HomeMy WebLinkAbout2017-08-14 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES August 14, 2017 CALL TO ORDER: Chairman Phil DeCologero called the meeting to order at 7:00PM in the Town Hall Meeting Room. The meeting was recorded. ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Licensing Chairman, Richard Vaillancourt, Rosemary Smedile, Chris Nobile, Town Manager Andrew Maylor, Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. Approximately 12 members of the public were in attendance. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Richard Vaillancourt made a MOTION, seconded by Regina Kean, to approve the Open Session Minutes of July 18, 2017. Vote approved 5-0. COMMUNICATIONS AND ANNOUNCEMENTS: Recognition-Eagle Scout Project-Anuvind Iyer Eagle Scout, Anuvind Iyer, was recognized for building a boardwalk/bog bridge at Mazurenko Farm. Recognition-Youth and Recreation Department summer programs Rick Gorman, Director of Youth and Recreation Services, and members of his staff were recognized for their outstanding summer programs. Application Seminars for 70 May Street Bread & Roses, Inc. is holding 2 application seminars for residents interested in purchasing the affordable home being built at 70 May Street. Other Communications and Announcements Town Manager, Andrew Maylor, explained that the Town is working with the new trash hauler and the existing recycling company to rework one day of the schedule to make sure recycling is being picked up when it is supposed to be. PUBLIC HEARING: National Grid Pole Petition-Morningside Lane and Meadoview Road (continued from 7/18/17) This public hearing was continued from the last meeting due to several unanswered questions. National Grid provided revised documents regarding the pole petition. All relevant departments reviewed the revised documents and had no issues. Chris Wellington from National Grid presented the information and answered questions regarding the petition. Rosemary Smedile made a MOTION seconded by Richard Vaillancourt to close the public hearing to receive comments on proposed National Grid Pole Petition for Morningside Lane, Meadowview Road and Woodcrest Drive. Vote approved 5-0. Rosemary Smedile made a MOTION seconded by Chris Nobile that the Board of Selectmen approve the National Grid Pole Petition #24184505 for Morningside Lane, Meadowview Road and Woodcrest Drive as presented. Vote approved 5-0. Removal of Public Shade Tree-70 May Street Richard Vaillancourt made a MOTION, seconded by Chris Nobile to open the public hearing to receive comments on the proposed removal of a public shade tree in front of 70 May Street. Laurie Burzlaff, Chair of the Affordable Housing Trust spoke on behalf of the owner of the property, Bread & Roses, Inc. Bread & Roses submitted a request to remove a tree located in the public way in front of 70 May Street. DPW Director, Jim Stanford, recommends removal of the tree as it was in bad shape and would eventually need to be removed by the Town. Chris Nobile made a MOTION, seconded by Richard Vaillancourt to close the public hearing to receive comments on the proposed removal of a public shade tree in front of 70 May Street. Vote approved 5-0. Board of Selectmen Minutes August 14, 2017 2 Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen approve the request of Bread & Roses, Inc. to remove a public shade tree in front of 70 May Street subject to them planting a new tree. Vote approved 5-0. CONSENT ITEMS: Saturday, October 21, 2017 from 10:00am to 11:30am Included in the packet was a request from Bob Autieri of the Samaritans of the Merrimack Valley October 21, 2017 from 10:00am to 11:30am. All relevant departments reviewed the request and had no issues. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen approve the request of Bob Autieri to use Willow Street and Flagship Drive on Saturday, October 21, 2017 from 10-11:30am as presented. Vote approved 5-0. Vote to change the abatement rate and number of participants for Senior Property Tax Work Off Program Included in the packet was a memorandum from Town Manager, Andrew Maylor, recommending an increase in the abatement rate and an increase the number of participants for the Senior Citizen Property Tax Work off Program. The recommendation is to increase the rate from $10 to $11 per hour and the number of participants from 40 to 50. Richard Vaillancourt made a MOTION, seconded by Regina Kean that the Board of Selectmen approve the senior citizen tax work off program, increase the abatement rate to $11.00 per hour and increase the maximum number of participants to 50. Vote approved 5-0. Request to surplus vehicles-Police Department Per town policy regarding surplus equipment, Police Chief Charles Gray submitted two memorandums regarding the surplus of vehicles. Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen approve the request of Police Chief, Charles Gray, to surplus a 2008 Ford Expedition and a 2007 Dodge Charger, as per his memorandums to the Town Manager dated July 26, 2017. Vote approved 5-0. Vote to establish OPEB Committee At the last meeting the Board agreed to vote on forming an OPEB Committee to evaluate options regarding OPEB. The Board discussed membership of the committee to include the following: Board of Selectmen representative, Finance Committee representative, School Committee representative, School Department Representative, the Town Finance Director, the Director of Human Resources and a resident with expertise in finance. Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen establish an OPEB Advisory Committee which shall include a representative from the Board of Selectmen, a representative from the Finance Committee, a representative from the School Committee, the Finance Director, Human Resources Director, Assistant Superintendent of Finance for the School Department and one resident. Vote approved 5-0. Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen appoint Chris Nobile as their representative on the OPEB Advisory Committee. Vote approved 5-0. Vote on recommendation of Appointment Subcommittee to repeal the Constitution and Bylaws of the North Andover Patriotic Observance Committee and establish mission After reviewing the documents related to the Patriotic Observance Committee, the appointment subcommittee recommended repealing the Constitution and Bylaws which were accepted by the Board of Selectmen on March 10, 2008. The goal is to eliminate the document that conflicts with state statute but keep the committee with the current membership. Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen table the matter until the meeting on August 28, 2017 so members of the Patriotic Observance Committee can review. Vote approved 5-0. Board of Selectmen Minutes August 14, 2017 3 Appointment of Board of Selectmen representative to the Affordable Housing Trust Town Bylaw requires a member of the Board of Selectmen to serve as a trustee of the Affordable Housing Trust. The Board must appoint a member to fill the seat vacated by Tracy Watson. Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen appoint Richard Vaillancourt to serve as Trustee of the Affordable Housing Trust for a term ending June 30, 2018. Vote approved 5-0. LICENSING COMMISSIONERS: Rosemary Smedile made a MOTION, seconded by Chris Nobile, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Smolak Farms Entertainment License violation Michael Smolak and his attorney were present to discuss with the Board the recent entertainment license th violations. The attorney indicated there was a miscommunication regarding the violation on July 18; however, she acknowledged there was never any request filed by Smolaks for an extension of their th entertainment license. Mr. Smolak apologized for the violation on July 26 and stated it would not happen again. Requests for one day all alcohol licenses for the following events in the tent at Smolak Farms: Class Inc. - Corporate awards banquet on Friday, September 8, 2017 from 6:00pm to 10:00pm Epizyme- Corporate picnic on Saturday, September 16, 2017 from 12:00pm to 6:00pm Phil DeCologero made a MOTION, seconded by Regina Kean, that the Board of Selectmen, acting as Licensing Commissioners, approve the requests for one day All Alcohol Licenses for events at Smolak Farms on September 8, 2017 from 6-10PM and September 16, 2017 from 12-6PM, as presented. Vote approved 5-0. Paul Gallant of Merrimack College requests the following licenses: One day all alcohol license for a new faculty reception in Crowe Hall on Wednesday, August 30, 2017 from 4:30pm to 9:30pm One day wine and malt license for a graduate studies welcome at the Rogers Performing Arts Center lobby on Thursday, August 31, 2017 from 5:30pm to 8:30pm Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting as Licensing Commissioners, approve the requests of Merrimack College for a one day all alcohol license for an event on August 30, 2017 from 4:30-9:30PM and a one day wine and malt license for an event on August 31, 2017 from 5:30-8:30PM, as presented. Vote approved 5-0. Kate Bibeau of Stevens Coolidge Place Trustees requests one day wine and malt licenses for: Outdoor cocktail party on Saturday, September 16, 2017 from 4:00pm to 7:00pm Outdoor concert on Sunday, September 24, 2017 from 2:00pm to 6:00pm Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting as Licensing Commissioners, approve the requests of the Steven Coolidge Trustees for one day wine and malt licenses for events on September 16, 2017 from 4:00-7:00PM and September 24, 2017 from 2:00-6:00PM, as presented. APPROVAL OF MINUTES: Richard Vaillancourt made a MOTION, seconded by Regina Kean, to approve the Open Session Minutes of June 19, 2017. Vote approved 5-0. PUBLIC HEARING: National Grid Pole Petition - Morningside Lane and Meadowview Road Michele Stacy from National Grid was present to explain the petition. The Board had several questions that Ms. Stacy could not answer. Michael Bartlett of 99 Meadowview Road requested driveways not be disturbed. Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen continue the Public Hearing for the National Grid Pole Petition for Morningside Lane and Meadowview Road until the next meeting on August 14, 2017. CONSENT ITEMS: Request of Leslie Frazier and others to donate a tree to be planted at the Town Common in memory of Glen Macon Leslie Frazier was present to request permission to donate a tree to be planted at the Town Common in memory of Glen Macon. They are not asking for any memorial plaque. John Lavin, Senior Foreman at Public Works, has provide a favorable recommendation. Accept and sign License Agreement with Massachusetts Electric Company Included in the packet was documentation provided by Jim Stanford, DPW Director, regarding the updated License Agreement with Massachusetts Electric Company regarding the Hatch area parking lot has reviewed the proposed License Agreement. Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen accept and sign the proposed License Agreement with Massachusetts Electric Vote approved 5-0. Accept and sign Easements from RCG West Mill MA, LLC Included in the packet was documentation provided by Jim Stanford, DPW Director, regarding permanent easements for two areas along Water Street near the intersection with High and Elm Streets. The easements are necessary in order to properly realign the intersection as part of the Water/High Streets Capital Improvement Project. Town Counsel has reviewed the proposed Easements. Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen accept and sign the proposed Easements from RCG West Mill MA, LLC for two areas along Water Street near the intersection with High and Elm Streets. Vote approved 5-0. Affordable Unit Resale - 4 Harvest Drive, Unit 216 (Oakridge Village-Maplewood Reserve) housing unit at 4 Harvest Drive, Unit 216 (Oakridge Village-Maplewood Reserve) is up for sale. It is recommended the Board not exercise its right of first refusal. Board of Selectmen Minutes July 18, 2017 3 Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen decline the right of first refusal to purchase the affordable housing unit at 4 Harvest Drive, Unit 216 (Oakridge Village-Maplewood Reserve). Vote approved 5-0. Vote to accept and sign Conservation Restriction from Wellington Woods Homeowner Association Trust Included in the packet was documentation provided by Town Counsel Suzanne Egan regarding a Conservation Restriction conveyed by Wellington Woods Homeowner Association Trust, through Messina Development Company for Wellington Woods. The Conservation Commission has already reviewed and signed the document. Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen accept and sign the Conservation Restriction from Wellington Woods Homeowner Association Trust for Wellington Woods. Vote approved 5-0. Appointments Rosemary Smedile made a MOTION, seconded by Regina Kean that the Board of Selectmen appoint Ronald Pallone as Constable for a term ending June 30, 2020. Vote approve 5-0. Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen appoint Sumi Dolben to the Council on Aging for a term ending June 30, 2020. Vote approved 5-0. Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen approve the appointment of Lauren Lemack to the Cultural Council for a term ending June 30, 2019. Vote approved 5-0. Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen approve the appointment of Ronn Faigen as an Associate Member to the Zoning Board of Appeals for a term ending June 30, 2020. FY17 Budget Reallocation Included in the packet was documentation for end-of-year FY17 budget reallocations provided by Lyne Savage, Finance Director. LICENSING COMMISSIONERS: Chris Nobile made a MOTION, seconded by Regina Kean, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Entertainment Licenses at 15 First Street Rosemary Smedile made a MOTION seconded by Phil DeCologero that the Board of Selectmen, Restaurant located at 15 First Street for Common Victualler and Entertainment Licenses. Vote approved 5-0. The applicant was present to answer any questions. Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen, located at 166 Sutton Street for a Common Victualler License. Vote approved 5-0. Request for a Change of Manage for a change to their Entertainment License to include live entertainment Mary McGraw was present to answer any questions. Vote to approve revised Alcoholic Beverages Regulations Included in the packet were the revised Alcoholic Beverages Regulations with the changes requested at the May 7, 2017 meeting. Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen, acting as Licensing Commissioners, approve the revised Alcoholic Beverages Regulations as presented. The Board also adopted an increase in the abatement rate from $9.00 per hour to $10.00 per hour. The rate was based on the Commonwealth of Massachusetts minimum wage at that time. As of January 1, 2017, the minimum wage in Massachusetts increased to $11.00 per hour. The program is doing well and the Town is receiving valuable services from the participants. This year I am recommending the Board increase the abatement rate to $11.00 per hour and increase the number of participants from 40 to 50. Although applications will most likely continue to exceed the number of available spots, we want to make sure we have sufficient work for those that participate. If you adopt these recommendations a participant could receive a maximum of a $1,100 property tax abatement, up from the current maximum of $1,000.
