HomeMy WebLinkAbout1987-03-19SPECIAL MEETING - March 19, 1987 The Board of Appeals held a Special Meeting on Thursday evening, March 19, 1987 at 7:40 p.m. in the first floor meeting room. The following members were present and voting: Mr. Frank Serio, Jr., Chairman, Mr. Alfred Frizelle, Vice-chairman, Mr. William Sullivan and Ms. Anna O'Connor. The meeting was held in order to take a vote on whether to reconsider the petition of Leslie & Constance Sheppard who had applied for a variance from the requirements of Section 7, Paragraph 7.1 and Table 2 of the Zoning ByLaws so as to permit the continued existence of two (2) lots in an R-2 zone, one of which is at present undersized due to rezoning. At the regular meeting on March 10, 1987, the Board had voted to grant this variance as requested, but due to additional information submitted to the Board by the Director of Planning and Community Development, the Board felt that a meeting to determine whether or not to reconsider this petition was in order. Attorney J. Willis, Jr. spoke for the petitioner and presented tnL Board with a copy of the ~eed which wa~ shown to all members. Attorney Willis stressed the fact that the peitioner purchased the property prior to the change in rezoning and he did not feel that reconsideration of this petition should be done. Karen Nelson, Director of Planning & Community Development referred to the letter she had sent to the Board and also the minutes of previous Planning Board meetings that up- held her claims regarding dates of purchase. Ms. Nelson stated that the lot in question is not a buildable lot, is in the Watershed District and this variance should not be allowed. Upon a motion made by Mr. Frizelle and seconded by Ms. O'Connor the Board voted to adjourn the meeting. The vote was Mr. Serio, Mr. Frizelle and Ms. O'Connor. in favor and Mr. Sullivan opposed.
