The meeting was called to order at 8:00 P. M. by the Chairman. Members present were
Mr. Nicetta, M~. Finck, Mr. Osgood, Mr. Barman and Mr, Gilman.
Mr. Colgate came in to talk about an easement which he had presented previously. The
Board unanimously agreed that it was alright as long as the drain pipe was cut down
from 15" to 12". The Board, however, wants a plan showing the easement~ The Board
stated that the Board of Health should first give a permit of approval of the above
before the Planning Board will approve. The matter is to be taken under advisement
and Mr. Colgate will be notifed at a future date of their decision.
Mr. Marino came in with plans for his land on Woodstock Street. The regulations of
the Board call for catch basins no farther apart than 400 feet, and Mr. Marino's plan
does not comply with these regulatio~ · Mr. Nicetta stated that he should have two
catch basins at least 400 feet apart. It was unanimously ag~ed by the Board that the
Highway Department should insert an article in the Town Warrant to continue the drain
from Waverly Road up past Woodstock Street. Mr. ~arino had previously submitted a plan,
and the Board feels that it should be done in accordance with his original plan. The
drain has to be put in and the road has to be in conformity with the regulations of the
Planning Board. It was decided that Mr. Marino would have to come before the Bosrd of
Appeals for ~ petition for variance.
A letter was read from the Board of Selectmen ' regarding the permit granted £~ the
use of the B & M Railroad station building as an industry. Article ~l in the
Zoning By-Laws was read and discussed by the Board. The Planning BOard ~uestioned
the Article under which the permit was granted~ and they felt that Article ~l should
be made known to the Board of Selectmen. Actually, the Board of Selectment asked ~he
Planning Board to approve a plan which is actually against the Zoning By-Laws.
The Planning Board went downstairs and met with the Board of Selectmen to have t~his
situation clarified. The Clerk was instructed to write a letter to the B .& ~ Railroad
to the attention of W. H. Barrett of the L~w Department, with a copy to go to Mr.·
~.losky~ stating that Lhe validity of the permit is questionable and the zoning is
residential, and not industrial, a.~d if ~4r- Barrett so wished, he could petition for
re-zoning.
Mr. GiLman made a motion that the Board accept the services of Mrs. Betty Balzius as
the new clerk. '~otion was seconded by Mr. Bare,an. All in favor.
Mr. Salisbury's bill in the amount of $200. was discussed and the Board signed a
voucher 'of payment for same.
A voucher was signed by the Board for the payment of $300. to Mr. John T. Blackwell,
Planning Advisor.
T~e Board took a vote, all in favor, and it w~.s ~nanimously agreed to set a date for
a public hearing in the cases of Mr. Colgate and Mr. Roy Fart. The date of the
public hearings was set as Thursday, December 22, 1955.
