5 J. Simons Chairman: The Planning Board meeting for Tuesday,January 30, 2018 was called to order at 6:20 p.m.

7 CONTINUED PUBLIC HEARING: WE CIAL TOWN MEETING ZONING ARTICLES:
8 Article 2: Citizen Petition—Prohibition of Non-Medical Marijuana
9 Article 4: Amend the Town of North Andover Zoning Bylaw- To Replace Section 8.13-Temporary Moratorium
10 on Recreational Marijuana Establishments with Section 8.13-Marijuana OverlayDistrict.
11 Article 5: Amend Zoning Map—Marijuana Overlay District(MOD)
12 J,-Enright: Provided a copy of the Planning Board Report and presentation material. Informed the Board that is has
13 been suggested by the Town Manager that the Board may want to vote during this meeting to recommend
14 withdrawal of Articles 4& 5 if Article 1 were to pass. It is my understanding that the Board of Selectmen (BOS)
15 will be taking a similar vote regarding Article 3 at their meeting tonight.
16 M. Rosen: Confirmed the BOS voted to recommend withdrawal of Article 3 if Article l passes.
17 _Board: Reviewed the Planning Board Report and presentation material. Discussion pertaining to the minority
18 opinion slide in the presentation. Majority members(in summary): hotly debated topic and it needs to be clear that
19 the Planning Board recommended Favorable Action 3-2,the minority report is not based on facts, should not be in
20 the presentation,and should not be given from the stage, but rather at the floor, the effort was to consider a bylaw
21 not a project. Minority members (in summary): it is factual and it is about the bylaw, not the project, it was agreed
22 there would be a minority opinion can't change the minority opinion because you don't like it, it will be made
23 clear that if you are in favor of a large scale marijuana cultivation facility this is a good bylaw that would protect
24 the town.

26 MOTION: E. Goldberg made a motion that if Article 1 passes the Planning Board recommends withdrawal of
27 Articles 4 and 5. P. Boynton seconded the motion. The vote was unanimous, 5-0 in favor.

29 MOTION: .1. Luz made a motion to close the public hearing for zoning amendment articles 2,4, and 5. P.
30 Boynton seconded the motion. The vote was unanimous, 5-0 in favor.

33 MOTION: J. Luz made a motion to adjourn the meeting. The motion was seconded by E. Goldberg. The vote
34 unanimous, 5-0 in favor.
