Minutes of Commission Meeting, October 9, 19741 regular monthly meeting.
Present and voting: Mrs. Trombly, lair. D'Angelo, Mr. Chepulis, Mr. Lafond;
Not Present: Mr. Resca, Mr. Lewis, Mars, Kittredge

2. The Commission reviewed complaints received on activities which may oome under the
jurisdiction of the Wetlands Aot.A. Y
Building Inspector, Mr.;I'ostex, has received a number of phone calls from
neighbors complaining of Mr. Emile Giard, Appleton Street, filling in a swC py area
on his property. A check of the: fides showed no former DNP{

A discussion of the project indicated that the Commission was not aware of the
scope of the project and that many area residents were concerned that 'this would create
a much wader roadway. Mr. Cyr showed plans indicating the work and the Commission
requested that he stop any further work until he formally filed a Notice of Intent and
received a legal permit for the work. Mr. Cyr was agreeable to this and indicated
that he would file immediately. The Commission set up the hearing date for October 16,
1974 at 8 P.M. F
3. The Commission reviewed a number of proposals for Land acquisition and the current
parcel.: under consideration.
A. A setter from Mrs. Elliot of Berkeley St. was read. It suggested the Commission
consider the Flatley site on Andover St. for possible acquisition. The Commission stated
that since it was not in the sake watershed nor in the green belt area it was not of
high priority in the open space program. It addition, it was pointed out that since
plan for development had already been considered, the price of the parcel would be
beyond the town's present means. A letter is to be sent to Mr,.Elliot thanking her for
her interest in the acquisition program, but explaining why the Commission cannot con—
sider the purchase at this time.
B. A number of letters to the Selectmen and Commission by Mrs. Mary Armitage, Sutton
Hill Rd. , suggesting purchase of the Appledore site off Johnson St. were entered into
the record. members stated that this would be an excellent site but that with our
committments to other parcels and the approved plans for the site, the cost of even
the ponds section would be beyond the town's present means. A letter to Mrs. Armitage
was to be prepared with copy to the Selectmen explaining that at this time the Commis—
sion could not undertake purchase. It would consider approaching the separate otimers
for conservation easements.
C. Mrs. Trombly stated that no response had been received from the Globe Field and
Stream Club, Inc. with reference to the Commission offer of x;43,000.
D. A letter was received from Mr. Martin Steinberg stating his acceptance of the
Commission's offer of 532,000.00 for the Ray's Pond parcel. It was a8-reed to write to
Mr. Steinberg indicating our firm intention of purchase. Mrs. Trombly was directed to
contract for the second full appraisal needed for the state. Mr. D'Angelo was directed
to inquire .for approximate costs of surveying.
E. Mrs. Trombly inquired from members who had been with the Commission a, number of
years why Mr. Ben Osgood's offer of land a number of years ago was turned doiui. Mr.
Chepulis indicated that at the time the Commission was hesitant to take on a land
acquisition program without a more substantial knowledge on procedures and maintenance
responsibilities. Mrs. Trombly suggested that, since Mr. Osgood seems to have developed
Coachman's Land asfar as he. intends, it might be worthwhile to approach him regarding
the possibility of acquisition of the remaining swampy acres. It was decided to write
a rather unspecific letter to Mr. Osgood inviting him to 'the next regular meeting to
discuss his future development plans for Coachman's Forest.
4. A copy of a letter dated October 1 , 1974. from DNR to Methuen Construction Co. was {
received by the Commission. It stated that DNR would not suspend the Appledore (242-6)
permit provided that the dam design for the ponds and the provision for maintenance of
control structures and siltation were received by DNR by October 15), 1974, In that no
copies of these plans were requested 'to be sent to the local Commission, it was decided
to send written request to Atty. Victor Hatem for copies for the Commission.
j. Notice was given of the fall meeting of the MACC at U. Mass. , Amherst.
6. Notice: from the U. S. Environmental Protection Agency, Boston Office were received
on two applications from North Andover industries for discharge permits of wastewater:
Davis and I'urber and Western Electric. Although no comment was to be made on the cases,
it was decided to send away for the fact sheets on the two cases.

7. lir. La.fond presented the final plans for the Town Garage facility. The Commission
reviewed these and decided to notify the Town Garage Committee of thein sa.ticfaction with
the plans. H wover, because one of the alternate proposals called for elimination of the
salt and sand shed, the Committee was to be advised that a formal filing under the Wet—
lands Act would be recommended to insure proper disposition of these materials.
