Chair 25 explained the procedure to the assembly and stated that the following petitions would be 26postponement as follows: 27 28 POSTPONEMENTS: 29 30 Joe Levis, 1003 Osgood Street, Map 35,Lot 50. Modification to a Site Plan Review Special 31 Permit to relocate the access roadway and parking lot reconfiguration. Landscaping plan not 32 complete. Waiver on file until March 6h. Requested to be heard March 60h. 33 34 Juniper Woods Realty, LLC, Juniper Woods, Map 108A, Parcel 2— 8-Lot, Single-Family 35 Definitive Subdivision and Planned Residential Development. First meeting date: August 1, 36 2006. Waiver on file until March .20th. Requested to be Beard March 61h. 37 38 GFM General Contracting Corp., 1812 Turnpike Street, Site Plan Review Special Permit. 39 Construct 25,900 s.f retail/office building within General Business zoning district. PB asked 40 engineer to add more information to the site plan. Waiver on file until March 13h. Requested to 41 be heard on March 6rir` 42 43 San Lau Realty Trust, 109-123 Main Street, Site Plan Review Special Permit. Proposed 44 renovation of existing Messina's Shopping Center includes construction of new buildings in the 45 area of the existing market, retail pharmacy and liquor store. G-B zoning district. Attorney 46 Smolak requested to be heard on March 6th. Planning Board Minutes of the Meeting February 20,2007 Page l 1 2 3 Chair announced there are no discussion items tonight. 4 DISCUSSION: 5 None 6 7 8 Chair then called 12 Bonny Lane. 9 CONTINUED PUBLIC HEARING: 10 11 1. Bonny Realty Trust/Amy Constantino, Trustee, 12 Bonny Lane, Map 62,Lot 41. 12 Watershed Special Permit to construct a single-family dwelling with attached garage, 13 driveway, and associated utilities within the Non-Disturbance and Non-Discharge Buffer 14 Zones of the Watershed Protection District. Can/Com issued an ORAD on 1/20/07. 15 Attorney Borenstein requested to be heard at Feb. 20th PB meeting and stated that this 16 project involves a single family lot in the Watershed. Stated he did confirm delineation 17 line w/ConCom. The engineer did tweak the design to work on the driveway to 18 minimize the retaining wall. Atty. Borenstein did confirm the ownership issue, one acre 19 located in the Watershed, this lot was held in joint ownership when Lot# 10 and Lot 412 20 were held together from 1983 to 1987. In 1987 they were transferred into separate 21 ownership. See letter for the record. Mr. Cammett, Engineer, 297 Elm St., Amesbury, 22 MA stated that he revised the plan to show 100 foot buffer zone, proposed structure of 23 6300 s.f., non-disturbance area, includes driveway, footprint and grading area. Revised 24 plan indicates that proposed structure is further away from wetland area in order to 25 reduce the grading impact, reduction to 5700 s.f, in no disturbance zone total is 26 approximately 10%. Reduced structure from 1600 to 1200 s.f, retaining wall is 80 feet 27 in length in SW corner; in NE corner it's approximately 90 feet. Applicant will apply 28 for a variance if the PB is satisfied with this plan tonight. PB would not have a problem 29 approving this as long as the ZBA give their approval for a variance. PB suggests that a 30 better plan was presented tonight. Edits: 92 I in VHB review certification to qualify of 31 water-put in decision.. #3 PB wants to reduce disturbance -put in decision. VHB 32 utilize layout cat's for site lay out plan#10 - make sure VHB gets the plan submitted 33 tonight. Lincoln read letter form VHB confirming they reviewed the alternate plan. PB 34 asked what standards they used to treat water quality? Third alternative plan shows 35 more qualify for water treatment. PB is wetland self contained or does it drain into 36 lake? PB wants a specific reply to the VHB letter point by point from Atty. Borenstein, 37 come back on March 61h as long as Atty. Borenstein has addressed VHB review. Draft 38 decision for next meeting. Put in the decision if the property is held in common 39 ownership or in separate ownership. Put in decision this is contingent upon the granting 40 of the variance, this will fall away if the variance is denied, put in the date of tonight's 41 plans in the decision.
