HomeMy WebLinkAbout2017-09-18 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES September 18, 2017 CALL TO ORDER: Chairman Phil DeCologero called the meeting to order at 7:00PM in the Town Hall Meeting Room. The meeting was recorded. ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Licensing Chairman, Richard Vaillancourt, Rosemary Smedile, Chris Nobile, Town Manager Andrew Maylor, Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. 3 members of the public were in attendance. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Chris Nobile made a MOTION, seconded by Regina Kean, to approve the Open Session Minutes of August 28, 2017. Vote approved 5-0. COMMUNICATIONS AND ANNOUNCEMENTS: Halloween Hours Chairman DeCologero announced Halloween trick or treat hours would be from 5:30PM to 7:30PM as recommended by Police Chief Gray. Trash and recycling update-Jim Stanford Jim Stanford, DPW Director, was present to review his memorandum regarding the new trash routes. Upcoming DPW events Included in the agenda packets were flyers for Household Hazardous Waste Drop Off Day, curbside leaf pick up and Lake Cochichewick shore clean up. Other Communications and announcements rd Chairman DeCologero reminded everyone that the Fall Festival is Saturday, September 23. Andrew Maylor announced that the town, along with surrounding communities, will be submitting a proposal to Amazon in response to their Request for Proposals for their second headquarters. th is on October 13 and the money raised will go toward holiday meals and gifts for families in need. CONSENT ITEMS: Vote to approve disbursement of $300,000 from the Affordable Housing Trust Fund to Bread & Roses Housing, Inc. for the purchase of 13 Annis Street The Affordable Housing Trust is once again partnering with Bread & Roses Housing, Inc. to purchase a property to be renovated and sold as affordable housing. Yesenia Gil, Executive Director of Bread & Roses Housing, Inc. was present to answer any questions. The Affordable Housing Trust unanimously voted to award $300,000.00 to Bread & Roses Housing, Inc. for the purpose of purchasing 13 Annis Street. Once the unit is sold to a qualified buyer, Bread & Roses will pay back the trust $120,500.00, plus the difference between the anticipated expenses and the actual expenses. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen authorize Town Manager, Andrew Maylor, to execute a Grant Agreement between the North Andover Affordable Housing Trust Fund and Bread & Roses Housing, Inc., and approve disbursement of funds from the Affordable Housing Trust Fund in the amount of $300,000.00 for the acquisition of property located at 13 Annis Street, North Andover, MA. Vote approved 5-0. Traffic related update including speed limits-Chief Gray (taken out of order) Police Chief Charles Gray was present to give an update on the traffic conditions in town. Chief Gray indicated the police department will be studying certain roads for speeding and will provide recommendations to the Board when the study is complete. Board of Selectmen Minutes September 18, 2017 2 Appointments Historical Commission James Wefers (reappointment) Sustainability Committee-ell Festival Committee-Susan Martin Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen re- appoint James Wefers to the Historical Commission for a term ending June 30, 2020, appoint and appoint Susan Martin to the Festival Committee for a term ending June 30, 2018. Vote approved 5-0. Affordable Unit Resale-1 Harvest Drive, Unit 109 (Oakridge Village/Maplewood Reserve) affordable housing unit at 1 Harvest Drive, Unit 109 (Oakridge Village-Maplewood Reserve) is for sale. It was recommended the Board decline its right of first refusal. Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen decline the right of first refusal to purchase the affordable housing unit at 1 Harvest Drive, Unit 109 (Oakridge Village-Maplewood Reserve). Vote approved 5-0. Chairman DeCologero recused himself and left the room. Mr. Vaillancourt took over as chair. Accept donation from North Andover Merchants Association to Fire Department in the amount of $865.00 to be used for the SAFE program The North Andover Merchants Association once again donated funds to the Fire Department to be used toward the SAFE (Student Awareness Fire Education) program. The program allows the fire department to provide fire education at the schools and senior center. Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen accept the donation of $865.00 from the North Andover Merchants Association to be used for the Fire Vote approved 4-0. Chairman DeCologero returned to his seat. Transfer of van from MassDOT to the Town of North Andover to be used by Elder Services Included in the packet was senior center van that is currently leased from the Merrimack Valley Regional Transit Authority. The Board was asked to accept the donation of the vehicle if it can be obtained from the MassDOT at no cost. Rosemary Smedile made a MOTION, seconded by Regina Kean, that the Board of Selectmen accept the donation of a 2011 van currently leased by Elder Services, if it can be obtained from the MassDOT at no cost. Vote approved 5-0. LICENSING COMMISSIONERS: Rosemary Smedile made a MOTION, seconded by Chris Nobile, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Requests for one day all alcohol licenses at Smolak Farms: Surprise party on Saturday, September 23, 2017 from 6:00PM-10:00PM in the Barn Staff Appreciation Dinner on Thursday, October 5, 2017 from 4:00PM-8:00PM in the Tent Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Dustin Silk for an All Alcohol License for a surprise party at Smolak Farms from 6:00PM to 10:00PM on September 23, 2017 and approve the request of Michael Lombard for an All Alcohol License for staff appreciation dinner from 4:00PM to 8:00PM on October 5, 2017. Vote approved 5-0. Richard Davenport d/b/a 495 Auto Gallery Inc. requests a class II license at 17 Massachusetts Avenue The applicant was not present. Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen, acting as Licensing Commissioners, table the request of Richard Davenport d/b/a 495 Auto Gallery, Inc. for Class II license at 17 Massachusetts Avenue until the next meeting. North Andover as a community depends on people like you who make the effort to volunteer. We have nearly thirty boards and commissions appointed by the North Andover Board of Selectmen and the Town Manager. Serving on a board or committee is real opportunity to help shape our town, and likely learn something new in the process! What is the biggest challenge and most engaging duty? Balancing the public good with private rights and interests is your most engaging duty. Being a good listener will help you determine what is in the public good/interest. Having an open mind to ideas and discussions is crucial. Fortunately our boards follow simple and fairly standard meeting rules designed to encourage public discussion. The mission and composition of each board is different. This document is intended to answer the common questions of new committee members, regardless of committee. Board members are expected to comply with three important laws: the Open Meeting Law, the Conflict of Interest Law and the Public Records Law. The Open Meeting Law ensures that the public has knowledge and access to the making process. All board meetings and discussions must take place at a public meeting; the time, place and agenda of which must be posted 48 hours in advance. The Town Clerk assists all boards and commissions with posting notice of public meetings. There are additional public meeting and hearing requirements that are applicable to various boards that you will learn about from your chairperson. personal relationships do not conflict with their public obligations. As an appointed board member, you are considered a municipal employee for the purposes of the Conflict of Interest Law. You are prohibited from participating in matters that involve your own, an immediate requires that you disclose any conflict or appearance of a conflict to your appointing authority. You must take the State Ethics Commission online training program and the accompanying test. At the end of the test print out the certificate and file it with the Town Clerk. Display good ethical behavior by avoiding the pursuit of special privileges, or personal gain. The Public Records Law presumes that every record that is made or received by a board or commission is a public record unless a specific statutory exemption applies. The minutes, information data, memoranda and circulating materials, correspondence, including emails of any town board or committee are mostly considered public records and subject to disclosure. The Ћ Town has appointed a Records Access Officer who manages all requests. If you have a question about a public record request or the status of document please contact the Records Access Officer. In addition to following the law, all board and committee members are reminded to be professional as you are representing not only yourself but the Town of North Andover. Be deliberate in how and what you communicate about matters pending before your board; always Attend all meetings, follow the rules of procedures and contribute in a constructive way. Some boards are created by Massachusetts General Laws, such as the Planning Board, Zoning Board of Appeals, Conservation Commission, Board of Health and Historic Commission, among other boards. Most statutorily created boards have permit granting authority that is typically authorized by a local bylaw and the state statute. It is important to understand the rules and requirements. Other Boards and Committees are created by the Board of Selectmen or Town Manager to examine an authority and their mission is defined by the North Andover Bylaws (2016) and North Andover Charter (2015) . How do I make decisions? Members of statutorily created boards that issue permits should base their decisions on the relevant laws, regulations, and the materials presented at the public hearing or meeting. All deliberations and decisions must be made at an open meeting and in compliance with the Open Meeting Law. Think and weigh carefully the public interest. and the information presented to the board. Ќ What do I need to know about my board? Some boards/committees work in support of a specific town department, representing the community interests to the department and acting as a liaison between the town and the community at large. In this case, a staff member may be assigned to attend the meetings and is your best point of content for advice as to how to engage other town or school employees. If you are a member of a board or committee that does not support one specific department directly, you should seek guidance from the executive assistant to the town manager or a member of the Board of Selectmen regarding how to best engage town or school department employees. Committee chairs, on behalf of the board, are annually requested to report to the Board of Selectmen the disposition of the important issues, considerations, and decisions of the committee. All boards are required to organize annually, including the election of a chairperson and other officers. Boards with representatives on other boards/committees shall annually vote on which representatives voted on by the board be rotated regularly. The Open Meeting Law requires that a committee keep minutes of its public meetings and a basis with the Town Clerk. The public meeting minutes are public records and are available to any member of the public on request. Any document introduced at a public meeting should be included in the minutes. Minutes must include: 1. the date, time and place of the meeting; 2. the members present or absent; 3. decisions made or actions taken; 4. a record of all votes taken; 5. a summary of discussion on each subject; 6. a list of all documents and exhibits used; and 7. the name of any member who participated remotely. to the committee, the desirability of widespread involvement, and the changing needs of the committee and our town. Although there is no fixed limit on length of service the length of service is normally limited to two (2) three-year terms. A committee member who is no longer able to serve should resign promptly so that the vacancy may be filled. A written resignation must be submitted to the Town Clerk, appointing authority and the chair of the committee. Ѝ meetings of a public body must be open to the public at all times. A meeting is defined as a gathering of a quorum (i.e. majority of the total membership) of the board or commission for the purpose of discussing the business of the public body. The law does not apply to chance meetings or social occasions; however, such meetings cannot be used to circumvent the requirement of discussing and deliberating at public meetings.
