaillancourt made a MOTION, seconded by Regina Kean that the Board of Selectmen
approve the senior citizen tax work off program, increase the abatement rate to $11.00 per hour
and increase the maximum number of participants to 50. Vote approved 5-0.
Request to surplus vehicles-Police Department
Per town policy regarding surplus equipment, Police Chief Charles Gray submitted two memorandums
regarding the surplus of vehicles.
Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen
approve the request of Police Chief, Charles Gray, to surplus a 2008 Ford Expedition and a 2007
Dodge Charger, as per his memorandums to the Town Manager dated July 26, 2017. Vote
approved 5-0.
Vote to establish OPEB Committee
At the last meeting the Board agreed to vote on forming an OPEB Committee to evaluate options
regarding OPEB. The Board discussed membership of the committee to include the following: Board of
Selectmen representative, Finance Committee representative, School Committee representative, School
Department Representative, the Town Finance Director, the Director of Human Resources and a resident
with expertise in finance.
Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen
establish an OPEB Advisory Committee which shall include a representative from the Board of
Selectmen, a representative from the Finance Committee, a representative from the School
Committee, the Finance Director, Human Resources Director, Assistant Superintendent of Finance
for the School Department and one resident. Vote approved 5-0.
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen appoint Chris Nobile as their representative on the OPEB Advisory Committee. Vote
approved 5-0.
Vote on recommendation of Appointment Subcommittee to repeal the Constitution and Bylaws of the
North Andover Patriotic Observance Committee and establish mission
After reviewing the documents related to the Patriotic Observance Committee, the appointment
subcommittee recommended repealing the Constitution and Bylaws which were accepted by the Board of
Selectmen on March 10, 2008. The goal is to eliminate the document that conflicts with state statute but
keep the committee with the current membership.
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen table the matter until the meeting on August 28, 2017 so members of the Patriotic
Observance Committee can review. Vote approved 5-0.

Appointment of Board of Selectmen representative to the Affordable Housing Trust
Town Bylaw requires a member of the Board of Selectmen to serve as a trustee of the Affordable
Housing Trust. The Board must appoint a member to fill the seat vacated by Tracy Watson.
Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen
appoint Richard Vaillancourt to serve as Trustee of the Affordable Housing Trust for a term ending
June 30, 2018. Vote approved 5-0.
LICENSING COMMISSIONERS:
Rosemary Smedile made a MOTION, seconded by Chris Nobile, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Smolak Farms Entertainment License violation
Michael Smolak and his attorney were present to discuss with the Board the recent entertainment license

violations. The attorney indicated there was a miscommunication regarding the violation on July 18;
however, she acknowledged there was never any request filed by Smolaks for an extension of their
th
entertainment license. Mr. Smolak apologized for the violation on July 26 and stated it would not happen
again.
Requests for one day all alcohol licenses for the following events in the tent at Smolak Farms:
Class Inc. - Corporate awards banquet on Friday, September 8, 2017 from 6:00pm to 10:00pm
Epizyme- Corporate picnic on Saturday, September 16, 2017 from 12:00pm to 6:00pm
Phil DeCologero made a MOTION, seconded by Regina Kean, that the Board of Selectmen, acting
as Licensing Commissioners, approve the requests for one day All Alcohol Licenses for events at
Smolak Farms on September 8, 2017 from 6-10PM and September 16, 2017 from 12-6PM, as
presented. Vote approved 5-0.
Paul Gallant of Merrimack College requests the following licenses:
One day all alcohol license for a new faculty reception in Crowe Hall on Wednesday, August 30, 2017
from 4:30pm to 9:30pm
One day wine and malt license for a graduate studies welcome at the Rogers Performing Arts Center
lobby on Thursday, August 31, 2017 from 5:30pm to 8:30pm
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners, approve the requests of Merrimack College for a one day all
alcohol license for an event on August 30, 2017 from 4:30-9:30PM and a one day wine and malt
license for an event on August 31, 2017 from 5:30-8:30PM, as presented. Vote approved 5-0.
Kate Bibeau of Stevens Coolidge Place Trustees requests one day wine and malt licenses for:
Outdoor cocktail party on Saturday, September 16, 2017 from 4:00pm to 7:00pm
Outdoor concert on Sunday, September 24, 2017 from 2:00pm to 6:00pm
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners, approve the requests of the Steven Coolidge Trustees for
one day wine and malt licenses for events on September 16, 2017 from 4:00-7:00PM and
September 24, 2017 from 2:00-6:00PM, as presented. Vote approved 5-0.
Rosemary Smedile made a MOTION, seconded by Chris Nobile to close a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
