(Continued from May 16, 2006) Jack Hashem, Lisa Lane, Map 98A, Parcel 75 Application for a 2- lot Subdivision. First meeting date to be May 2nd. Decision due: July 14, 2006. (Continued from May 16, 2006) PLANNING BOARD "OLD BUSINESS": 1. Sherwood Drive/Jared IV Subdivision - Completion of subdivision roadway and tot- lot, Last meeting: May 2, 2006 Action Item: Town Planner to update punch list of items and cost estimates Update: The Town Plainer, "Town Engineer, and Conservation Administrator conducted a site visit to assess the subdivision roadway. Gene Willis, Town Engineer, will provide an updated cost estimates to complete the road and tot lot. 2. Stone Wall, CVS Pharmacy located on Rte. 114/Turnpike Street. . DISCUSSIONS: 3. Rte. 114 Corridor Development District Zoning Language—Discussion of amending language in preparation for Town Meeting. Last Meeting: May 2, 2006 Action Item: Received language from Mr. McGregor's Attorney to modify uses within CDD2. Update: The Planning Department is in receipt of the proposed language changes from Attorney Trombly in a letter dated May 10, 2006. The primary concerns raised by Attorney Trombly involve as-of-right uses for buildings in excess of 3,000 sq. ft. and the inclusion of fence shop/manufacturer and seasonal sale of shed (and like equipment) as allowed uses within the CDD2. 4. Treadwell's Office Building Project, 1025 Osgood Street, Map 35, Lot 20. Modification to Site Plan Review Special Permit to change the building footprint and parking configuration. Last Meeting: First meeting is May 30, 2006 Planning Board agenda May 16,2006 Page 1 Update: Due to complications in receiving the necessary permits from the FAA to construct a two-story building, the owners of the property are considering modifying the approved site plan and watershed special permits by eliminating the second floor, increasing the footprint to 7,614 sq. ft., and increasing parking by approximately 13 spaces. 5. Merrimack College— Discuss a modification to the enhance and internal roadway. Last Meeting: First meeting is May 30, 2006 Merrimack College is before the Planning Board to discuss relocating their main entrance from Andover Street in North Andover across the Town Boundary line on to Elm Street in Andover, a distance of approximately 180 feet. In addition, the internal roadway would also be modified to accommodate the new entrance and the project would result in the elimination of more than 10 spaces. CONTINUED HEARINGS: 6. Warrant Articles Article #40 Amend Zoning Map--Davis Street—Assessors Map 70—Parcel 18 From General Business (GB)to Residential 4 (R4). Pla ming Board to provide recommendation. Since the last meeting, Mr. Levis decided not to go forward with this Warrant Article. He intends to withdraw the article at the Town Meeting. Planning Department recommends that the Planning Board recommend taking unfavorable action. Article 944 Amend Underground Utility Bylaw,Chapter 170. To see if the Town will vote to amend Chapter 170, Section 3(C)— UndergroUnd Utilities to read "Downtown Area: Main Street from SLItton Street to Merrimac Street, including 200 feet from Main Street for the following side streets—Waverly Road, First Street, and Second Street, all of School Street, and on Water Street from Main Street to High Street. (Petition of the Board of Selectmen) Planning Department recommends that the Planning Board recommend taking favorable action. Article #43 Amend Bylaws 178, Section 9 - Wetlands Protection. Planning Board to provide recommendation. The Planning Board did not take any action on this Article. As such, the Planning Board will need to make a recommendation. Planning Department recommends that the Planning Board recommend taking unfavorable action due to the non-descriptive and vague language. 7. Cingular Wireless, 0 Chestnut Street— Special Permit to attach antennas to centerline height of 122' on existing 152' tower and to install 11'x 20' equipment shelter, (Continued from May 16, 2006). Last Meeting: Continued from May 16, 2006 Update: At the last meeting, the applicant presented the proposal. Planning Board agenda May 16,2006 Page 2 Recommendation: Upon heating all of the information and presentations, close the Public Hearing. The application satisfies the narrow purview of the Planning Board which to grant a Site Plan Special Permit under Section 8.9 (see enclosed decision). As part of a settlement agreement between the ZBA/Town and the Cingular Wireless, the Planning Board should grant the Site Plan Special Permit. PUBLIC HEARINGS: 8. Stephen Smolak, 425 Waverly Road, Map 22 Parcel 130 - Site Plan Review Special Permit to construct a four unit residential dwelling into a three unit residential dwelling. Last Meeting: Discussion Item---May 7, 2006. First Public Hearing- May 30, 2006 Update: At the last Planning Board meeting, the Board determined that a formal site plan application needed to be filed due to the increase of the buildings footprint(> 2,000 sf). Given the rather odd circumstances and the status of the project(building permit already issued), the Planning Board requested the applicant submit a simplified application for review. Upon review of the application submitted, a number of items need to be provided in accordance with Section 8.3 of the Town Bylaw (see enclosed review). All of the items can be addressed internally. Recommendation: Direct Staff to draft decision. 9. 1503 Osgood Street, Map 34, Parcel 7—Site Plan Review Special Permit to redevelop a portion of the property to construct an automobile service station for gasoline sales with no automobile repair, retail convenience store and deli, and drive-thru doughnut shop. Last Meeting: First Public Hearing—May 30, 2006 Update: The Town Staff and the outside consultant performed an initial review of the project raising several concerns involving drainage and stormwater management, traffic (access, site lines, sources of information and general methodology), and general public safety. (Please refer to the enclosed project review). Recommendation: Continue to the June 1$1" Planning Board meeting to incorporate the recommendations of Staff and the Outside Consultant. 10. 586 Mass. Avenue, First Calvary Baptist Church---- Special Permit to install 3 panel antennas concealed within the existing church spire and 3 proposed equipment cabinets. Last Meeting: First Public Hearing—May 30, 2006 Update: Enclosed please find a letter from the Inspector of Buildings dated April 12, 2006 stating the application is exempt from the 600 minimum setback rule in Section 8.9.3(e)(v)(I) of the Town Bylaw. The Inspector of Buildings determined that the aforementioned section does not apply to the proposed installation of antennas as the antennas will be, installed within the existing structure (Church spire). In accordance with Section 8.9.3(c)(v)(2), in the event that a preexistent structure is proposed as a mount for a wireless service facility, the setback provisions of the zoning district shall apply. Planning Board agenda May 16,2006 Page 3 The applicant submitted a complete application including a comprehensive list of waiver requests. The application satisfies the purview of the Planning Board with which to grant a Site Plan Special Permit under Section 8.9; 1. The specific site is an appropriate location for the project as it is being located within a pre-existing structure and will maintain the current appearance of the Church. 2. The use as developed will not adversely affect the neighborhood as indicated by the analysis conducted by Ian Hopkins, RF Engineer. 3. The carrier has demonstrated that the facility is necessary in order to provide adequate service to the public. 4. The plan meets the requirements of the Wireless Service .Facilities By-law section 89. 5. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Recommendation. Upon completion of the presentations and information presented by the applicant and abutters, close the public hearing and direct Staff to draft a decision. DRAFTED DECISION(S): 11. Arthur's Pizzeria, 1060 Osgood Street,Map 35, Parcel 29—Modification to the approved Site plan Review Special Permit to construct a drive-through. Last Meeting: Continued from May 16, 2006 Update: At the request of the Planning Board, a decision has been drafted for the review. MINUTES: Approve the April 18, 2006 & May 2, 2006 "Minutes".
