HomeMy WebLinkAbout1988-08-22The Board of Appeals held a Special Meeting on Monday evening, August 22, 1988 at 7:00 p.m. in the Selectmen~s Library and Conference room. The following members were present and voting: William Sullivan, Acting-chairman, Augustine Nickerson, Clerk, Walter Soule, Raymond Vivenzio, Anna O'Connor and Louis Rissin. The meet- ing opened at 7:10 p.m.. UNDER ADVISEMENT - DECISIONS Geor~ina & Crai~ Mitchell - Special Permit - 95 Candlestick Lane Discussion held about the possibility of a fenced in area for the daycare play area. Mr. Rissin stated that the property is almost too private and that the area closest to the driveway was dangerous to small kids and the play area should be fenced in, and Mr. Nickerson agreed with that. Ms. O'Connor stated that she does not feel that a fence is necessary, Mr. Sullivan has the same concerns as every one about the back yard being close enough to the wooded are for the kids to get lost quickly, and he feels that a 3' fence should be put in, at least in the two ends near the house and driveway. Upon a motion made by Mr. Rissin and seconded by Mr. Nickerson, the Board voted, unanimously, to GP~T the Special Permit, as requested, subject to the following condition: 1. A permanent fence, at least 3' high, be installed to completely enclose the designated play area. (Sullivan, Nickerson, O'Connor and Rissin) North Andover Texaco Variance & Special Permit - 980 Os~ood St. Upon a motion made by Mr. Nickerson and seconded by Mr. Rissin, the Board voted, unanimously, to GRANT the variance Special Permit as requested, subject to the following conditions: 1. That there be no signs, logos or advertising on the canopy, on either side, front, or rear, or on the roof. 2. That the lighting be surface mounted underneath the canopy, facing down. (Sullivan, Nickerson, O'Connor and Rissin) Willow Park Daycare Center Special Permit - 65 Flagship Drive Mr. Nickerson read Attorney Joyce's letter about extending the time period and about the new plans. The letter extended the time to the last August meeting. The Board feels that the Police and Fire Department should be asked.to see if any of the changes reqnested had been made. The Board feels that the safety factors should be addressed by the Fire and Police Departments and new letters sent to the Board. Mr. Nickerson referred to the bylaw and read a few to the Board. Mr. Soule feels that the chemical sites are to nearby(ChemLawn}. Upon a motion made by Mr. Nickerson and seconded by Mr. Vivenzio, the Board voted, unanimously, to DENY the Special Permit as requested. (Sullivan, Nickerson, O'Connor and Rissin). DISCUSSION AND VOTE Upon a motion made by Mr. Vivenzio and seconded by Mr. Nickerson, the Board voted, unanimously, that this matter be referred to the Board of Selectmen with the request that it be sent to Town Counsel for appeal. Page 2 DECISION Dilip Mukerjee, MD - Special Permit - 14 Main Street Upon a motion made by Ms. O'Connor and seconded by Mr. Nickerson, the Board voted, unanimously, to GRANT the Special Permit as requested, subject to the condition that the petitioner present revised plans to the Town Planner showing the curb cuts on Main Street and parking, and that this revised plot plan be complete prior to our next regular meeting.(Sullivan, Nickerson, O'Connor and Rissin).
