HomeMy WebLinkAbout1960-10-03Monday, October 3, 1960 Regular Meet_~ The regular monthly meeting of the Planning Board was held en Monday, October 3, 1960 at the Town Building. The meeting was called to order at 7:40 PM. Members present and voting were: James M. Be~nAn, Chairman, Robert Burke~ Secretary, George Farley. Mr. Nicetta arrived ~t 8:05 PM. William Chepulis and Norm~ Hughes of Osgood Street appeared before the Board asking if a permit had been granted to Bonelli & Carradin~ for excavation of their property on Osgood Street. Mr. Barman stated a permit to build a way and reduce to grad. te put in a building had been sisnged by the Planning Board but he knew nothing of excavating being done. The Board wxplained they h~d no enforcing power but this was up to the Building Inspector and the Board of Selectmen who are over the Building Inspector. Mr. Chepulis asked ~at is done when the permits have been violated. Mr. Barman stated when problems of this type come before the Board the first thing he does is contact Town Counsel for advice. Mr. Barman explained plans #hewing grade lines etc. under Section 5.3 of the Zoning By Law were presented to him by a lawyer from Haverhill. Mr. B~-~- said he tried to contact all the members of the Board but could only reach Mr. Farley and Mr. Gilman for their signatures. Plans were signed on September 27. Mr. Nicetta said he knew nothing of these plans and that he felt the Board had ne authority to ~t such permission. Mr. Banyan pointed out a percolation test could not be made ,~Bless the land comes to grade. Mr. Chepulis presented a set of rules and regulations to the Board but was told these were outdated. Mr. Burke asked if l°a4 has been taken off the land and was told it has been hauled away. A discussion was held on the probabilities of where the l~ad was being taken. Mr. Barman asked Mr. Chepulis if he will accept his authorit~r to get i~ teueh with T~wn Counsel. Mr. Chepulis asked why the Planning Board doesn't act more strongly. Mr. BAB-an explained until there is an existing condition one cannot call To~n Counsel. Mr. Bannan said this permission was given in good faith and if there is anything wrong the Planning Board would like to have it stopped. Mr. Chepulis questiened the Planning Board's interpretation of a way. Mr. Barman said he would get in teuch with Town Counsel on this. October 3, 1960 ~Cont) Mr. Nicetta told Mr. Chapulis the ByLaw stated the enforci~gpowers are the BdldingInspector and the Board of Selectmen if the zoning bylaws are violated. Mr. Chepulis asked what happened if the Building Inspector or the Board of Selectmen does not enforce the ByLaw. Mr. Nicetta said he feels under the circumstances the only thing that can be done is to get in touch with Toun Counsel. He said in his opinion the only thing to do would be to get a copy of the plans to see if any violation had been made after the Planning Board's approval. The only alteruative would be to tell Mr. Chepulis to go the the Board of Selectmen. The Board sta~ed if the excavating was on land owned by Bonelli & Co~radino this is a metterfor the Building Inspector. Mr. Chepulis said he would like to ask the Board as an entire body and as individu~s to co-cperate in enforcing the ByLaw. Mr. Barman shoed the Board the Street Map. The Board had a discussion on what should be done to the map in order to have it for Public use. Bills were signed for Mary Doherty N. E. Tel. & Tel. 10.50 8.35 lS. S5 Mr. Nicetta brought up the fact that the Highway Department had advertised forbids on Woodstock Street. Be read a section of the bids that do not meet with the Board's specifications. A discussion was held on this and said this would be looked into further. Mr. Burke moved the meeting adjourn at 9:30 PM. Mr. Nicetta seconded the motion. Unanimous vote.
