HomeMy WebLinkAbout1969-01-22Wednesday - January 22, 1969 Special Meeting The Planning Board met with the Selectmen at 7:00 P.M. to select a new member to the Board to fill the vacancy caused by the resignation of William B. Puffy, Jr. The unanimous vote of both Boardswas to appoint Charles W. Trombly, Jr., Esquire. The PLANNING BOARD then held their meeting at 7:30 P.M. with the following members present: William Chepulis, Jr., Chairman; George B. Farley; James M. Barman and newly appointed member Charles W. Trombly, Jr. Mr. Burke was unable to attend due to illness. There were 8 people present at the meeting. John Roberts, Chairman of the Conservation Commission presented to the Board a draft of a flood plain zone amendment to the Zoning By-Law. He said maps would cost approx. $1,0OO and would show topography, property bounds, districts, etc. and that there would be alot of work involved. Mr. Bannan said that this couldn't possibly be done for Town Meeting and that he would not go for a Special Town Meeting. Mr. Chepulis explained that this amendment does not restrict the use of the land. More positive descriptions and use has to be given and still have to go by Zoning By-Law requirements. Have to get Board of Appeals permission. It protects people in the area~. Mr. Robertssaid he would like the Planning Board to help on the expenses of the maps. It was suggested that he contact Merrimack College and that part of the studies and assignments are surveying and this could be made a class project at very little expense. A lengthy discussion was held. Mr. Roberts will try to get more work done. Mr. Bannan made a motion to refer this matter to the Planning Consultant when there is one and take this under advisement for the present. Mr. Farley seconded the motion. The members will study the draft. Atty. John Lynch had a suggestion for an apartment amendment. As the result of the past Special Town Meeting action he thinks the present apartments are non- conforming. He proposes creating multi-dwelling districts, defined by metes and bounds to include the present apartments. This would also include the restrictions under Section ~.7. The land would have to be rezoned first and then go to the Board of Appeals for a special permit, making it a double check. The present apartments have to be protected. Atty. HarOld Morley also had a petition with a parcel of vacant land to be inserted in the multi-dwelling district. A lengthy discussion was held. They w~11 submit this suggestion as an article. Ben Osgood submitted a couple of articles that he would like the Planning Board to consider relative to cluster zoning. He spelled out the different requirements size of lots, setbacks, width of streets, etc. 7 acre requirement. January 22, 1969 - cont. Charles Foster, Building Inspector, appeared before the Board and read a letter from the Selectmen relative to a complaint of a large truck being parked on High Street. He stated that there is nothing in the Zoning By-Law to control it and the police can't do anything about it. He though maybe the Planning Board could have something inserted in the Zoning By-Law to control this. Ben Osgood suggested further that the town make an Industrial Park District in addition to Industrial S. & L. That it would be an asset to the town. Mr. Barman said he would go along with cluster zoning and the members agreed to sponsor it. He also made suggestions as to the exclusion of commercial activity in homes and to amend the number of persons employed in home occupations. The meeting adjourned at 11:00 P.M. WC Chairman Clerk Thursday, January 9, 1969 Special Meeting The PLANNING BOARD held a Special Meeting on Thursday evening, January 9, 1969 at the North Andover High School at 7:00 P.M., prior to the Special To~rn Meeting. The following members were present and voting: William Chepulis, Jr., Chairman; George B. Farley and James M. Bannan. This meeting was called to discuss the hearing held on Monday evening relative to the "Apartment Development" amendment o£ the Zoning By-Law. Mr. Barman made a motion to recommend unfavorable action. The Board felt that this ty~pe of amendment should be taken up at the Annual Town Meeting, not at a Special Town Meeting. The Board does not want to abolish the "apartment" section completely - there could be modifications. It is the intention of the Planning Board to bring in various zoning articles including revisions to Section 4.7 (apartments) of the Zoning By- Law. Mr. Farley seconded the motion and the vote was unanimous. The meeting adjourned at 7:30 P.M. WC AD Chairman Clerk
