The application was submitted by Kenneth Rea,44 Rea Street,North Andover,MA 01845,dated December 29,2000. Findings of Fact The Planning Board makes the following findings relative to this proposed preliminary subdivision plan: A. The Preliminary Plan does not adhere to all of the design standards indicated in Section 4.3 of the Town of North Andover Massachusetts Rules and Regulations Governing the Subdivision of Land in North Andover,Massachusetts,dated November,2000 as noted below. a) The Plan does not comply with Section 4.3.e of the regulations as the plans do not state whether the proposed street will be offered for acceptance to the town. b) The Plan does not comply with Section 4.3.1. of the regulations as a copy of the deed demonstrating ownership of the property and reference to any and all deeds, encumbrances and easements are not listed on the plan. c) The Plan does not comply with Section 4.3.5 of the regulations which requires the contiguous buildable area of each lot to be depicted The only reference to contiguous buildable area is shown on Sheet 1 listed with the Zoning District Information. The contiguous buildable area of each lot needs to be listed for each and every lot on the plan. d) The Plan does not comply with Section 4.3.7 of the regulations which requires the existing and proposed topography to be depicted at 2'intervals. The plan depicts the topography in 10'intervals. e) The Plan does not comply with Section 4.3.9 of the regulations which requires a statement describing the cut and fill operations,including a general estimate of the net import or export of the fill from the subdivision to be provided No such statement has been provided. f) The proposal does not comply with Section 4.3.16 of the regulations which requires a certification from a registered professional engineer in the Commonwealth of Massachusetts stating that the plans have been designed in accordance with good engineering practice and the design of the plans is in compliance with the purpose of these subdivision rules and regulations. B. The Preliminary Plan does not comply with the Town of North Andover Zoning Bylaw: a) It is unclear if the proposal meets the side,front and rear lot setbacks mandated by Table 2—Summary of Dimensional Requirements of the Town of North Andover Zoning Bylaw. Although Sheet 1 of the plans lists what the setbacks required are on the Zoning District Table, the plans do not indicate whether the proposed dwellings will meet these setbacks. The plans need to depict all of the building setbacks and their proximity to the proposed dwellings. b) It is unclear if the proposal meets Section 7.1.2 of the North Andover Zoning Bylaw. Section 7.1.2 of the North Andover Zoning Bylaw requires the minimum width of a lot to be a distance of 100 feet between the street frontage and the front buildingline. The plans need to depict this 100' between the p dep street frontage and the front building line of each proposed dwelling on every lot. As the applicant has failed to follow the procedures and provide the information required by the Rules and Regulations as demonstrated by the Findings of Fact the Planning Board herein DENIES this application for a preliminary subdivision plan. 1.
