Public Hearing
The Hearing was called to order at 7:45 P. M. Members present: Nicholas Nioetta, Oh-~rm,,~
Job, Osgood, Secretary, Ralph Finck, Jam-_s Barman and Howard Gilman.
This Hearing was held on the petition of the Sutton H~ll Co., Inc., the petitioner being
Malcolm B. Beattie, President of the Incorporatio~ and petitione~. The notice of Public
Hearing as published in the Evening Tribune was read by the Secretary.
The Chs~rman qu~eStioned if anyone wished to speak in favor of the petition. )ir. Beattie
(petitioner) stated that previous plans were submitted to the Planning Board in 1946 and
were approved. He further stated the only ch,nge is on Heath Road sUCh as the pavement,
drainage. He also added a radius of curves has been added to conform 'with the Planning
Bpard regula-~iens.
Mr. Elwood Field, representative for Mr. Mrs. Hogan were against the petition. Ne stated
Mr. Hogan obtained a map from Mr. Floyd when he received notification of the Hearfn_~, and
upon e~wm~nation the coldersack would enable th~ petitioner to divide the property into
lots.
He further explained Mr. Hogan has had trouble with his septic tank, as the land does not
absorb water as it norm. lly should. Stewart Associates, Incorporated made tests in that area
the results, the water tables were high, and the water might produceaa health problem which
should he looked into.
Mr. E. Hogan, there is a tremendous problem of water. He stated there was a breach of faith
in connection with the eoldersack as it would enable the petitioner to 1~,~1~1 four or five
house~ more which would aggrevated the water situation.
Mr. Beattie, petitione~ stated he dida't believe they could get additio--l lots around the
coldersack. Mr. Hogan stated the fact that several towns have stopped the erection of coldex~-
sacks.

petition.
Mr. Chairm,n questioned if anyone was opposed to the petition. ILlfred Gielbunt, his cellar
is always wet. There is a tSb~ee or four inch pipe going into tk~_ street, and there's an
odor of sewerage from the ground, and if new developemants should he on Sutton Hill it would
be a serious health problem. He stated the ground is made mp of cla~ preventing the water
from seeping into the ground.
Mrs. ~. Perkins stated she also has aoticed odor from the sewerage. Mr. Gielbunt~ said it is
a nuisance. Mr. Hogan, could guarantee if the Board of Health looked over the field, they
could see sewerage running out of the ground as the clay is inpenatrable. Mr. Gielbunt, no
objection if a svwerage was put in.. Mrs. Perkins, it is unfair to the people on Milk Street.
At this point, the ~halrman said this Board is regulated by statu~e. Mr. Finck, stated if
residentw presenta are not saiisfied with the Board of Health~s decision it is their privilege
to take it to a court of law. Concerning this petition~ it is only the approval of the lay out
which is streets. The roads meet the conditions of the requ~r_ e~e. nts.of.t..he Zo.~_ g ~y-Laws,
