BOARD OF SELECTMEN MINUTES December 4, 2017
CALL TO ORDER: Chairman Phil DeCologero called the meeting to order at 6:35PM in the Town Hall
Meeting Room. The meeting was recorded.
ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Licensing
Chairman, Richard Vaillancourt, Rosemary Smedile, Chris Nobile, Town Manager Andrew Maylor,
Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. Approximately 24
members of the public were in attendance.
EXECUTIVE SESSION:
Regina Kean made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen
enter into executive session for Reason No. 6 under MGL Chapter 30A, Section 21(a) to conduct
strategy session to consider the value of property-1600 Osgood Street proposed marijuana siting
agreement. Chairman DeCologero declared that an open meeting may have a detrimental effect on
the negotiating position of the public body and announced that the board will reconvene in open
session at the conclusion of executive session. Roll call vote: Vaillancourt-yes, Kean-yes,
Smedile-yes, Nobile-yes, DeCologero-yes. Vote approved 5-0.
The Board returned to the meeting room at 7:40PM.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
Chris Nobile made a MOTION, seconded by Richard Vaillancourt to approve the Open Session
Minutes of November 13, 2017 as presented. Vote approved 5-0.
COMMUNICATIONS AND ANNOUNCEMENTS:
Chairman DeCologero invited Amy Mabley, chair of the School Committee, to speak. Ms. Mabley
announced that Gregg Gilligan was chosen as the new Superintendent of Schools by unanimous vote.
Chairman DeCologero thanked the Festival Committee for organizing the Santa Parade, tree lighting and
breakfast with Santa.
Five year financial forecast
Town Manager, Andrew Maylor, presented his five year financial forecast.
CONSENT ITEMS:
Accept MassWorks grant in the amount of $2.7 million for Route 125 corridor improvements
Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen accept the
MassWorks grant in the amount of $2.7 million for improvements to Route 125. Vote approved 5-0.
Appointments
The appointment subcommittee recommended Bryan Perry and Mark Rodgers be appointed to the OPEB
Advisory Committee.
Chris Nobile made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
appoint Bryan Perry and Mark Rodgers to the OPEB Advisory Committee. Vote approved 5-0.
Request of Tom Duggan of The Valley Patriot to use the Town Common for a menorah display from
December 14, 2017 until December 21, 2017 and to use the Town Common on December 14, 2017 from
5:30pm-7:30pm for the lighting of the menorah
Included in the packets was a request from Tom Duggan to use the common from December 14, 2017-
December 21, 2017 for the menorah display and to hold the menorah lighting on December 14, 2017
from 5:30pm to 7:30pm. Mr. Duggan estimates 20 people will attend the lighting. All relevant town
departments reviewed the request and have no issues.

Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen approve the request of Tom Duggan to use the Town Common for a menorah display
from December 14, 2017 through December 21, 2017 and for the lighting of the menorah on
December 14, 2017 from 5:30pm to 7:30pm, as presented. Vote approved 5-0.
Affordable Unit Resale-210 Chickering Road, Unit 204A (Kittredge Crossing)
lanning Association (CHAPA) notified the Town that the affordable housing
unit at 210 Chickering Road, Unit 204A will be listed for sale. It was recommended the Board decline its
right of first refusal.
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen decline the right of first refusal to purchase the affordable housing unit at 210
Chickering Road, Unit 204A (Kittredge Crossing). Vote approved 5-0.
LICENSING COMMISSIONERS:
Rosemary Smedile made a MOTION, seconded by Chris Nobile, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
License Renewals for Calendar Year 2018
The Board was provided with a list of establishments requesting license renewals.
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners table the renewal of the licenses for North Andover
Restaurant Inc. . Vote approved 5-0.
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen, acting
as Licensing Commissioners table the renewal of the entertainment license for Smolak Farm. Vote
approved 5-0.
Phil DeCologero made a MOTION, seconded by Regina Kean that the Board of Selectmen, acting
as Licensing Commissioners, approve and renew the licenses for all of the establishments listed
in t, except for North Andover
. Vote approved 5-0.

Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of China Blossom, 946 Osgood Street to

Rosemary Smedile made a MOTION, seconded by Phil DeCologero to close a meeting of the North
Andover Licensing Commission. Vote approved 5-0.

PUBLIC COMMENT:
Frank Ragonese of 1939 Great Pond Road, asked about the subject of the executive session.
Stephanie Sewade of 615 Massachusetts Avenue indicated she was unhappy with the proposal by the
state (MassDOT) to expand Massachusetts Avenue and believed it would cause more accidents.
Karen Lauro of 591 Massachusetts Avenue requested the state review the project with regards to injury
and death.
Jonathan Park of 595 Massachusetts Avenue stated he is concerned about the safety of his children
walking to school.
The Town Manager agreed to organize a meeting with state officials and residents to discuss the matter
and report back to the Board the contents of that meeting. Residents in the area of the project will be
notified of the meeting via robocall. The Board will discuss the matter further at a future meeting.

Christopher Spanks, an employee of the Department of Public Works, expressed his dissatisfaction with
the DPW and Human Resources.
Dave Rand of 280 Dale Street, asked the Board to fix the Vietnam veterans memorial at the high school.
The Town Manager indicated he would ask the Veterans Services Officer to work with Mr. Rand to
develop a plan for repairs.
The Board was provided with the job posting/vacancy log from the Human Resources Department.

Regina Kean made a MOTION, seconded by Chis Nobile to adjourn the meeting at 9:20p.m. Vote
approved 5-0.

BOARD OF SELECTMEN MINUTES November 13, 2017
CALL TO ORDER: Chairman Phil DeCologero called the meeting to order at 7:00PM in the Town Hall
Meeting Room. The meeting was recorded.
ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Licensing
Chairman, Richard Vaillancourt, Rosemary Smedile, Chris Nobile, Town Manager Andrew Maylor,
Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. Approximately 40
members of the public were in attendance.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
Richard Vaillancourt made a MOTION, seconded by Chris Nobile, to approve the Open Session
Minutes of October 30, 2017, as amended. Vote approved 5-0.
COMMUNICATIONS AND ANNOUNCEMENTS:
Swearing In- Firefighter Matt Sifferlin
Town Clerk, Joyce Bradshaw administer the oath to Firefighter Matt Sifferlin who successfully completed
his one year probationary period and graduated from the Massachusetts Firefighting Academy.
Budget status report FY2018-Lyne Savage
Finance Director, Lyne Savage, gave a status report on the FY18 budget.
Power outage update
Town Manager, Andrew Maylor, thanked the residents for their patience and recognized Fire Chief
William McCarthy, Emergency Management Director, Jeff Coco, Police Chief Charles Gray, DPW Director
James Stanford, Facilities Director Stephen Foster and Assistant Town Manager, Ray Santilli for their
work during the outage. Mr. Maylor indicated he met with representatives from National Grid and
continues to meet with senior staff to try to improve operations. The town is looking into back-up
generators for traffic lights and helping the housing authority address the needs of their residents during
power outages.

Rosemary Smedile announced that Robert Holland and Steven Grass, state police officers from North
Andover, received medals of honor.
Ms. Smedile thanked the Merrimack College students that help assemble the wreaths and thanked Dan
Lanen and the Patriotic Observance Committee for the Veterans Day events
PUBLIC HEARING:
Property Tax Classification
The purpose of the hearing was to receive comments regarding classification and taxation of property
according to use.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile to open a public hearing
on property tax classification. Vote approved 5-0.
Included in the packets were
Garrett Boles, Chief Assessor, provided information about the classification process and responded to
questions. William Carpenter, Vice President of the Merrimack Valley Chamber of Commerce, submitted
a letter to the Board and asked that the tax factor for commercial properties be decreased.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile to close the public hearing on
property tax classification. Vote approved 5-0.
The Board discussed the different percentages and impact those percentages would have on the various
tax bills.

Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen
adopt a residential factor of .94646 for the purpose of classifying the FY2018 North Andover
property tax rates. Vote approved 5-0.
CONSENT ITEMS:
Accept donation for payment of soft costs for MassWorks grant
Andrew Chapin of Princeton Properties, the developer of the Forgetta Farm parcel announced his
company would donate to the Town the total amount of the soft costs (engineering and design) of
approximately $300,000 associated with the MassWorks grant.
Richard Vaillancourt made a MOTION, seconded by Regina Kean that the Board of Selectmen
accept the donation from Princeton Properties for the soft costs for the MassWorks grant project.
Vote approved 5-0.
Vote to recommend to North Andover Commissioner to have GLSD communicate with districts regarding
sewerage spills
Chairman DeCologero asked
to have the GLSD communicate with districts regarding sewerage spills.
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen direct the Townask the Board of Commissioners to
put a policy in place which will require the GLSD to communicate with districts regarding
sewerage spills. Vote approved 5-0.
Request of Jim Stanford, DPW Director, to surplus vehicles and equipment
Included in the packets was a request from DPW Director, Jim Stanford, to surplus a Chevrolet
Trailblazer, a Bandit Chipper and a Kubota mower. All items will be traded in for new equipment.
Richard Vaillancourt made a MOTION, seconded by Regina Kean that the Board of Selectmen
approve the request of DPW Director Jim Stanford to surplus a 2005 Chevrolet Trailblazer, a 1994
Bandit Chipper and a 2011 Kubota mower. Vote approved 5-0.
Request of Jeff Coco, Festival Committee chairman, to use the Town Common for the Christmas Tree
Lighting Celebration on Sunday, November 26, 2017 from 4:30PM to 6:30PM and waive all fees
Jeff Coco, Chairman of the Festival Committee, was present to request permission to use the Town
Common for the annual Christmas Tree Lighting on Sunday, November 26, 2017 from 4:30PM to
6:30PM. The Committee also requested the Board waive all fees.
Rosemary Smedile made a MOTION, seconded by Regina Kean that the Board of Selectmen
approve the request of the Festival Committee to use the Town Common for the Christmas Tree
Lighting Celebration on Sunday, November 26, 2017 from 4:30PM-6:30PM and to waive all fees.
Vote approved 5-0.
Appointment of Brooke Paige to the Cultural Council
The appointment subcommittee recommended Brooke Paige be appointed to the Cultural Council.
Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen appoint
Brooke Paige to the Cultural Council for a term ending June 30, 2020. Vote approved 5-0.
Vote to increase membership on the OPEB Advisory Committee
At the request of the appointment subcommittee, the Board discussed whether they want to increase the
number of people to serve on the OPEB Advisory Committee.
Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen increase the
membership on the OPEB Advisory Committee from 7 to 9 by adding one more resident and one
more member of the finance committee. Vote approved 5-0.
LICENSING COMMISSIONERS:
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt, to open a meeting of the
North Andover Licensing Commission. Vote approved 5-0.

Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners, approve the five one day wine and malt license requests of
Merrimack College for events on November 16, 17, 18, 20 and 30, 2017. Vote approved 5-0.
Jeremy Jones, manager of Howling Wolf North Andover, Inc. d/b/a Howling Wolf Taqueria Express
requests an all alcohol general on premise license and an entertainment license at 550 Turnpike

Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Howling Wolf North Andover, Inc.
d/b/a Howling Wolf Taqueria Express for an all alcohol general on premise license and an
entertainment license at 550 Turnpike Street. Vote approved 5-0.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero to close a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
OLD BUSINESS:
FY19 Budget Policy Statement
Included in the packets was the final draft of the Budget Policy Statement. The statement has been
NEW BUSINESS:
Discussion regarding Special Town Meeting for cannabis bylaw
Town Counsel, Suzanne Egan, was present to answer any questions about her memorandum regarding
the recommendation of the Attorney General to hold a Special Town Meeting prior to April 1, 2017 for the
general bylaw prohibiting the establishments voted on at the last meeting (marijuana retail and craft
marijuana cultivator cooperative). The Board discussed the potential risk of waiting until Town Meeting in
May to amend the general bylaw.
Brooks Street closure
Included the packets was a memorandum from DPW Director, Jim Stanford, regarding the Brook Street
culvert. Town Manager, Andrew Maylor, explained the issue at Brook Street and the costs involved to
correct the problem.
Process for waiving permit fees
In response to a question from Selectman Kean, the Board discussed the process for waiving permit fees.
Chairman DeCologero indicated the applicant must submit a request to waive fees prior to the event and
the request will then be placed on the agenda for the Selectmen to vote on.
PUBLIC COMMENT:
None
Town Manager, Andrew Maylor, informed the Board that Garrett Boles, Chief Assessor, was retiring as of
December 8, 2017.

Based on Revenue and Fixed Cost Review Committee Approved Amounts
Increase Tax Levy by 2.5%.
New Growth increased to $650k for the five year period after many
years at $600k.
Debt Exclusion figures are actual based on the debt schedule. A
significant decline of more than $1.2 million attributable to Thomson,
Middle School, and Osgood Hill expiring debt.
Local Receipts are assumed to increase by 3.55% in FY19 and 3.0%
annually thereafter. FY19 increase mostly attributable to motor
vehicle excise tax.
FY19 State Aid projected to be level funded to approved FY18 State
Budget amounts and increase by 2.5% in each fiscal year from FY20-
FY23.
Operating Transfers are assumed to increase at 2.5% annually during
the five year period.

Pro Forma Assumptions General Fund Expenses
Health Insurance is assumed to increase by 2.00% for FY19 and 6.5% in FY20
and 7.0% from FY 21 through FY23.
Other Personnel Benefits (primarily Retirement and Workers Comp) are
projected to increase by 7.5% in FY19 and 9% in each of the following four
fiscal years. The primary driver of the increase is the Retirement Appropriation
which will increase 8% to 9% each year over the five year period.
Debt Service figures are actual based on existing and assumed debt
schedules.
General Government spending assumed to increase 4.5% in FY19 and 3.00%
from FY20 through FY23. FY19 increase includes a 1 FTE addition of a licensed
mental health professional.

which will be used to make roadway and pedestrian improvements on both sides of Osgood Street from
Butcher Boy to the farm stand at Barker Farm and to install a traffic signal at the intersection of Osgood
