Order of Delineation (cont.) This Order of Resource Area Delineation determines the boundaries of those resource areas noted above and is binding as to all decisions rendered pursuant to the Massachusetts Wetlands Protection Act (M.G.L. c.131, §40)and its regulations (310 CMR 10.00) regarding such boundaries. This Order does not, however, determine the boundaries of any resource area or Buffer Zone to any resource area not specifically noted above, regardless of whether such boundaries are contained on the plans attached to this Order or to the Abbreviated Notice of Resource Area Delineation. This Order must be signed by a majority of the Conservation Commission. The Order must be sent by certified mail (return receipt requested) or hand delivered to the applicant. PROJECT DESCRIPTION - SUMMARY- Special Requirements to be met for Obtaining a Frontage Exception Special Permit - Attachment 1 —E\i.sting Lots Attachment 2•-Proposed Lots - Attachment 3 —Potential Lots FRONTAGE EXCEPTION SPECIAL PERMIT SUMMER STREET AND MOLLY TOWN ROAD NORTH ANDOVER MA PROJECT DESCRIPTION Mr. Gillen acquired two parcels of land, one with frontage on Molly Towne Road and the other on Summer Street in the hopes of minimizing the development that would take place on that land. The property on Summer Street(See attachment 1, Existing Lots, Lot 1) has 213 feet of frontage, 2 acres and a house on it. The Parcel of land on Molly Towne Road(Attachment 1, Lot 2)has 215 feet of frontage and 7 acres. With improvements to Molly Towne Road and the subdivision of this land,there is a potential for the development of five lots as well as the existing lot on Summer Street. (Refer to Attachment 3 —Potential Lots.)The development of Molly Towne Road will also encourage the development of land on the east side of Molly Towne Road. Mr. Gillen proposes to divide the land into 3 parcels(Refer to Attachment 2— Proposed Lots). The largest portion of the land, (Attachment 3, Lot 3)is 5.2 acres and will be added to his property on Spring Hill Road. Remaining land will be divided into two lots with frontage on Summer Street. Lot 1 will be a standard lot conforming to zoning regulations and Lot 2 will be a three acre lot with 50 feet of frontage. The sale of the two building lots will offset the land acquisition costs. The proposal conforms to the General Requirements To Be Met For Obtaining A Special Permit as follows. 1. The proposed use is in conformance with the residential zoning designation of the land is an appropriate use. 2. It prevents the overcrowding of land by proposing only two lots where five could be developed and by not developing Molly Town Road which would encourage development of neighboring parcels of land. 3. The values of land and buildings will be conserved by limiting the development of the property to two lots,thereby preventing overcrowding and providing open space. 4. The potential for traffic congestion will be reduced because the property will be developed to a lesser level than allowed by zoning. 5. Leaving the majority of the land as undeveloped and subdividing the land in conformance with zoning will prevent undue concentration of population. 6. The lot configuration and the open space will provide for adequate light and air. 7. Building along Summer Street rather than along Molly Town Road will allow easier access for fire protection and keep houses from being built nearer to 1 undeveloped and which will reduce the potential for brush fires. p 8. Through taxes the proposal will assist in the"economical provision of transportation,water,...,schools,parks,and other public facilities. The properties will be served by on site sewage disposal. 9. There aren't any bodies of water or watercourses on the property. 10. Maintaining the majority of the land as undeveloped will reduce the probability of losses resulting from floods. 11. The proposal will reserve the amenities of the Town by leaving land undeveloped. SPECIAL REQUIREMENTS TO BE MET FOR OBTAINING A FRONTAGE EXCEPTION SPECIAL PERMIT SUMMER STREET AND MOLLY TOWNE ROAD NORTH ANDOVER,MA The proposed special permit meets the requirements for a frontage exception lot as presented below. 1. The area provided is three times the minimum requires in the district—3 ACRES 2. The lot has a frontage of 50 feet and a minimum width of 50 feet.—50.01' 3. There aren't any other frontage exception lots contiguous to the proposed lot. —Assessor's Map Reference 4. It is located on an existing through street and is not located in any way that would block the future extension of a dead end street.-Summer Street 5. The creation of the lot will not adversely effect the neighborhood because it will conform to zoning and will allow the development of a single family home in a single family neighborhood. FINDINGS OF FACT: Lot 2 (as shown on the Special Permit Plan, revised 4/1/04)conforms to all of the criteria set forth in Section 7.2.2 of the North Andover Zoning Bylaw as follows: 1. The area lot exceeds by three times the minimum area required for that Zoning District(43,560 s.f.) as the lot contains 130,680 square feet. 2. The lot has a minimum continuous street frontage of not less than fifty(50) feet and a width of not less than fifty(50') feet at any point between the street and the existing home. The lot contains 50.01' of frontage on Summer Street. 3. There is not more than one other such lot with frontage contiguous to it. 4. The lot is located as not to block the possible future extension of a dead end street. 5. The creation of the lot will not adversely affect the neighborhood. The development of single family homes on a lot in excess of three (3) acres is in keeping with the current zoning and respects the rural character of the existing neighborhood. 6. The granting of this special permit will not be detrimental to the town as the alternative to the creation of this lot may be a 5 lot subdivision off Molly Towne Road, utilizing the land of Lots 2 &3. The applicant has placed a restriction on the development of Lot 3 (54 Spring Hill Road), which limits future development to no more than two single family residences in addition to the residence of 54 Spring Hill Road. 7. The creation of the frontage exception lot is in harmony with the general purpose and intent of this bylaw. 8. There are no wetland resource areas located between the street and buildable portion of lot 2. 9. The boundaries of wetland resource areas are currently being reviewed by the North Andover Conservation Commission. Upon final approval of the wetland resource area boundary by the Conservation Commission,the applicant shall submit a revised plan displaying the location of the approved wetland resource area boundaries, and the revised Contiguous Buildable Area(CBA)calculations. Upon reaching the above findings,the Planning Board approves this Special Permit with the following conditions: Special Conditions: 1.
