Mr. LuNd stated that actually he did not as he could raise what he needed without aw permit b~t when it came to s el~g he could not build a stand or greenhouse unless it was re-zoned. When asked if the smaller piece of lar~ would suffice for this purpose he though% that it woulde N~ further explained to the Board that the smaller piece of land was b~, ~r~ed on two side by land that was classed as i~dustrial as it bordered the railroad tracks of the Boston and Maitre Railroad. This smaller piece of laud is n~w zoned as General Residential. Mr. Lund stated that if he could have the ~aaller plot re- zoned for A~gricultural District then he would ask for a non-conforming use permit from the Board of Appeals in order to erect the stand that he had in mind~ since this could be done in an Agricmltugal District only. Motion was made and' seconded and it was voted to tak~ this matter advisement. Application was then received from Edward W. Saul~ requesting the approval of the Board for a proposed amendment of the Zoning B~-Laws of the Tow~ %o change the c!~__~sification o~ a parcel of ~roperty~ owned by ~im from Agricultural to Business. This application was advertised in the Evening Tribune on November 22 and November 29~ 1952e Mr. Saul was present and stated +~at he ~d conduhted his garage business at this location for over five years or se'and that he had been doing this under a non-conforming use permit which had been granted y~arly. This permit of course ~its him t~ a certain extent and he felt that he now would like to s epara~e his business and his home so that each would be mx separate lots. When questioned as to what he intended to de in the future~ he stated that he had no intention of se3]~ng used cars or an~ng of tb~t sort~ in the first place he stated he did not have the room but he felt that he would like to have his filling station in a business District and not his home. Houghton Farmbam was present and stated that he lives about 1/8 of a mile from this location and that there were no filling s tatio~m for more than four miles awa~ and that it was very convenient for the people in this location to have the station at this point. He further stated that Mr. Saul h~ been running a nice clean and attractive filling station for several years and he felt that the petition should be approved, John Farnum who lives across the street, stated that he owns 30 to 40 acres of land at this location and he also was in favor of the petition being approved. He stated that the station was very neat amd very handy and that in his opinion there was no room for ar~v extra business activities or to build any other bUilding at this site, Mr. William ~ Smith~ ~'iley Court also stated tbst this station was very neat and very handy and he felt that it should be approved for re-zoning. Motion was made and seconded and it was voted to take this matter under ad- visement. The petition of Henry E. Lund was then discussed by the Board and all the members felt that in view of the fact that Mr. Lurid had stated that he could manage with the smaller piece of land for the present, they would p~fer to grant approval on~y on that parcel, It was then decided to talk further with Mr. Lurid. Mr. Lurid was asked to return to the meeting and questioned further. He agreed that if ~be Board felt that the Board would rather approve only the sm~ller parcel of ~ecember 1, 1952-Cont. land he could get along with that for the present~ as this particular parcel was the one en which he intended to build the stand or small greenhouse~ when and if it was re-zonede He also agreed to present new plans to the Board which would show only the ~mall~r piece of land which was to be approvede These will be filed with t he Board and also a copy will be filed with the Town Clerk and the Board of Assessors. Motion was then made ~nd seconded ahd it was unanimously VOTED to gzaut approval on this petition for the smaller parcel of land only~ for the present. The application of Edward Saul was then discussed by the Board~e~ I~' view of the fact that there was no opptsition since this filling station had been in operation for several years and these factors were carefully considered by the Board. However, it was felt that re-zoning ~kes the control of the property awa~ and that anything can replace it if and when it is re-zoned for Business. The fact was brought out that if in leter years Mr. Saul wished .to sell his property, that anything' could happen there and although it was not a very large piece of property it could turn out to be undesireable if anything else but a filling station was operated at that location. Motion was then made and seconded to grant the petition~ After i~arther deliberation, it was VOTED by' a .majority vote of 3 to 2 that the petition should be given approval. Since this Board only requires a majority vo.te, this petition was then approved. Ail abbutt~rs of both the Lu~ petition and the Saul petition were notified of the Public Hearing and also of the decision of the Board. A copy of the pla~ for both was filed with the Town Clerk and a copy also was filed with the Board of Assessors. Motion was then made and seconded and it was voted to adjourn at 10:30 P.M.
