HomeMy WebLinkAbout1951-02-26February 2 6, 1951 The meeting was called to order ~F the Cheir~-~ at 8~IOP.M. in the Town Building. .This meeting was continued from the previous week and was also a continued Public Hearing. Members presentt Ch~_r,.~_n, Peter Ritehie, Eich~d G. Whipple, Gregory Mooradkanian, ~dwin Reinhold and Lym~ H. ll~lton. Also ,resent were ~r. Harry Sutton, Mrs. R~m-~dell, Mr. Hogan, Mr. Smith and Mr. Wilkinson all but Mr. Wilkinson being abutters. Mr. Wilkinson is a member of the Sutton Hill Co. Mr. Kilton stated that after viewing the location he did not approve of any alteration in the plans until proof was given taht the developers will provide suitable streets in back of the old mansions and that the new road should be 50 feet wide without the trees. He stated that he thought that the present residents of this development should be pro- tected rather than the future be~ers. He thought that the present resi- dents had a difficult time of getting in and out of their property at the present time. Mr. Brasseur stated that the streets were now 50 feet wide and that the grades meet the requirements and that the law does not require that the trees be removed. He stated that he thought that it was beyond the power of the Board to require that all the trees be remeved. Mr. Whipple stated that he did not quite agree with Mr. Eilton as this was not a brand new proposition but only a proposed tw?rovement over the old plans. Mr. Rrasseur s.tated that on the old road the grade was about 12% and that this new road would be very much less. Mr. Mooradkanian then stated that it is within the power of the Board to require a bond of performance to be set, 'so that the roads would have suitable grades and that there was suitable access t~ t~e pre~aises for fire fighting equipment et~. He stated that no me~ber would want to act unreasonably but that to a certain extent the developers have not acted to the best interest of the present owners in this location. That they (the present owners) had received verbal rights of w-s~ which la~er they had been deprived of and that an~ further tw~povements should be to the best interests of these present residents. He stated that in his opinion this new plan was ~ decided ~,.?rovement over the o~d plan but that there were several items which could be perfected. Mr. Hogan stated that he also thought that this plan was an improve~ent over the old one and he thought that it would be a shame to out down the trees. He stated that there were children in this development and with the trees located as they were, drivers would be apt to be more careful that if the road was a bare one and that in his opinion it would spoil the beauty of the roadway. He stated that he thought the road should not look like a highway but more like a country drive. Mr. Brasseur stated that these were only pre~mt-~ry plans and that the bounds had to be set and other work done before they came back for final approval. It was moved and seconded at this point that the Bo~-d go into executive session, 4i The following is a copy'of au inform~l_ letter sent ~o the Sutton Hill Uompany Inc., a~ter the meeting held on February 2 6~ l~S1 The Planning Board would grant a tentative approval to a pre1 ~-~ary plan dated February 19, 1951 submitted bythe Sutton Hill Co., Inc. and Showing certain modifications and changes from an original plan of "Sutton Hill Development"~ so called for which approval had been given to said Sutton Hill Co., Inc. some years ago. This tentative approval would modify and chau~e the approval given to the origina~ plan in these followi~g respects~ 1: Cancel and revoke the improvement and building of that portion of a road shown as Sutton Hill ~oad on the original plan beginning from its intersection to Johnson Street and extending to its intersection with Heath Road. 2: Extending Heath Road as shown on said prel~m~uary plan to the point of intersection with Johnson Streete The above changes and modificati~--~ are hereby tentatively granted with the understanding and on the condition that approval of the planning Board to a final plan incorporating the above changes to be submitted to the Planning Board shall not be granted and final approval to the same shall be witheld unless these following~ conditions ~r~ fully complied with and carried out by said Sutton Hill Co.~ Inc. or its representativesj successors and assigns: 1: That the extension of~ saud Heath Road fron its intersection with Sutton Hill Road to its intersection with Johnson Street~ and the said Sutton Hill Road beginning from its intersection with said Heath Road to a point at or near the southerl~ 11~e of property now or formerly owned by Francis S. Barrows as shown on said plan originally approved by the Planning Board, sh~11 be built and 1reproved so that the said roads shal~ have maximmm grades not exceeding 6~ % to be surfaced by gravel at least eight inches in depth and bed of the road to have at least twenty-two feet in width of gravel to have lines and grades as shown on said prell mt ~ary plan. 2~ That said final plan for final and definite approval by the Planning Board shall be submitted to the Planning Board by the owners of this sub-division development within one year from date of approval of this p~eliminary plan.
