Simons, Chairman: The Planning Board meeting for Tuesday,November 21, 2017 was called to order at 7 p.m. 7 8 PUBLIC HEARING 9 CONTINUED PUBLICHEARING 1.22 Foster Street North Andover Varsity"'Wireless Brian Grossman 10 Application for Wireless Facilities Special Permit—Site Plan Review under sections 8.9 and 8.3, 10.3 and 10.31 of 11 the North Andover Zoning Bylaw. Applicant proposes to construct, operate and maintain a 130 foot monopole 12 tower(13 5 feet to top of faux branches)with supporting equipment located in the Residential 1 (R-I)Zone. 13 [Continued to the December S, 2017 PI anning Board meetingl 14 15 DISCUSSIONS: 16 Framework for Recreational/Commercial Marijuana Zoning Bylaw: 17 The Board conducted a detailed review of the proposed Framework for the Marijuana Zoning Bylaw with Suzanne 18 Egan,Town Counsel. Comments and suggested edits were communicated. M. Rosen, applicant's attorney offered 19 comments and generally agreed with suggested edits. Town Counsel to update the proposed draft bylaw 20 incorporating edits discussed. 21 22 Wendy Wakeman, 140.Academy Road-Citizens Petition: Communicated that she presented the petitions to the 23 Board of Selectmen and wanted to clarify a misstatement that was made in the newspaper article.The article stated 24 that we are trying to prevent all marijuana use in town. Stated that clearly,these days,you can smoke'm if you got 25 them. That's the new law. All the bylaw and zoning bylaw petition articles aim to do is to eliminate all 26 commercial marijuana uses. Stated that she believes the petitions will go on the very next warrant and that she 27 believes the Board will have to hold hearings on the Zoning Bylaw petition. Expressed that the Town voted this 28 down in 2016 and they merely want to put the other solution in front of the people.Expressed that we have every 29 right to keep all commercial marijuana interests out of town and the idea hasn't been fully vetted because of well- 30 funded corporate interests, 31 32 1600 Os ood Street. Hooks Johnston: Medical Marijuana Overla District/Massachusetts Innovation Works 33 Honks Johnston: Reassured the Board that this project will be successful; the business plan shows this both on the 34 wholesale and the medical Research& Development side. Various implications of a fully controlled interior use of 35 an existing building have been presented. The size of the operation should be driven by the market;the market will 36 ensure this facility grows profitably so we can divert money toward the Innovation Center. The host agreement 37 being negotiated now with the Town is based on square footage of cultivation. If you limit that;the benefit to the 8 Town is diminished. We agree with your conditions,this has to be done in a controlled way and we thinkyou have 39 a lot of control. Stated that timing has been discussed and not having something just before having our Annual Town 46 Meeting but rather to pace it so that there isn't one town meeting then another one a month later.A lot has to do 47 with public input. Expressed she does not believe this should be rushed because it is a big step for the Town. 48 Cautioned that a lot of people don't even know that this is even going on;we owe our citizens the right to weigh in 49 and be a part of it; it's a big decision. 50 51 MINUTES APPROVAL 52 MOTION: (No minutes presented) 53 54 ADJOURNMENT 55 MOTION: J. Luz made a motion to adjourn the meeting. The motion was seconded by P. Boynton.The vote was 56 5-0,unanimous in favor.
