The applicant is requesting Variance from Section 7,Paragraphs 7.2(Street Frontage),7.3(Yard Setback),&Table 2,and Section 8,Paragraph 8.1 (Off Street Parking)of the Zoning Bylaw for dimensional relief in order to construct a new airplane hangar;and for a Special Permit from Section 9,Paragraph 9.1 (Non-Conforming Uses)of the Zoning Bylaw in order to extend a non- conforming use(airport)in the 12 zoning District Said premise affected is property with frontage on the West side of Clark Street and Holt Road within the I-2 zoning district. Legal notices were sent to all names on the abutter's list and were published in the Eagle-Tribune,a newspaper of general circulation in the Town of North Andover,on March 30 and April 6,2009. The following voting members were present: Ellen P.McIntyre,Joseph D.LaGrasse,Richard J.Byers,Albert P. Manzi,III,and Richard M.Vaillancourt. The following non-voting members were present: Thomas D.Ippolito, Daniel S.Braese,and Michael P.Liporto. The Board finds that owing to circumstances relating to the shape of the 520 acre Lawrence Municipal Airport land, and its multiple interior lease lot lines especially affects the Lawrence Municipal Airport and the M.E.M.L.V.,LLC lease area but does not affect generally the Industrial 2(I-2)zoning district in which it is located. The Board finds that a literal enforcement of the provisions of Section 7,Paragraphs 7.2,7.3,and Table 2 would involve substantial hardship,financial or otherwise,to the petitioner. The Board finds that there is a need for secure airplane storage. The Board finds that that there was no written or spoken opposition to placing anew airplane hangar on the existing outdoor airplane tie-down area, The Board finds that desirable relief maybe granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Bylaw and that the applicant has satisfied the provisions of Section 10,paragraph 10.4 and Section 7,Paragraph 7.2,7.3 and Table 2 the Zoning Bylaw in that the granting of this Variance will not adversely affect the airport or the surrounding neighborhood or derogate from the intent and purpose of the Zoning Bylaw. Also,the Board finds that the applicant has satisfied the provisions of Section 9,Paragraph 9.1 And Section 10, Paragraph 31 of thezoning bylaw and that the granting of this Special Permit to extend the pre-eausting,non conforming use(airport)in the I-2 zoning district. The Board finds that the Lawrence Municipal Airport is an appropriate location for airplane hangars,and this use will not adversely affect the neighborhood,rather,it will increase neighborhood and Town safety by storing airplanes in a secured hangar. The Board finds that there will be no nuisance or serious hazard to vehicles or pedestrians since access to M.E.M.L.V.LLC is via the controlled access North Ramp Road. The Board finds that securing airplanes is in harmony with the general purpose and intent of this Bylaw and that another hangar addition shall not be substantially more detrimental than the existing hangars to the neighborhood..
