(the "Applicant") Dear Honorable Members of the Planning Board: This firm represents the Applicant in connection with an application for a site plan special permit from the Town of North Andover Planning Board (the "Board"). The Applicant seeks to install and operate a stealth wireless communications facility within the existing spire (the "Spire") on the existing church (the "Church") located on the Property. The Property is located in the Residence 4 (R-4) zoning district. The use of the Property for the stealth wireless communications facility is permitted by special permit pursuant to Section 8.9(3)(a)(iii) and Section 10,3 of the Zoning Bylaw of the Town of North Andover (the "Bylaw"). The Board recently approved the use of the Church for wireless communications purposes by MetroPCS. The Applicant seeks to install, operate, and maintain a stealth wireless communications facility (the "Facility") which will consist of up to four (4) wireless telecommunications antennas mounted within the existing Spire. The Applicant will replace existing windows within the Spire with radio frequency compatible panels that will match the existing windows in color, style and texture and will allow the Applicant's antennas to function properly. The Applicant's Facility is shown on the plans attached hereto, and incorporated herein by reference (the "Plans"). The Applicant's radio communications equipment cabinets will be located within the Church as depicted on the Plans. I. Background The Applicant is licensed by the Federal Communications Commission (the "FCC") to construct and operate a wireless telecommunications network in various markets throughout the country, including the Commonwealth of Massachusetts and in particular in the Town of North Andover. A copy of the Applicant's FCC license is attached hereto. The Applicant is in the process of designing and constructing a telecommunications system to serve all of the Commonwealth of Massachusetts. One of the key design objectives of its systems is to provide seamless coverage. Such a system requires a grid of radio transmitting and receiving Finks located approximately .5 to 2 miles apart, depending on the location of existing and proposed installations in the 8905671 lay PRINCE.LOBEL .GLOVSKY &TYE Planning Board Town of North Andover March 30, 2009 Page 2 surrounding area, the existing use of the network and the existing topography. The radio transmittingand receiving facilities operate on a line-of-sight basis requiring a clear path from the 9 P 9 � q g facility to the user on the ground. This dynamic requires the antennas to be located in a location where the signal is not obstructed or degraded by buildings or by topographical features such as hills. II. The Applicant's RF Coverage Determination The Applicant has performed a study of radio frequency coverage for the Town of North Andover and from the Property, the results of which are shown on the Applicant's radio frequency propagation maps submitted herewith. The Applicant has determined that the Applicant's proposed Facility located on the Property will provide adequate coverage to the targeted sections of the Town of North Andover and the immediately surrounding area if the Applicant's antennas are located at the height requested herein and as depicted on the Plans. In connection herewith, the Applicant has submitted a radio frequency propagation map which shows its current coverage and the gap in coverage that the proposed site will fill, and a radio frequency propagation map showing the anticipated coverage from the site. III. The Facility As depicted on the Plans, the Applicant's proposed Facility will consist of four (4) panel antennas installed behind the proposed replacement windows in the Spire of the Church. The Applicant proposes to replace the existing windows within the Spire with radio frequency compatible material. The proposed replacement windows will match the existing architecture and color of the windows. The antennas will be connected to the radio communications equipment cabinets by coaxial cable running within the Church. Three (3) Base Transceiver Station (BTS) cabinets and one (1) battery back-up cabinet will be located within a proposed 7' x 10' equipment room within the Church as depicted on the Plans. In addition, one (1) power and telephone board and one (1) HVAC unit will be located within the proposed equipment room. Further, one (1) HVAC condenser unit will be located adjacent to the Church and will be screened by the proposed landscaping as depicted on the Plans. Per FCC mandate, enhanced emergency (E91 1) service is required to meet nationwide standards for wireless communications systems. To comply with this federal standard, the Applicant will also install one (1) Global Positioning System (GPS) antenna and one (1) E91 1 GSM antenna. Both the GPS antenna and the E91 1 antenna will be mounted near the base of the Spire and will be painted to match the existing Spire. After installation, the proposed Facility will be unmanned and will only require bi-weekly visits by maintenance personnel who will inspect the Facility to ensure it remains in good working order. The Facility will comply with all applicable local, state and federal safety rules and regulations. IV. Legal Arguments A. The Applicant's Proposed Facility Complies with the Special Permit Criteria Set Forth in Section 8.9 of the Bylaw The Applicant's proposed Facility satisfies the requirements set forth in Section 8.9 of the Bylaw as follows: 1. District Regulations Pursuant to Section 8.9(3)(1)(iii) of the Bylaw, the Applicant's proposed Facility is permitted in the R-A zoning district. 2. Location In accordance with Section 8.9(3)(b)(i) of the Bylaw, the Applicant's proposed Facility utilizes an existing structure and will be concealed within the existing Church. 3. Dimensional Requirements In accordance with Section 8.9(3)(b)(i) of the Bylaw, the Applicant's antennas will be concealed within the existing Spire and located at a height of 105' above ground level (to the top of the antennas). Accordingly, the Applicant's proposed Facility will not increase the height of the Spire nor otherwise project above the height of the Church. Further, in compliance with Section 8.9(3)(b)(v) of the Bylaw, the Applicant's Facility complies with the setback provisions applicable to the use of a pre-existing structure.' The Applicant further understands that the its interpretation of the applicability of this section of the Bylaw is consistent with prior interpretations of the Bylaw issued by the Town of North Andover Building Inspector, including a reaffirmation of such opinion provided in connection with the MetroPCS application to locate a wireless communications facility within the Church on the Property. 878291.1 la, PRINCE.LOBEL.GLOVSKY&TYE Planning Board Town of North Andover March 30, 2009 Page 4 4. Design Standards a. Visibility/Camouflage Wireless Service Facilities (i) Camouflage by Existing Buildings or Structures. In accordance with this provision of the Bylaw, the Applicant's proposed Facility will be concealed within the existing Church. (ii) Camouflage by Vegetation. To the extent applicable to the Applicant's Facility located within the existing Church, the Applicant's proposed HVAC condenser located next to the Church will be screened by the proposed landscaping. (iii) Color. The Applicant's proposed Facility concealed within the existing Spire and Church complies with this requirement of the Bylaw. The proposed replacement windows will replicate the existing windows. (iv) Equipment Shelters. The Applicant's proposed radio communications equipment cabinets will be located within the existing Church and will not be visible from outside the Church. The Applicant's proposed HVAC condenser located next to the Church will be screened by the proposed landscaping. b. Lighting and Signage. The Applicant's proposed Facility complies with these provisions of the Bylaw. The Applicant's proposed Facility will not require the addition of any lighting or signage that will be visible from outside the Church. C. Historic Buildings. Scenic Landscape and Vistas. Not applicable. e. Environmental Standards. The Applicant's proposed Facility will comply with the provisions of Section 8.9(4)(e) of the Bylaw. f. Safety Standards (i) RFR Standards. As stated in the Affidavit of Radio Frequency Expert, the Applicant's Facility will comply with all applicable FCC guidelines and regulations concerning radio frequency radiation. (ii) Structural Integrity. The Applicant's Plans submitted herewith include a statement on Sheet C-1 at Note 4 that the Facility will meet State Building Code requirements. Further, if required by the Building Inspector, the Applicant will provide additional information demonstrating that the Church and Spire are structurally sound and capable of supporting the Applicant's proposed Facility. 5. Application Procedures: (a) General Filing Requirements In accordance with Section 8.9(5)(d) of the Bylaw, the Applicant has submitted the required information. (b) Location Filing Requirements In accordance with Section 8.9(5)(d) of the Bylaw, the Applicant has submitted herewith the required information. In compliance with Sections 8.9(5)(d) (ii)(4) and (5) of the Bylaw, the Applicant has provided information for its existing and approved wireless facilities in North Andover and within a one (1) mile radius of the Town. 878291.1 1q, PRINCE.LOBEL.GLOVSKY&TYE Planning Board Town of North Andover March 30,2009 Page 6 (c) Siting Filing Requirements The Applicant has submitted herewith copies of the Plans depicting its proposed Facility within the Church. To the extent that the Plans do not depict any of the required information, given the de minimis nature of the proposed Facility concealed within the Church, the Applicant respectfully requests a waiver from strict conformance with Section 8.9(5)(d)(iii) of the Bylaw. (d) Sight Lines and Photographs The Applicant's proposed Facility within the existing Church will not materially alter the visual aspects of the existing Church. Consequently, the Applicant respectfully requests a waiver from the sight line representation and photographs required by Section 8.9(5)(d)(iv) of the Bylaw because these requirements are more applicable to facilities that will not be concealed within an existing structure. (e) Design Filing Requirements The Applicant has submitted herewith the required information concerning its proposed Facility. To the extent the information does not strictly comply with the requirements of this Section of the Bylaw, given the de minimis nature of the proposed Facility concealed within the Church, the Applicant respectfully requests a waiver from the design filing requirements of Section 8.9(5)(d)(v) of the Bylaw. (f) Noise Filing Requirements The Applicant has submitted herewith a specification sheet for the HVAC condenser demonstrating that the Applicant's proposed Facility will comply Y with the Town of North Andover noise regulations. (g) RFR Filing Requirements The Applicant has submitted herewith the Affidavit of Radio Frequency Expert which provides that the proposed Facility will comply with all applicable FCC regulations relative to radio frequency emissions. To the extent necessary, the Applicant respectfully requests a waiver from the requirement of Section 8.9(5)(d)(vii)(3) of the Bylaw requiring an Applicant to provide "a copy of the letter from the Massachusetts Department of Public Health approving the site". (h) Federal Environmental Filing RgS uirements Not applicable. An Environmental Assessment is not required for the Applicant's proposed Facility concealed within the existing Church. 6. Co-Location Pursuant to Section 8.9(6) of the Bylaw, encouraging the use of existing structures and the co-location of wireless communications facilities the Applicant proposes to co-locate its proposed Facility within the existing Church previously approved by the Board for use as a wireless communications facility for MetroPCS. 7. Modification The Applicant will comply with the modification provisions of Section 8.9(7) of the Bylaw, to the extent lawful and applicable. S. Monitoring and Maintenance a. Radio Frequency Radiation. The Applicant has submitted herewith the Affidavit of Radio Frequency Expert which indicates that the proposed Facility complies with FCC regulations with respect to radio frequency emissions. The Applicant will comply with the monitoring requirements set forth in Section 8.9(8)(a) of the Bylaw, to the extent lawful and applicable, and otherwise reserves its rights. b. Acoustic Reports. The Applicant has provided specifications, including information concerning noise, for the HVAC condenser to be located outside of the existing Church. The small HVAC condenser will be the only noise generating equipment located outside of the Church and is smaller than most HVAC condensers that would be commonly found and utilized in a residential area. C. Condition. In accordance with the requirements of Section 8.9(8)(c) of the Bylaw, the Applicant agrees to maintain its existing Facility in good condition. 9. Bond As a condition of approval, prior to the issuance of a building permit,the Applicant will agree to provide a removal bond in an amount certified by a registered professional engineer registered to practice in the Commonwealth of Massachusetts. The Applicant respectfully requests that it be permitted to provide a removal bond or other surety in the necessary amount in lieu of a cash escrow to secure removal of the proposed Facility. B. There will be no nuisance or serious hazard to vehicles or pedestrians; The Applicant's proposed Facility will only be visited one to two times per month for routine maintenance. The Applicant's personnel will utilize the existing access to the Property. Accordingly, the Applicant's proposed Facility will not be a nuisance or hazard to vehicles or pedestrians on or near the Property. 4. Adequate and appropriate facilities will be provided for the proper operation of the proposed use; Adequate and appropriate facilities will be provided for the Applicant's proposed Facility. The Applicant will utilize the existing electric and telephone utilities already located on the Property. The Applicant's proposed Facility is unmanned and does not require water or sewer services, nor will it generate any trash, waste, rubbish or discharge any water or sewage. 5. The Special Permit Granting Authority shall not grant any Special Permit unless they make a specific finding that the use is in harmony with the general purpose and intent of this Bylaw. As enabled under its Federal Communications Commission (FCC) license T-Mobile seeks to design its wireless network in order to provide reliable wireless services to its customers, whether those customers are on the street, in a vehicle, or in a building. Providing reliable service to its customers in each context is critical for T-Mobile to provide the quality of wireless service that customers demand, and to meet the objectives of Congress that a robust, competitive and low cost wireless communication capacity be developed to serve the entire nation. 3. I have thoroughly reviewed the radio frequency engineering studies, reports, and computer model prepared by T-Mobile with respect to the subject wireless communications facility. I used Asset, a propagation modeling software developed by Aircom Inc., to simulate the proposed coverage created by the facility. This software calculates frequency strength over distance taking into account geographical, and topographical land features and other contributors to signal loss. Finally, this calculation has also been adjusted by empiric data obtained from field measurement. 4. In order to meet its obligations under the radio license T-Mobile must have in place a network of base station antenna facilities to serve portable wireless communication devices and mobile telephones. These facilities consist of antennas mounted on a pole, building, or other structures that are connected by cables to a small equipment cabinet located near the antenna. These antennas transmit voice and data to subscribers within a defined area of coverage. Likewise, the antenna receives the radio signal from mobile transmitters (such as telephones) which then goes to equipment located in the cabinet and to ordinary phone lines from which the transmission may be routed anywhere in the world. 5. Wireless antenna facilities are integral to T-Mobile's network. Each facility, servicing only a limited area, must be carefully located so that it can properly interact with surrounding facilities. To maintain reliable, uninterrupted service to a wireless telephone user living and/or traveling in a given area serviced by multiple antenna facilities, T-Mobile depends on a continuous interconnected series of facilities, which in-part overlap in a grid or"cellular"pattern. 6. In compliance with its FCC license, T-Mobile is actively building its PCS network to provide service in New Hampshire. In order to meet its goal of providing reliable, seamless and uninterrupted service T-Mobile must continue to acquire interest in property for additional facilities, and is applying for and obtaining local governmental approvals to construct the facilities in order to eliminate gaps in reliable service coverage. Any delay at this point in time severely curtails T-Mobile's ability to achieve a market position that will allow it to compete for customers, which is in the public interest. 7. Using precise computer prediction model and following a thorough review of the RF engineering studies and reports prepared by T-Mobile it was determined that a new facility in proximity to Main St., Water St., and State Rt. 125/133, in North Andover, MA is critical to the overall engineering and technical plan for T-Mobile's network. 8. The subject location has specific characteristics, of topography, relationship to existing structures and its location within the narrow search limits specified by the above referenced computer model, makes it uniquely suitable to address T-Mobile's need for a proposed wireless telecommunications transmission facility. With the above considerations the proposed site was determined to be the most appropriate location for a facility to fill the existing gap in service coverage within the context of available land parcels provided to me for analysis. 9. Without a wireless transmission facility located at or near this location, a significant area of inadequate, unreliable coverage would remain in T-Mobile's wireless network in the vicinity of the proposed installation. This lack of service area or "gap" in coverage would adversely impact the service T-Mobile is able to provide to businesses and residents of North Andover as well as travelers along State Rt. 125/133, Main St., Water St. and other primary roads through and around North Andover,MA. 10. The result of such a "gap" will be an inability for the T-Mobile customer to reliably initiate, receive, or maintain voice and data connections, including 911 emergency calls, from the time that subscriber leaves the service area until that subscriber reaches that point where a quality signal is available to reinitiate the communication link. 11. All proposed wireless communications equipment will be installed, erected, maintained and operated in compliance with all applicable Federal, State and local regulations, including, but not limited to: the radio frequency emissions regulations set forth in the 1996 Federal Communications Act, applicable regulations administered by the Federal Aviation Administration (FAA), Federal Communications Commission (FCC), and Massachusetts Department of Health. All equipment proposed is authorized by the FCC Guidelines for Evaluating the Environmental effects of Radio Frequency Emissions. The radio frequency exposure levels generated by the proposed facility are substantially below the maximum allowable health and safetystandards established b the FCC. Viable candidates consist of existing structures of sufficient height from which an antenna installation can provide sufficient coverage, or lacking such a structure, parcels located within the narrowly defined search area upon which a tower may be constructed to a sufficient height. In order to be viable, a candidate must provide adequate coverage to the significant gap in OCI's network. In addition, all viable candidates must have a willing landowner with whom commercially reasonable lease terms may be negotiated. Preference is given to locations that closely comply with local zoning ordinances, or in the event no viable candidates are determined to be located within such areas,to identify other potentially suitable locations,with preference given to existing structures in accordance with the Town of North Andover Zoning Bylaw(the"Bylaw"). 5. Based upon the height of the existing structure,the site was rejected by OCI's radio frequency expert because it did not provide adequate coverage to this significant gap in OCI's network coverage. c. New tower candidate located,Park at Steven's Memorial Library- 345 Main Street,North Andover,MA-The property is located within a Residential 4 zoning district. Because there is no existing structure at this location, a new communications tower would be required. However, based upon my review of the Bylaw, it includes a requirement that an applicant for a new tower demonstrate that there are no feasible existing structures that can be utilized by the applicant. Accordingly,because the Site is feasible for OCI's use, and because of other requirements applicable to new towers under the Bylaw, including without limitation, additional setback and screening requirements, in my professional opinion, the use of this property for a new communications tower is infeasible 888093.1 under the Bylaw.
