BOARD OF SELECTMEN MINUTES October 16, 2017
CALL TO ORDER: Chairman Phil DeCologero called the meeting to order at 7:04PM in the Town Hall
Meeting Room. The meeting was recorded.
ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Licensing
Chairman, Richard Vaillancourt, Rosemary Smedile, Chris Nobile, Town Manager Andrew Maylor,
Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. 11 members of the public
were in attendance.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to approve the Open
Session Minutes of September 25, 2017. Vote approved 5-0.
COMMUNICATIONS AND ANNOUNCEMENTS:
Update on Open Meeting Law-Joyce Bradshaw (taken out of order)
Town Clerk, Joyce Bradshaw, updated the Board about changes to the Open Meeting Law.
Master Plan Process Update-RKG Associates
Craig Seymour from RKG Associates and Community and Economic Development Director, Eric Kfoury,
updated the Board on the Master Plan Process.
Board of Selectmen meeting calendar
The Board was provided a revised meeting calendar with dates through June, 2018.
Other communications and announcements
Chairman DeCologero announced the School Committee has invited a member of the Board of
Selectmen to serve on the Superintendent Search Committee. The Board will vote on their appointment
at the next meeting.

Joseph Huggins presented his request for

Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt, that the Board of
Selectmen approve the installation of little free community libraries at Reynolds Playground,
Drummond Playground and McEvoy Field, as presented. Vote approved 5-0.
Appointments
Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen appoint
Karen Kline to the Poet Laureate Committee for a term ending June 30, 2019, Linda Lawrence to
the Council on Aging for a term ending June 30, 2019 and Sue Parke to the Festival Committee for
a term ending June 30, 2018. Vote approved 5-0.

James Doucett requests permission to use streets in North Andover for the 28 annual Cambridge Sports
Union rollerski race on Sunday, November 5, 2017 from 9:30AM to 11:00AM

Included in the packets was a request from James Doucett to use streets in North Andover for the annual
Cambridge Sports Union rollerski race on Sunday, November 5, 2017 from 9:30AM to 11:00AM. The race
route is Milk Street to Johnson Street to Rea Street to Chestnut Street ending back at Milk Street.
Approximately 20-30 participants are expected. All relevant town departments reviewed the request and
have no issues.
Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen approve the
request of James Doucett to use the streets in North Andover, as presented, for the Cambridge
Sports Union annual rollerski race on Sunday, November 5, 2017 from 9:30AM to 11:00AM. Vote
approved 5-0.
The Patriotic Observance Committee requests permission to use streets in North Andover for the annual
Veterans Day Parade and ceremony on Saturday, November 11, 2017 and to close the end of First Street
at Main Street
Included in the packet was a request from the Patriotic Observance Committee to hold the annual
Veterans Day Parade and Ceremony on Saturday, November 11, 2017 starting at 10:00AM. The
Committee is also requesting permission to close the end of First Street at Main Street. All relevant
departments reviewed the request and have no issues.
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen approve the request of the Patriotic Observance Committee to conduct the Veterans
Day Parade and Ceremony, as presented, on Saturday, November 11, 2017 starting at 10:00AM
and to close the end of First Street at Main Street. Vote approved 5-0.
Request to surplus vehicle and self-contained breathing apparatus-Fire Department
Included in the packet was a memorandum from Fire Chief William McCarthy to surplus a vehicle and
self-contained breather apparatus. The items will either be auctioned or traded in.
Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen
approve the request of Fire Chief William McCarthy to surplus a 2000 Ford Econoline bucket truck,
20 Scott SCBA harnesses, 27 Scott air bottles and 14 AV2000 Scott SCBA masks. Vote approved
5-0.
Carol Bradstreet of the Cystic Fibrosis Foundation requests use of Drummond Park on Saturday, May 19,
2018 from 7:30AM-3:00PM for the Great Strides Walk to Cure Cystic Fibrosis
Included in the packet was a request from Carol Bradstreet of the Cystic Fibrosis Foundation to use
Drummond Park at Strides: A Walk to Cure Cystic
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen approve the request of the Cystic Fibrosis Foundation to use Drummond Park on
Saturday, May 19, 2018 from 7:30AM to 3: Walk to Cure

Glen Alt, Water Treatment Plant Superintendent, requests a waiver of all permit fees for the installation of
a generator at the Holly Ridge sewer pump station
Included in the packet was a request from Glen Alt, Water Treatment Plant Superintendent, requesting a
waiver of the permit fee for the installation of the new generator at the Holly Ridge sewer pump station.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen
waive all permit fees for the installation of the new generator at the Holly Ridge sewer pump
station. Vote approved 5-0.
Fiscal 2019 Budget Policy Statement
In accordance with the Town Charter, Chapter 9-2-n or before the first day of November of each
year, the Board of Selectmen, after consulting with the Town Manager, shall issue a policy statement
relating to the budget for the ensuing fiscal year. The statement shall establish the outer limits of possible
bud The budget policy statement was developed by the Board and Town
strategic planning meeting.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen
approve the FY19 Budget Policy Statement as presented. Vote approved 5-0.

Winter parking ban
Included in the packets was the proposed winter parking ban. After discussions with the Police Chief and
Director of Public Works, the Town Manager recommended the ban begin on January 2, 2018 and end on

March 15, 2018. In the past the ban has run from December 1 through February 28.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen adopt the Winter Parking Ban effective January 2, 2018 at 12:01AM through March 15,
2018. Vote approved 5-0.
LICENSING COMMISSIONERS:
Rosemary Smedile made a MOTION, seconded by Chris Nobile, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Kristi Hale of the North Andover Foundation for Education requests a one day wine and malt license for a
fundraising dinner at Brooks School on Saturday, November 18, 2017 from 6:30PM to 10:30PM and
requests a waiver of the fee
Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Kristi Hale of the North Andover
Foundation for Education for a one day wine and malt license for a fundraiser on Saturday,
November 18, 2017 from 6:30PM-10:30PM at Brooks School.
Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting
as licensing commissioners waive the fee for a one day license for the North Andover Foundation
for Education. Vote approved 5-0.

Groundbreaking at North Campus Pavilion on Wednesday, October 25, 2017 from 3:30PM to 8:30 PM

Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners approve the five one day wine and malt licenses for events at
Merrimack College, as presented. Vote approved 5-0.
Michele and Paul Anderson request a one day wine and malt license for a baby shower in the tent at
Smolak Farms on Sunday, October 22, 2017 from 11:00AM to 3:00PM
Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Michele and Paul Anderson for a one
day wine and malt license for a baby shower in the tent at Smolak Farms from 11:00AM to 3:00PM
on October 22, 2017. Vote approved 5-0.
Rosemary Smedile made a MOTION, seconded by Chris Nobile to close a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
OLD BUSINESS:
Commercial marijuana discussion
Chairman DeCologero began with public comment related to the commercial marijuana issue.
Charles Salisbury of Johnson Street, stated he believed the town waited too long to address the issue
and asked the Board to think about what they want North Andover to represent.
since regulations have not been released and they are not scheduled to be released until March.
In response to a question from Selectman Smedile, Suzanne Egan, Town Counsel, indicated that there
would be no legal issues if the Board decided to take the items up at different times. Town Manager,
Andrew Maylor, indicated that although there are no issues legally, for the purposes of the Planning
Board process, the Board may not want to wait to vote on whether they want to limit or prohibit any of the
five commercial marijuana establishments.

With regard to marijuana retailer, all Board members indicated they would not be in favor of any
marijuana retailers.
With regard to manufacturing and cultivation, Selectmen Nobile would be open to allowing it because
North Andover could become a hub for innovation. Selectmen Kean indicated she does not want to see a
ban on manufacturing, cultivation or laboratory.
Manager to provide further information for their next meeting.
Selectmen Smedile stated that she is opposed to allowing an independent testing laboratory because the
Federal government does not allow it. Town Counsel, Suzanne Egan, clarified that this issue is
completely separate from Federal laboratory licensing. This decision is strictly under state law.
Attorney Egan also indicated that the Board can limit the number of licenses.

PUBLIC COMMENT:
Stan Limpert, 43 Stonecleave Road, thanked all the volunteers that helped at the Farmers Market.
Anne Gleason, 28 Bradstreet Road, asked the Board to consult with someone with experience in
addiction counseling prior to making a decision on allowing marijuana businesses in town.

Town Manager, Andrew Maylor, provided the Board with a memorandum from Town Counsel regarding
the commercial marijuana law.
CONSENT ITEMS:
Request of Dan Pas to hold the MDA Boot Drive at the roundabout at the Town Common
Dan Pas of the North Andover Firefighters Union submitted a request for permission to hold their annual
Muscular Dystrophy Association Boot Drive on Saturday, September 30, 2017 from 9:00AM until 2:00PM.
All relevant departments reviewed the request and had no issues.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen approve the request of Dan Pas to use the roundabout at the Town Common for the
Muscular Dystrophy Association Boot Drive from 9:00AM to 2:00PM on September 30, 2017. Vote
approved 5-0.
Direasking the Board to accept ongoing
donations of food from Stop and Shop.
Rosemary Smedile made a MOTION, seconded by Regina Kean that the Board of Selectmen
accept the donation of non-perishable food items from Stop and Shop to the Senior Center. Vote
approved 5-0.
LICENSING COMMISSIONERS:
Rosemary Smedile made a MOTION, seconded by Chris Nobile, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Richard Davenport d/b/a 495 Auto Gallery Inc. requests a class II license at 17 Massachusetts Avenue
Mr. Davenport withdrew his application so no action was needed.
Amy Hoffenberg of Merrimack College requests 3 one day wine and malt licenses for theater concessions
at the Rogers Center for the Arts on September 28 and 29, 2017 from 6:30PM to 10:30PM and October
19, 2017 from 6:30PM to 11:30PM
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as licensing commissioners, approve the three one day wine and malt licenses for
Merrimack College for events at the Rogers Center for the Arts on September 28, 2017, September
29, 2017 and October 19, 2017, as presented. Vote approved 5-0.

CALL TO ORDER: Chairman Phil DeCologero called the meeting to order at 7:30PM in the 2 Floor
Conference Room at Town Hall.
ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Chris
Nobile, Rosemary Smedile, Richard Vaillancourt, Town Manager Andrew Maylor and Executive Assistant,
Laurie Burzlaff. No members of the public were in attendance.
NEW BUSINESS:
The Board discussed the following items as part of the Strategic Planning Session for FY2019. No votes
were taken.
Finance
The Board stressed the need to develop a budget which is structurally balanced, adhering to the financial
reserve policies adopted by the Board and Finance Committee in 2015.
The Board also discussed developing a long term strategy for Stevens Estate and Osgood Hill.
Economic Development
The Board wants to continue to focus on bringing new businesses to North Andover and revitalize the
downtown area. In addition, explore ways to make it easier to open a business in North Andover.
The Board discussed working with Merrimack College to help find ways to promote North Andover.
Neighborhood Enhancement
The Board will continue its commitment to expanding and enhancing active open space and accelerate
the Playground Improvement Plan funded by Community Preservation. The Town Manager indicated the
design for the Middle School Field redevelopment should be completed this year.
The Board asked for a plan to be developed for repair to existing sidewalks and adding new sidewalks in
certain areas to improve pedestrian safety and provide walkable access to businesses.
The Board ask the Town Manager to develop and fund a street tree replacement program.
Community Development
The Board and Town Manager agreed that the Town should hire a mental health/social services
community
support.
The Board indicated its desire to continue to find ways to take advantage of the opportunities available by
being designated a Green Community.
Public Safety
The Board asked the Town Manager to focus on ensuring that public safety employees have the sufficient
training and equipment to adequately perform their jobs.
Government Philosophy
has begun. The Board
asked that a tracking system for annual departmental budget goals be developed.
The Board indicated they want to see all boards and committees be process driven, technology enabled,
consistent and transparent.

Overview
The North Andover Charter (section 9-2-3) requires that the Board of Selectmen, after consultation
with the Town Manager, issue a Budget Policy Statement
budget (FY19 - July 1, 2018 to June 30, 2019). The Charter states that the policy statement shall
establish the outer limits of possible budget growth for the town. The financial resources identified
in this report are preliminary and will be revised, as necessary during the budget process.
Budget Policy Objectives and Strategic Goals
The financial constraints which existed in the first decade of this century have been replaced with
an environment of relative fiscal stability, especially during the past four years. The FY19
commitment to the
-North Andover agenda
predicated on sustainability and stewardship. Contained within those Fundamentals are priorities
established by the Board of Selectmen as part of their strategic planning process. The primary
focus of the Fundamentals, assuming these priorities, includes:
Financial -
and advancing responsible reserve policies that str
to act on pressing needs while protecting against the impacts of economic downturns that
could threaten municipal services delivery and the viability of the Town government. The
Town will continue to develop annual budgets which are structurally balanced and
continue to
a Five Year Capital
Improvement Plan that focuses on reducing the risk of deferred maintenance while
managing the impact that debt service can have on the operating budget. Additionally,
the Board remains committed to developing a long term strategy for the use and/or reuse
of the Stevens Estate, support buildings, and Osgood Hill.
Economic Development further supporting the Town through an aggressive agenda that
seeks to attract new revenue in a variety of forms, including property tax, auto excise tax
and building inspection fees. The Town will work with Merrimack College to develop a
students and their families can provide to the local economy. The Board will continue to
implement strategies to revitalize the downtown area and attract new businesses while
piloting new initiatives to reduce barriers to locating a business in Town, such as group
inspections and expanding the technical review committee process.
Neighborhood Enhancement continually producing improvements in each and every
neighborhood of the Town by updating infrastructure through a functioning Capital
Improvement Program, cleaning streets, enhancing open space, and tackling and resolving
long-standing problems. The Town will accelerate the Playground Master Plan by
completing both Phases 4 and 5 (Carl Thomas and Reynolds) in FY19. The goal for
subsequent years is to renovate two playgrounds per year, which would allow the Town
to complete the Playground Master Plan in seven years instead of eleven. In addition,
the Town will develop a plan to replace existing sidewalks which are in poor condition
and add new sidewalks, with strategic partners when possible (i.e. MassDot), in areas
which can improve pedestrian safety and/or connect pedestrians to local businesses. The
Town will also develop and fund a street tree replacement and augmentation program.
Community Development fully encouraging partnerships between Town government and
governmental entities, the
business community, non-profit leaders, neighborhood groups and individual residents, in
order to support a broad array of programs and initiatives that may or may not be Town-
promote the advancement of its families
and individual residents over a broad range of human needs, including, but not limited to,
affordable housing, health care, education and job training. In FY19, the Town will hire a
full time mental health/social services professional to address a wide range of resident
needs, serving as a conduit for assisting residents in accessing services in areas such as
substance abuse, mental health support, elder shut-in, and homelessness. In addition to
replacing all town owned street lights with energy efficient LED lights, the Board will
continue to explore ways to take advantage of the opportunities provided by being
designated a Green Community.
Public Safety constantly improving upon the protection of the public and its property by
initiating policy and providing the necessary resources, be it training, staffing or
equipment, to effectively carry-
emergency management agencies. The Board will focus on ensuring that all public safety
employees have the sufficient training and equipment to adequately perform their jobs.
This would include both capital and operating budget funded initiatives.
Governmental Philosophy becoming a more open, responsive and responsible municipal
government that not only hears the needs of its people, but develops and initiates efforts
designed to address those needs in an honest, fair, equitable, accountable and cost-effective
manner, while never sacrificing good government for the benefit of those whose goals run
counter to that of a pro-North Andover agenda. In FY19, the Town will complete the
codification and digitation of the general and zoning bylaws. The Town will develop a
tracking system for annual departmental budget goals which would allow for
management reporting and integration in the annual budget development process. The
Town is committed to working with division directors and department heads on
succession planning and mentoring of new management staff.

ALL NIGHT WINTER PARKING BAN
WILL GO INTO EFFECT ON JANUARY 2, 2018, AT 12:01 AM
In accordance with Chapter 40, Section 22, of the General Laws, the following parking regulation shall go into effect on
January 2, 2018.
1. On or after the effective date of this ORDER, no person, except in the event of an emergency, shall park or permit
any vehicle to remain unattended on any street or way in the Town of North Andover between the hours of 12:00
from JANUARY 2, 2018 through MARCH 15, 2018. The Selectmen reserve
the right to continue the ban past March 15, 2018 if the need arises. Parking on sidewalks at any time during the year,
including the period of this ORDER is not permitted, except as noted below in section 2b.
2a. During the period of this ORDER, parking is allowed so that two tires are within 12 inches of the curb or
sidewalk and a minimum of twenty feet away from an intersection or ten feet from fire hydrant, on the
following streets, as indicated below.
Stonington Street: Parking on even side only
Saunders Street: Parking on odd side only
Lincoln Street: Parking on even side only
Perry Street: Parking on even side only
Church Street: Parking on odd side only
Ashland Street: Parking on odd side only
Annis Street: Parking on even side only
Thorndike Road
(from Sutton Street to Troy Road): Parking on odd side only
Marblehead Street
(from Union Street to Middlesex Street): Parking on odd side only
Union Street

2b. During the period of the ORDER parking is allowed so that two tires are within 12 inches of the curb or
sidewalk and a minimum of twenty feet away from an intersection or ten feet from a fire hydrant on the even side of
Beverly Street from Middlesex to Union and on the odd side from Union Street to the Dead End. (No parking on
either side of Beverly from Dana Street to Middlesex Street.) The sidewalk on the odd side of Beverly Street from
Middlesex to Union Street is closed during the period of this ORDER. Residents may park on this sidewalk so long as
no part of the vehicle is on the roadway.
3. Any violation of this ORDER shall be punished by a fine of $25.00.
4. No parking will be allowed in municipal parking lots for more than 48 hours. Vehicles in violation will be towed at
