The following non-voting members were present: Thomas D.Ippolito, Daniel S.Braese,and Michael P.Liporto. Upon a motion by Joseph D.LaGrasse and 2nd by Richard J.Byers,the Board voted to GRANT the applicant's request to WITHDRAW WITHOUT PREJUDICE the Special Permit from Section 4,Paragraphs 4.122.14.A.b, 4.122.14.1),and Section 10,Paragraph 10.31 in order to construct a new two family dwelling on the proposed Lot C2. Prior to the issuance of any Certificate of Occupancy,the applicant"demonstrate to the Board and or its designee that it has mitigated any and all water drainage and or run off flowing on or to abutting properties. Applicants duty to mitigate may Wade but is not limited to:preparing and supplying engineered drainage plans as determined by the Board and or its designee,to the extent required,thereby demonstrating to the Board and or its designee compliance as to this condition. 7. Prior to the issuance of a Certificate of Occupancy applicant shall demonstrate to the Board or its Designee,it has provided appropriate landscaping to delineate and screw abutting Properties as required by the Board and or its Designee thereby ensuring said petition is in keeping with the substantially similar and an appropriate fit of the neighborhood of said petition. The Board finds that owing to circumstances relating to the shape and location of the existing 234 Greene Street dwelling which is listed in the 2007 North Andover Flistorical Commission's List of 100 Year-old Structures, on the existing lot especially affects 254 Greene Street(Map 22,Parcel 5 1)and the existing structure but does no affect generally the Residential 4 zoning district in which it is located. The Board finds that a literal enforcement of the provisions of Paragraph 7.1&Table 2 and Section 10,paragraph 10.4 would involve substantial hardship,financial or otherwise,to the petitioner. The Board finds that Fredrick Soucy,6 Green Hill Avenue,stated he bad seen the proposed revised Plan of Land and proposed single family dwelling and had no objections to the revisions. There were no written or spoken opposition to the revised lot lines for proposed construction of a single family dwelling on the revised Lot C2 Great Oak Street. The Board finds that lots in the Waverley Road,Massachusetts Avenue,Greene Street,Linden Avenue,Great Oak Street and Green Hill Avenue area vary between 6,000 and 24,000 square feet with most lots less than the required 12,500 per North Andover Tax Maps 22 and 22.
