Palaestra Gymnastics Academy-Site Plan Waiver Mr. Schwarz motioned to GRANT the site plan waiver request for Plaestra Gymnastics Academy renovation, 2"d by Mr. White, voted 3-0 in favor of the motion. Article 3-Authorization to Accent Grants of Easements Mr. Schwarz motioned to recommend FAVORABLE action for Article 3- Authorization to Accept Grants of Easements, 2 nd by Mr. White, voted 3-0 in favor of the motion. Article 4-Authorization to Grant Easements Mr. Schwarz motioned to recommend FAVORABLE action for Article 4- Authorization to Grant Easements, 2°d by Mr. White, voted 3-0 in favor of the motion. Article 9-Architectural Fees for a new Foster Farm Elementary School Mr. Schwarz motioned to TAKE NO ACTION for Article 9-Architectural Fees for a new Foster Farm Elementary School, 2"d by Mr. White, voted 3-0 in favor of the motion. I Article 10-New Elementary School at Foster Farm-Boxford Street j Mr. Schwarz motioned to TAKE;NO ACTION for Article 10-New Elementary School at Foster Farm-Boxford Street, 2"d by Mr. White, voted 3-0 in favor of the motion. Article 38-Street Acceptance-Saile Way A 1 Mr. White motioned to recommend FAVORABLE action for Article 38-Street Acceptance-Saile Way, 2""by Mr. Schwarz, voted 3-0 in favor of the motion. Stonewedge.Circle-Surety Agreement The Planning Board endorsed the surety agreement for the amount established by VHB to extend for two years. 1812 Turnpike Street-Surety Agreement The Planning Board accepted the surety agreement as approved by Town Counsel for 1812 Turnpike Street. Public Hearings: Wallace Street/Saville St-Definitive Subdivision The Planning Board questioned whether the technical review committee had time to comment on the plans before the Planning Board. Mr. Mitchell stated he would look into the committee. The applicant felt that he did not need to file for a definitive subdivision were the lots were created in 1913. The Planning Board requested staff to look into the status of the roads ownership and lots and receive an opinion from Town Counsel on whether a definitive should be filed for. Ms. Mary Jo Ciesleeski 32 Booth Street stated that she is a direct abutter and did not receive notification. Mr. Chris Ham 40 Booth Street stated he had not received notification either. Mr. Nardella motioned to CONTINUE the Public Hearing until May 20, 2002, 2"d by Mr. White, voted 4-0 in favor of the motion. Boston Hill Condominiums-,Site Plan Special Permit Mr. Chris Huntress stated that with the previous withdrawal of the plan a building had been eliminate and additions made to some of the units that were previously four units. Mr. Gene Willis stated that he did not feel that the special permit should be granted and that the applicant had not fulfilled the requirements with the traffic study. Mr. Nardella motioned to CLOSE the Public Hearing for Boston Hill Condominiums- Site Plan Special Permit, 2"d by Mr. Schwarz, voted 4-0 in favor of the motion. Mr. Nardella motioned to APPROVE the Site Plan Special Permit for Boston Hill Condominiums with amendments, 2"a by Mr. Schwarz, voted 4-0 in favor of the motion. Discussions: 2 i Article 26- Mr. Schwarz motioned to recommend FAVORABLE action on Article 26, 2 by Mr. White, voted 4-0 in favor of the motion. Article 27 Mr. Schwarz motioned to recommend FAVORABLE action on Article 27, 2"d by Mr. White, voted 4-0 in favor of the motion. Article 28 Mr. Schwarz motioned to recommend FAVORABLE action on Article 28, tad by Mr. White, voted 4-0 in favor of the motion. Foxwood Settlement-Recommendation Mr. Nardella motioned to recommend FAVORABLE action for the Foxwood Settlement Agreement with Town Counsel's approval of the final draft, 2nd by Mr. Schwarz, voted 4-0 in favor of the motion. Article 30-Boundary Line Change between Boxford and North Andover Mr. Schwarz motioned to recommend FAVORABLE action for Article 30- Boundary Line Change between Boxford and North Andover, 2,dby Mr. White, voted 4- 0 in favor of the motion. Article 35-Discontinuance of Public Way-Wood Lane Mr. Nardella motioned to recommend FAVORABLE action on Article 35, 2a" by Mr. Schwarz, voted 4-0 in favor of the motion. Continued Public Hearings: Article 34-Rezone Map 25 Parcel 4-Willow Street R6 to GB Mr. Nardella motioned to recommend FAVORABLE action with the restriction recommended by staff for Article 34, 2"d by Mr. Schwarz, voted 4-0 in favor of the motion. Article 3 1-Modffy Section 9.3 Non-Conforming Zoning Bylaw Mr. Nardella motioned to recommend FAVORABLE action on Article 31, 2"a by Mr. Schwarz, voted 4-0 in favor of the motion.
