HomeMy WebLinkAbout2004-03-23 Planning Board Minutes C��c��5�Li1 az+ TOWN OF NORTH ANDOVER PLANNING BOARD Unapproved Minutes March 23, 2004 Regular Meeting i Members Present: Alberto Angles, Chair, John Simons, Rick Nardella, George White, Vice Chair, Felipe Schwarz, Clerk ,Tames Phinney, Associate Member Staff Present: Julie Parrino, Town Planner,Debbie Wilson,Planning Assistant The Chair called the meeting to order at 7:02PM Informal Discussions: ANR Plans The Planner addressed the board and updated them in regards to the Form A's that she and Ms. Griffin processed. The following ANR Plans were reviewed and acted on. She advised the board that she sought the advice of Town Counsel prior to endorsement of these Form A's. 215 & 225 Old Cart Way—The planner indicated this was approved—Simons stated that this Form A created a non-conforming lot and stated to the Planner that this needs to brought to the attention of the building commissioner and the applicant. Bradford Street—The Planner stated this has been denied—Frontage on three lots does not meet the North Andover requirements even though the property is primarily in Haverhill. Simons and Nardella would like the Planner to look in to this file and inform the board of the details that took place some years ago. Merrimack College—The Planner stated this has been approved—She stated the College was refinancing and needed to change a lot line. Falcon Bond Release The Planner addressed the board and stated that the applicant is in compliance to have his bond released. Motion by Nardella release all remaining bond monies,• second b Schwarz. Discussion: none Motion carries 5-0 530 Turnpike Street (Modification to a Special Permit) The Planner addressed the board and indicated that she had received a call from the applicant. She asked if the islands could be removed and the road striped over to allow for better snow removal. Nardella suggested that a possible compromise could be done. Simons would like to see the landscaping greater to or equal to the island being removed. Angles stated he could stripe it and relocate the plantings somewhere else. Town Meeting Article Discussion The Planner stated that she needs assistance from the board in regards to the warrant articles. Residential Adaptive Re-Use Special Permit— Simons will work on this one. Phased Development Bylaw —Nardella will work on this one. Flood Plain District - Heidi has completed this. R-4 Zoning Amendment for 2 Family Dwellings—Nardella will work on this one and consult with the building department. Planned Commercial Development District—Angles will assist the Planner on this one. The Planner stated that the new zone requires that all of the homes must be included in order for the article to work. The board discussed the new zone and its pro's and con's. Public Hearing: 7:32PM Continued Public Hearings: 80 Saile Way—Watershed Special Permit Mr. Russell addressed the board in regards to the VHB comments and stated he has addressed all of the comments. The Planner stated that VHB requested a Leach Trench pipe to be shown on the plans within the swale detail. She stated that it might have just been a misunderstanding with the plans since there was never a pipe proposed. Angles stated that the pipe is not necessary and the other board members concurred. Nardella stated that a deed restriction must be recorded. Nardella stated that the decision should be clarified to protect the watershed area in regards to chemicals used in the pool. Nardella stated that the deed restriction should be done prior to work on site. Motion by White to close the public hearing for 80 Saile Way,second by Schwarz. Discussion: none. Motion carries 5-0 1789 Great Pond Road The applicant has requested to continue to the April 6tt' meeting, The Planner indicated that VHB comments were in their packets for their review. CVS - Site Plan Special Permit Mr. Manzi addressed the board and requested that the public hearing be closed this evening. Schwarz asked what screening was proposed on the side of the church. The Planner showed the plans to the board and clarified that there would be five white pines and five Pear Trees. Nardella asked the applicant to add hedges in between the trees. Mr. Manzi stated that this would not be a problem. The Planner read the outstanding conditions to the board. The Planner stated that the signage was mentioned in the comments. Nardella stated that the signs are dictated by the building department and the decision should state that signs must conform to the bylaw. Nardella stated that the church should agree for a construction and maintenance easement. Mr. Manzi stated that the church agreement would to be obtained by the Church in Boston. The Planner stated this would be conditioned in the decision. Taylor Dowdy, VHB stated the manhole cover has been lowered and will be shown on the mylars. He stated the island will be shown on the new plans. Schwarz asked if a copy of the Mass Highway proposal was completed. Mr. Dowdy stated that he would see that a copy of the Mass Highway application is submitted to the Planning Department. Schwarz asked if the construction easement is required prior to approval. The Planner stated that a condition could be put in that it must be obtained prior to construction. Schwarz stated that if they do not get the easements it opens up a bunch of conditions. Schwarz wants to see the easement prior to the decision being rendered. Mr. Manzi stated that prior to any work being done on the site he would produce the easement agreement with the church. Simons stated that there are many loose ends and he is not comfortable closing the public hearing. Simons stated that the board has not even seen the final set of plans and he would like to see the plans. Angles stated that the board needs to see the final plans prior to closing the public hearing. The applicant was instructed to provide the new plans and incorporate some additional landscaping. Mr. Manzi agreed that the easement would be conditioned to have it in place prior to any work on site. Nardella instructed the applicant to make sure everything is finalized on the plans. VHB submitted a revised cover sheet for the recent drainage calculations at tonight's meeting. The Chair stated this would be continued to the April 6th meeting. New Public Hearings Brooks School —Watershed Special Permit John Scott addressed the board regarding two single-family housing units that are proposed to being built at the school. One of the homes is located in the non-discharge area. Jim Pugh explained the location of the homes to the board. Mr. Scott stated that all the questions from VHB have been addressed. Nardella asked about the gutters and roof run off. Mr. Scott stated that the driveway run off is running in to swales. The roof run off will be directed to underground infiltration systems. The Planner stated that all of the VHB questions have been addressed. Angles asked why the applicant did not move the home out of the non-discharge area. Mr. Pugh stated that it preserves the mature trees and grassy area and houses outside of the non-discharge area may impact the observatory. The PIanner asked the applicant if there is a recorded deed restriction in regards to fertilizer. Mr. Scott stated that he was not sure. She stated one would be required for this permit against the parcel in question. Angles stated that he would like to see a draft decision prior to the next planning board meeting. Angles instructed staff to prepare a decision. Motion by Simons to close the public hearing, second by White Discussion: none Motion carries 5-0 Decisions 80 Saile Way Motion by Nardella that the Planning Board approves the Watershed Special Permit as amended this evening for 80 Saile Way, second by White. Discussion: none. Motion carries 5-0. 492 Sutton Street The Planner discussed the decision with the board and asked if a 1,000 bond would be enough. The board agreed a$1,000 bond would be sufficient. s Moban by Nardella that the Plannin__board approve the 492 Sutton Street as amended this evening,second by Schwarz. Discussion: none. Discussion: none Motion carries 5-0 Discussion Items: The Planner read the Town Counsel letter regarding Time Frames for Special Permit Decisions. Nardella would like the Planner to address the issues at Northeast storage. There are dead plantings and there are excess trucks in the area. The applicant stated last year that he would replant this spring. Angles instructed the Planner to review this site. The Planner addressed the board in regards to Jared Place. The board stated that the applicant said he would take care of this in the spring. The Planner stated she would contact the applicant. Motion by Nardella to ad'ourn at 9:40pm, second by Schwarz.
