HomeMy WebLinkAbout1975-11-17November 17, 1975 - Monday R~gular meeting The PLA~ING BOAP~held a regular monthly meeting on Mo~day evening, November 17, at 7:30 P.N. in the Town Office Meeting Room. The following members were present and voting: Fritz Os%herr, Vice-Chairman; Paul Ri Lamprey and John J. MonteArc. Messers. Chepulisand Salemme arrived later on in the evening. PLANS NOT REQUIRING APPROVAL: (Lot 7A) 1. Scott Properties - Boston Et.: Ai~ter viewing the plans, Mr. Nonteiro made a motion to endorse the plan of la~d dated Nov. ~4, 1975 as not reqlAi~ring apprc.~l under sutxlivi- wion control iaw and Mr. Lamprey seconded. The vote ~as unanimous. 2. Scott Properties - Boston Et.: ~ot 4A) This lot is abutting the subdivision and a motion was made byMr. Lamprey to endorse the plan of land in North Andover, Ma. dated Nov. 17, 1975 as not requiring approval under s~division control law, Mr. Monteiro seconded and the vote was unanimous. 3. Sullivan - ~ummer Et.: ~he letter accompanying the application from Atty. Gerald Lewis w~e read. This land is in an R-2 Distr~ct. A mo~ionwas made by John Montetro to endorse as not requiring approval the plan owned by Sullivan and revised Nov. 17, 1975. Mr. ~_~mprey seconded and the vote was unanimous. ~PRESCOT2 ST. NURSIN~ ~0~EPLANS A~DAPPLICATION: Mr. Ostherr, Acting Chairman~ and member of the subdivision control onbco?~ittee questioned why the BOARD Was being asked to s~ a form that stated the plan is dated June 23rd when the plan is dated Nov. 3rd. Mr. Callak~a said his secrstarymust have put the previous date on it. Mr. Monteiro asked if the subdivision control subcommittee were in accordance with evers~hing else and ated that it pe ed BOARD OF APPEALS DEOISI(~PS: 1. Scott Properties, Inc. -Denial on Boston Bt. 2. Webber's of North Andover - Approval of Variances on Mass. Ave. 3. Hereford Corporation- Granting of Earth Removal Permit. Mr. Lamprey took exception with the statement in the decision regarding the agreement between the Board of Appeals and Hereford and questioned why it did not come under Sec. 5 of the By-Law. The section regarding a 6 month renewal of an existing permit was brought ou~, also. Mr. O~herr suggested tha~ the BOAPd) apprise Town Counsel of its concern about ~he matter and show him a copy of the By-Law. At the same time, he suggested filing a formal appeal against the Board of Appeals decision. A motion was then made by Mr. Lamprey to send the Board of Appeals a letter expressing Planning Board displeasure and request from the members of the Board of Appeal~areccnsiderationvote. Mr. 0~herr seconded the motion and the vo~e was taken. Ail members were present for the discussion and the vote was recorded as follows: Messers. Chepulis, 0stherr, Lamprey and Monteiro in favor and Mr. Salemme against. Mr. Lamprey made a motion to contact ~Lrnold Salisbur~with the intention of appealing this decision to Superior Cour~ and at the same time request permission from the Select- men to use Town Counsel in our behalf. Mr. 0stherr seconded the motion and the vote was: 4 members in favor with Mr. Salemme opposed. MATTERS: Sutton Industrial Park - Mr. Ostherr stated that the Subdivision Control ~ubcommittee had met ~lth Atty. J. Ford, Atty. Willis, Sr., Joe Borgesi and Bud Oyr. The attorney for November 17, 1975 - cont. the GLED didn't seem to feel that they had fee in the roads. However, he was going to go back to the District to see if they would acquire fee in the road and if they did they would he taking over the whole roadway from Sutton St. in. We haven't made ~ny committments and neither h~ve they, said Nr. Ostherr. He commented further that he would like to ask the Selectmen to request inviting Arnold Salisbury to sit in on the nex~ meeting whenever it occurs. He will also notify the whole Planning Beard at that time. Sign By-L~w Committee - Mr. Ostherr asked if the BOARD had any specific objectives for him inasmuch as he is the delegate to this Committee. Mr. Lamprey and Mr. Nonteiro said they would go along with the feelings as stated at ~he last meeting. Salem Gardens Subdivision - the BOARD advised the secretary to W. rite a letter to Mr. Sullivan requesting a status repor% inasmuch as this subdivision is to be completed by Dec. 1, 1975 aCcord~ing to our records.
