Special Meeting
The PLANNING BOARD held a special meeting on Monday evening, December 18, 1973
at 7:15 P.M. at the North Andover High School, prior to Special Town Meeting at
8:00 P.M. The following members were present and voting: Charles W. Trembly, Jr.,
Chairman; Donald N. Keirstead, Vice Ch.; Fritz Ostherr, Clerk; William Chepulis and
John J. Monteiro.
The Board met so that all of the members could vote on the amendments to the Zoning
By-Law, for which hearings were held on December 13, 1972.
Article 1:
To strike paragraph (1~) of Section A.122, R~ district, amd insert a
new paragraph having to do with conversion of dwellings instead of
"buildings".
The Board discussed the amendment suggested at the last meeting and the proposed
article.
Mr. Keirstead said he doesn't feel the Board made a mistake when drafting this
section of the By-law and he made a motion that the Planning Board recommend
~-~FAVORABLE action; Mr. Ostherr seconded the motion and the vote was A-l, Mr.
Monteiro voted no.
The Board gave the following reasons:
1. By allowing for conversions and to~nhouses in the Zoning By-Law, the Board
feels it is a good way to provide lower cost, unsubsidized housing.
2. Conversions would prevent deterioration of buildings that are unsuitable for
their original use.
3. There are enough safeguards in the By-law to properly allow these uses to
remain in the Zoning By-Law.
Article 2: To strike "townhouses" from paragraph (15), Section~.122, RA district.
Mr. Keirstead made a motion to recommend UNFAVORABLE action; Mr. Ostherr seconded
the motion and the vote was ~-1; Mr. Monteiro voted no. The Board gave the same
reasons as for the previous article.
k~CHDIOCESETOWNNOUSEPROPOSAL:
A letter had been received from Atty. Dolan relative to the Archdiocese Town-
house proposal.
Mr. Keirstead said he felt this type of development would be more advantageous to
the town since the town won't own any of the streets an~,ay. He would accept the
restriction that they will not sell the lots. Mr. Keirstead then made a motion to
refer the letter to Counsel and ask can this legally be accepted in this manner
and have the Board go on record that the Board favors this type of development;

Mr. Trembly seconded the motion. Mr. Ostherr, Mr. Monteiro and Mr. Chepulis
objected. They said they have not seen the letter and ~ill not act on something
they have no knowledge of. Mr. Ostherr said the Board will be in trouble if we
start creating these mythical frontages and roads.
Mr. Keirstead withdrew his motion. Mr. Trembly said we could Just refer the
letter to Town Counsel and show him the plan and ask him, if we approved it, would
it be legal. The Board agreed to this.
The meeting adjourned at 7:55 P.M.
