Regular Meeting
The PLANNING BOARD held their regular meeting on Monday evening, January 6, 1969
at 7:30 P. Fa in the Town Office Building. The following members were present and
voting: William Chepulis, Jr., Chairs--; George B. Farley and James M. Bannan.
Robert J. Burke was unable to attend due to illness. William B. Duffy, Jr., Esq.
~o,~ftted a letter of resignation to the Board. A special town election was held in
December, 1968 due to the death of Selec2~n Fred P. Oakes and W~lliam B. Duffy, Jr.
was elected to fill his unexpired term.
There were 10 people present.
HEARING: ZBL AMENDMENT -. Apartments
Mr. Chepulis read the legal notice of the hearing to be held to strike out the
sections of the Zoning By-Law pertaining to apartment developments.
The petitioner Donald Xeirstead was not present.
Norman Lents spoke in favor of the petition and said that there are no further facts
to be presented at this time that have not been given at previous hearings.
Carol Hegarty, 334 Osgood St., spoke in favor of the amendment; big apartment develop-
ments should be stopped.
James Deyo, Board of Appeals Chairman, asked if prior evidence presented at previous
hearings for this same reason would hold any substance.
Mr. Farley said this is a complete new hearing. Mr. BA~an said there is no need of
repeating everything again.. Mr. Chepulis said if people present want to present
arguments they can; that Mr. Lents is not the spoke~w~u for others.
Mr. Barman made a motion to conduct the hearing as usual and petitioners should present
their case~. Mr. Chepulis said this should be treated asa brand new hearing and
evidence should be presented.
Mr. Lents said it is not a new article - he thinks the Planning Board is playing games.
Further discussion was held and the hearing continued.
Atty. Charles W. Trombly urges the Board not to recommend the abolishing of apartments;
they are needed in North Andover. Authority should rematn with the Board of Appeals.
North Andover cannot go on without industry or apartments - that is progress for the
town.
Atty. John J. Willis is opposed to changing the Zoning By-Law as to apartments; they
should be retained. Elimt_~ation of them would be regressive action of the town.
This source of revenue is needed for the need. He pointed out the various apartment
developments in town and said that the Board of Appeals has done a good Job - it is
the kind of thing North Andover should retain and in its present form. He further
stated that this is a public hearing and the Planning Board is required to hold it
and evidence should be heard pro and eon. There has been no evidence presented
concerning the affirmative side of changing the By-law.
Ben Osgood spoke in opposition to the petition for the sam- reasons as given by the
two previous speakers.

Mr. Barman spoke about a question raised by Nr. Lents regarding the legal right to
vote if a petition was presented twice in one year; receiving unanimous approval
of Planning Board, etc. Would that statute apply to this particular case? Should
probably ask Town Counsel. He a~so pointed out that no o~e has c~ forth to cbR~ge
location of apartments, type, etc. - just trying to abolish them. The Planning
Board usually throws out a petition if the petitioner does not appear.
Mr. Chepulis explained that the Planning Board would like to m~ke some sort of
change in ZB~. relative to apartments - possibly stronger regulations; but
Planning Board recommendations have not bee~ followed at Towm Meeting.
Mr. Barman made a motion to take the petition u~der advisement and would like to
hear from Town Counsel as to legality. Mr. Farley seconded the motion. The vote
WaS 1~R~4 mous.
DOUGLAS E. WILSON SUBDIVISION:
Douglas Wilson and John Coady appeared before the Board. Mr. Wilson said the
road (Lisa Lane) has been hot-topped, sewer is in etc. and he would like to sell
3 lots and requests the Board to release them.
The Board informed them that reports will have to be received from the Board
of Public Works, Highway Department and Board of Health before a release can be
made.

BEN OSGOOD:
Ben Osgood appeared before the Board with the request that the bond and deposit
on Coachman's Lane be released as to lots 8 through 17, 26 and 27. On the Morning-
side subdivision all lots except ll, 35, 36 & 37 should be released.
Letters will be sent to the Board of Public Works and Highway Dept. for their
reports.
A general discussion was held by the Board members, Ben Osgood and Board of Appeals
chairman James Deyo relative to changes in the Zoning By-Law. The Board will
probably meet again during latter part of January to discuss the Zoning articles in
the warrant.
The Board discussed the resignation of Member William B. Duffy, Jr. since he was
elected a Selectman at a special election, and whether or not a meeting will be held
with the Selectmen to appoint a new member to the Planning Board until March election.
A special meeting ~ill be held on Wednesday evening, January 22, 1969.
The meeting adjourned at 11:00 P.M.
