Chief Cyril Feugill of Methuen spoke in favor of the ~etition stating that they
had an~open air theathre in Methuen and that they have had n.o trouble wi~h noise
or traffic. He stated that thes® ~rea are constantly policed, that they cater to
f~milies who are out for a iittle A~,eement and that there is generally no disorder.
Attorney John Eareli.tz~ representing Mrs. John Griffin stated that this type of
business is a constant traffic ~azard and that *there is ~ ~lWa~ ':~ noise with so
ma_-y cars coming and going. He also stated that when .the speakers go out of
co~ ~sion the persons in 'the cars blow their hems to attract the attendant' s
attention and that this can be ver~. annoying. Mr. £arelitz .stated that his client
had built a substantial ho~e in North ~ndover on the assuption that she was locating
in a Residential Area only to find that business area wbre sl~inging bp in vari~,_s
spots around her property, He stated that if this petition was approved it would
be discovered later that it would not be for the best interest of the inhabitants
of the To~. He stated that ~his type of business invite~oro~ds which in turn
~kes for oongestion~ confusion and traffic accidents.
Mr. ~eorge R. Barker an abutter, stated that he was not in favor of a~reving this
perdition because he felt that this would devaluate his property and that he felt
that this was an undesireable element to in-ing into this Town.
Mr. Forgotta who lives aortas the street from the property in question objected
to its approval of _the-'petition because of the noise and nuisance it would ~r~ato.
Mrs, Nora, s Greenwood objected to this proposition as a parent stating that this
type of business was a general n~isanoe which attracted the high school age group
and that ~aUy of them brought liquor in. their cars and she felt that this Town
should guard against Juvenile Delinquency.
Mrs. Caroline Rogers stated that she owns[.prepert~ close by and she felt that this
would depreciate the value of her land. She wished to he recorded as objecting.
The following persons also wished to be recorded as obJectin~ to the approval of
this petition. Mrs. Madelin~ Foerster~ John Osgood~ Robert SaltonstaJ_l, Horatio
Rogers, Mrs. Griffin, Norm-- Gree~ood, MarJorie Howe, Mr. Heoper~ Carefree Salton-

Motion was then ~ade by Mr. ~ipple, Seconded
voted to take the ~atter under advisement.
The Board then went into aa executive session.

After so~e deliberation, The Chai~ of the Board requested that the Secretary of the
Board be allowed to take over the ~eeting to a~low hi~ Mr. Nicetta to stoke a ~otion on
the application of Guy B. Howe, Motion was ~ade by Me. Whipple~ Seconded by Mr. Driscoll
and it was un~usly voted to allow the Secretary of the ~oard to take over the meeting
for this petition. A motion was then ~ade By Mr. Nicetta~ seconded by Mr. Lee and it
was voted three $~o tee to deny the application of Mr Howe. Mr. Driscoll and Mr, ~hipple
did not vote on this applications The reason ~for denial was that ~t would not be for the
best interests of the neighborhood to approve this petition.
The application of John Slipkowsk~ was then considered0
A ~otion was made by Mr. ~il~an, seconded by Mr. Lee and it was a :~o~r ta:~ne vote to
approve this petition. Mr. Whipple voted in opposition. The reasons for approval were
as follows~ 1- The land in question is not readily suitable for residential parposes.
2- The type of business proposed would not create a traffic hazard. 3- The land in
question borders on an already existing section zoned for business purposes.

The application of Albert A. Steinberg (Osgood Street) was then considered.
Motion was s~de by Mr. Whipplem seconded by Mr. Driscoll and it was vnanis~usly
voted to deny this petition for the following reasons. The Board feelg that no
c~R~ge should be ~ade at this location antil such time as further ~tudy has been
made by the Board and the Townspeople as to what area should be re-zoned for
business purposes on Osgood S$~reete
The application of ~eorge R. Barker was then considered,
Motion was ~ade by Mr. Whipple, ~econded by Mr. Driscoll and it was voted by
a four to one vote to deny this application. Mr. Nicetta did not vote on this
application. Reasons for denial were as follows~ 1-If this petition was approved
the Board would have no reason to deny further applications for business purposes
for the entire frontage on Osgood Street opposite the land acquired by the
Western Electric Co. 2- The Board further feels that until such ~ as they
have become acquainted with the complete physical developments of the Western
Electric Co. plant as to the beautifying ofits grounds and the attractiveness
of the buildings, they should not per, it any change in zo~g on the easterly
side of Osgood Street opposite said Western Electric Co. for business purposes.
3- The Board also feels that the approval of Business uses in this area should
be seriously considered by the Townspeople in its overall planning for son~
The application of Albert A. Steinberg on Barker Street was then considered.
Motion was ~ade by Mr. Lee, seconded by Mr. Driscoll and it was una-t*~usly
voted to deny this application for the following reasons~ 1- The intended
use of this location for an open air theatre would constitute a traffic hazard
because of the narrowness and contours of this heavily travelled road.
2-. The Board does not feel that the proposed use will promote ~he best
interests of the Town.
A ~otion was then ~ade by Mr. Ntcetta, seconded by Mr. Lee and~ it was
-un~sl~ voted to extend sincere thanks to Mr. Whipple for. his service
and cooperation while a me~ber of the Planning Boarde This was Mr. ~hipple's
last ~eeting.
Motion was then ~ade and seconded and it was voted to a~Journ the meeting at
lltOO P.M. The next regular meeting to,be held an April 5m 1954.
